870 Pape Avenue - Transfer of Easement
for Vehicular and Pedestrian Access

The East York Community Council recommends adoption of the following report
(April 13, 1999) from Mr. Quinto M. Annibale, Loopstra, Nixon and McLeish, Solicitors for
the East York Office:
Purpose:
This report to Council concerns a request by Upper East Side Developments Inc. to execute and
register on title a Transfer of Easement for vehicular and pedestrian access in favour of the owner
of Part 122, Plan 66R-18066 over Part 123, Plan 66R-18066.
Funding Sources:
The cost of preparing and registering these releases will be paid by the owner.
Recommendations:
It is recommended that:
(1) Loopstra, Nixon and McLeish, Solicitors, be directed to prepare and register on title a
Transfer of Easement; and
(2) the appropriate City officials be authorized to take such actions and execute such document
as may be necessary to give effect to Recommendation No. (1).
History:
The request for the Transfer of Easement is required in order to allow vehicular and pedestrian
access in favour of the owner of Part 122, Plan 66R-18066 over Part 123, Plan 66R-18006 so that
the owner of Part 122, Plan 66R-18066 may access their property along the laneway and in order to
have access to their garage located at the rear of their property. Staff of the East York Office have
no objection to the granting of such vehicular and pedestrian access.
Part 123, Plan 66R-18066 was acquired at the time the Subdivision Agreement was registered in
order to provide for the opening of the laneway to Pape Avenue at a later date, if necessary. At this
time there is no access to Pape Avenue along this laneway.
Conclusions:
We have circulated the request for the Transfer of Easement to City Planning Staff - East York
Office and they have confirmed that there are no concerns with respect to this. It is appropriate to
allow vehicular and pedestrian access in favour of the owner of Part 122, Plan 66R-18066 over
Part 123, Plan 66R-18066.

Installation of Disabled Persons
Parking Space on Gledhill Avenue
(City Council on May 11 and 12, 1999, adopted this Clause, without amendment.)
The East York Community Council recommends adoption of the following report
(April 7, 1999) from the Director, Transportation Services, District 1:
Purpose:
To report to the East York Community Council on the proposed implementation of a disabled
parking space adjacent to 260 Gledhill Avenue.
Financial Implications:
Funds to undertake the installation of the disabled parking space in the estimated amount of $500.00
are contained in the Transportation Services Division 1999 Current Budget request.
Recommendations:
It is recommended that:
(1) Schedule 'E' of By-law No. 34-93, entitled "To provide for disabled person parking permit holders", as amended, be further amended to implement a disabled parking space on
the west side of Gledhill Avenue from a point 49.0 metres south of Barker Avenue to a point
54.5 metres south of Doncaster Avenue;
(2) this disabled parking space be removed when Mr. Sydney Norman no longer resides at
260 Gledhill Avenue; and
(3) the appropriate City Officials be authorized and directed to take the necessary action,
including the introduction of the necessary Bill in Council to give effect thereto.
Comments:
The Works and Emergency Services Department received a letter from Mr. Sydney Norman,
260 Gledhill Avenue, dated February 15, 1999, requesting a disabled parking space adjacent to his
residence. A copy of Mr. Norman's disabled parking permit was provided.
Gledhill Avenue, between Lumsden Avenue and Barker Avenue, is currently regulated by overnight
permit parking between 11:00 p.m. and 5:00 a.m. A "No Parking Anytime" restriction exists on the
east side of the street, and the west side is regulated by the unsigned 3 hour parking regulation when
the overnight permit parking regulation is not in effect. The property at 260 Gledhill Avenue does
not have access to on-site parking.
Overnight permit parking records from the pervious permit period show that parking permits on
Gledhill Avenue sold 6 permits out of a total of 17 permit parking spaces. The implementation of
a disabled parking space would effectively eliminate one overnight permit parking space, but will
not have any negative effect on the on-street permit parking availability on Gledhill Avenue.
In accordance with the policy of the former Council of the Borough of East York regarding
notification of proposed disabled parking spaces, the neighbouring residents will be notified by the
City Clerk's, East York Office, that this report is being presented to the East York Community
Council.
Conclusions:
It is recommended that a "Disabled Parking Only" space be installed on the west side of
Gledhill Avenue, adjacent to 260 Gledhill Avenue. The removal of one on-street parking space on
Gledhill Avenue is not expected to significantly impact parking in this area, since overnight parking
permit, have not been sold out for the past three permit periods.

The East York Community Council recommends that the following report (March 31, 1999)
from the Director of Community Planning, East District, be received:
Purpose:
The purpose of this report is to seek direction from Council regarding appeals of the two Committee
of Adjustment decisions described below. This report is for the consideration of the East York
Community Council at their meeting of April 28, 1999.
Recommendation:
It is recommended that this report be received for information.

2. Variance Application A.20/99EY
Anthony and Kleoniki Barkas
Re: 37 Beechwood Drive
The owners of 37 Beechwood Drive are proposing to construct a detached garage in front of their
detached dwelling. Their proposal requires variances from the maximum lot coverage and side yard
setback requirements, and a variance from the zoning provision prohibiting accessory buildings in
front of the house. On February 16, 1999, the Committee of Adjustment approved the variances. The
owners also requested a variance to permit a deck on the roof of the proposed garage, which the
Committee of Adjustment refused. The decision was appealed to the Ontario Municipal Board by
a neighbour who objected to the approval of the three variances.
Staff did not take a position on this application, and do not recommend that Council direct staff to
attend the Ontario Municipal Board hearing.
3. Variance Application A.22/99EY

Re: 47 Vanderhoof Avenue
The applicant is proposing to construct a second storey addition and a one and two storey addition
to the existing one storey detached dwelling. On March 16, 1999, the Committee of Adjustment
approved a variance to the side yard setback requirement, but refused the applicant's request for a
variance to the floor space index requirement.
Staff did not take a position on this application, and do not recommend that Council direct staff to
attend the hearing.

Public Meeting Held in Accordance with the Planning Act
with respect to an Application for Zoning By-law Amendment

(City Council on May 11 and 12, 1999, adopted this Clause, without amendment.)
The East York Community Council, based on the findings of fact and conclusions,
recommends adoption of the report (April 9, 1999) from the Director, Community Planning,
East District, subject to the applicant providing each Member of the East York Community
Council, prior to the meeting of City Council scheduled to be held on May 11, 1999, shadowing
diagrams showing the impact of overshadowing on the adjacent residences on
Meighan Avenue as at June 21, at 8:00 p.m.
The East York Community Council reports having requested the applicant and City Planning
officials to meet with interested residents from Dawes Road and Meighan Avenue to discuss the
most appropriate type of trees to be used in the landscaping of the development to address the issues
of privacy.
The East York Community Council reports having held a statutory public meeting on April 28, 1999,
in accordance with Section 34 of the Planning Act, and appropriate notice of this meeting was given
in accordance with the Planning Act and the regulations thereunder.
The East York Community Council submits the following report (April 9, 1999) from the
Director, Community Planning - East District:
Purpose:
To review an application for a zoning by-law amendment that will facilitate the development of the
north-east corner of Dawes Road and Gower Street with 11 street-front multiple-attached
(townhouse) dwellings.
Financial Implications:
Costs associated with this development will be assumed by the developer.
Recommendations:
It is recommended that City Council:
(1) approve the application by 1314661 Ontario Limited, to amend Zoning By-law No. 6752, by
rezoning the lands at 401 Dawes Road from Residential R1B to Residential R2A - Site
Specific, which would permit the development of 11 street-front townhouse units; and
(2) enact the Zoning By-law substantially in the form attached.
Background:
Proposal:
This application, submitted by Peter Pitino, on behalf of 1314661 Ontario Limited, requests
Council's permission for a site specific re-zoning. It is intended to facilitate the development of this
property with 11, street-front townhouse units (see Exhibits 1 to 3 inclusive). The 1,529.2 m2
(16,460.2 sq. ft.) site is currently vacant and is
located on the north-east corner of Dawes Road and
Gower Street.
Comments:
Official Plan Policies and Zoning By-law:
East York's Official Plan designates this property
for low density ground related residences including
townhomes such as those proposed by the developer
and requires Council to:
- encourage housing intensification, including development, redevelopment and infill at
suitable locations provided it has no adverse impacts on the character of the adjoining
residential areas;
- promote the provision of additional housing units in order to maintain adequate supply and
range of quality housing types;
- encourage the development of a compact urban form which minimizes energy consumption.
Staff are satisfied that this development advances these policies and is appropriate for this location.
The present zoning is residential R1B which permits detached dwellings on 12 m wide lots with
370 m of lot area. If approved this application would require a site specific zoning amendment.
Building Height and Site Design:
The recommended site and building design shown on Exhibits 1 to 3 inclusive, show a project which
orients six and five townhouses along the respective frontages of Gower Street and Dawes Road. The
siting of the houses respond to the corner location by accenting its relative prominence, by improving
the local pedestrian environment and facilitating safety. It also has an added advantage of
minimizing the problem of direct overlook by locating all but two of the newly proposed houses
away from the adjoining properties.
The proposed single access point to Gower Street is preferable to multiple access points to the street
from the individual dwellings and has been endorsed by the City's design and traffic divisions.
The location of the parking area at the north-east corner of the site is dictated by the siting of the
houses along the frontages of Gower Street and Dawes Road and by the desire to minimize the
number of access points to these streets. The parking area will be screened via a solid fence which
will extend along the length of the site's eastern property line and along a major portion of the
northern boundary and which will be secured through the Site Plan approval process.
The proposed height of the buildings at 9.75 m (32 ft.) although higher than the surrounding
residences, can be supported on the basis that it does not introduce extensive overshadowing and that
it represents the generally accepted height for townhouse developments throughout East York. The
shadowing diagrams submitted with the application indicate that there is some overshadowing of the
properties to the north and east of the proposal during the winter months. These properties were
similarly impacted by the previous gas station which although lower than the townhouse dwellings,
was located closer to these properties boundaries.
The design of the site and the built form will be scrutinized in a separate Site Plan report which will
be approved by the Director of Community Planning for the East District. The Site Plan approval
will require the development to be constructed in accordance with the drawings attached to this
report and will ensure that all functional elements such as landscaping, or snow storage are included
in the project's design.
Staff believe that, on balance, the design of the proposed development is acceptable and should result
in a built form that represents an attractive addition to this neighbourhood.
Access and Parking:
The parking spaces for the units fronting onto Dawes Road are located directly behind each unit and
the parking spaces for the Gower Street units are located within a common parking area in the north
east corner of the site. Entrance to all these parking spaces is at the east end of the property and
consists of a two-way, 5.75 m (18.9 ft.) wide private driveway leading to Gower Street. The
proposed eleven parking spaces meet East York's Zoning By-law standard which requires that
parking be provided at one parking space per unit and that it be located behind the main front wall.
The City's Transportation Division comments indicate that they found both the proposed access and
parking provisions to be acceptable.
Shared Elements:
The design of this project requires shared use of facilities such as the laneway accessing the rear
parking area as well as laneway lighting and fencing. The presence of such shared facilities
generally entails a condominium form of ownership. In this case, the applicant wishes to sell the
project as freehold housing. This means that the future owners of the project will have to enter into
private agreement(s) to secure the continuing maintenance of these elements.
The City's policy generally discourages freehold housing involving shared elements and suggests
that such developments, particularly if they involve a large number of ownerships, should proceed
by way of a condominium. Condominium ownership is preferable because it tends to provide greater
certainty regarding the legal and financial ability of householders to resolve future problems.
However, the policy also recognizes that in instances where the risks are minimized by the size of
the project or the type and number of shared elements, freehold ownership may be an option. From
the applicants perspective, freehold ownership is supported by current market preferences and by
the fact that it will save him considerable costs associated with the imposition of a condominium set
up.
Staff believe that due to the relatively small size, and the type and number of the shared elements,
freehold ownership can be supported on this site.
Parkland Dedication:
As per East York By-law No. 85-92, the applicant will be required to make a 5 percent cash-in-lieu
of parkland dedication payment.
Site Servicing:
The site servicing plan for this project proposes: individual storm, sanitary and water services
connected to local services on Gower Street and Dawes Road, drainage for the common driveway
to a catchbasin and a storm sewer connecting to Gower Street.
The City Engineer notes that the provision of servicing to the site will require the construction of
approximately 30 metres of new storm and sanitary sewer on Gower Street. This work will be done
at the owner's expense.
Site Clean-up:
The proposed development will be located on a site formerly used for a gas station owned by
Petro Canada. Petro Canada has extensive experience with such site's decommissioning. The
developer provided confirmation (contained in the Offer of Purchase and Sale), that the land will
be fully decommissioned, the clean-up done according to MOE's Guidelines, and that Petro Canada
will assume full responsibility for all the matters related to the site's condition.
Agency Circulation:
The application was circulated for input to all appropriate agencies and City departments. Responses
received from the circulation, have been used to modify the project's design and to formulate
appropriate by-law standards.
Public Input:
Notice of the application was sent to all residents within 120.0 metres (400.0 ft.) of the site and a
community information meeting to obtain public input was held on March 22, 1999. The notice and
the meeting engendered criticisms of: the inadequate time (notice) given to the community to prepare
for the March 22, 1999, community meeting; the project's height and density; the proximity of the
proposed parking areas to adjoining back yards; overshadowing; loss of privacy; building residential
units on a site formerly occupied by a gas station; and the potentially adverse effect of the
development on property values of the adjoining area.
Other comments consisted of inquiries about the project's tenure and expressions of support on the
basis that the proposed development was bound to be an improvement over the existing situation.
Conclusion:
The proposed development is appropriate because it conforms to, and advances East York's Official
Plan's policies, provides for adequate access, establishes a strong pedestrian relationship to the
street, facilitates pedestrian safety, and features an attractive building design and landscaping
treatment.

To amend Restricted Area Zoning By-law No. 6752,
as amended, of the former Township of East York
WHEREAS authority is given to Council by Section 34 of the Planning Act, RSO 1990, c.P. 13, as
amended, to pass this by-law, and whereas Council of the City of Toronto has provided adequate
information to the public and has held at least one public meeting in accordance with the Planning
Act;
The Council of the City of Toronto HEREBY ENACTS as follows:
1. The lands subject to this By-law are those lands outlined by a heavy black line and
identified as "Area Subject to Amendment" as shown on Schedule "1" attached hereto.
2. Schedule "A" to By-law No. 6752, as amended, is hereby further amended by changing the
zoning category for the lands identified as "Area Subject to Amendment" 1" on
Schedule "1" of this By-law from "Residential R1B Zone" to " Residential R2A - Site
Specific (R2A.36 ) Zone".
3. Zoning By-law No. 6752, as amended, is hereby further amended by adding a new
Section 7.5.4.36 immediately after Section 7.5.4.35 of the By-law as follows:

7.5.4.36.1 Area Restricted
The provisions of this Section shall only apply to those lands being Lots 24, 25, 26
and Part of Lot 27 on Registered Plan M - 395, City of Toronto (formerly Borough

7.5.4.36.2 General Provisions
On those lands referred to in Section 7.5.4.36.1 of this By-law, no person shall use,
occupy, Erect, alter, cause to be used, occupied, Erected or altered any Building,
Structure or land or part thereof except in accordance with the following provisions:
(1) Permitted Uses:
(a) Residential - Multiple Attached Dwellings; and,
(a) Buildings and Structures Accessory to the foregoing.
(2) Development Requirements:
(a) minimum Lot Area

(3) Other Provisions of the By-law:
(a) none of the provisions of this By-law shall apply to prevent the use,
occupation, erection or alteration of any Building, Structure, land or part
thereof on any land referred to in Section 7.5.4.36.1 in accordance with the
provisions of Section 7.5.4.36.2. In all other respects, all the other provisions
of By-law 6752 with the exception of Sections 5.6 g) and 7.5.1 to 7.5.3
inclusive, shall apply to the lands referred to in Section 7.5.4.36.1.
(4) The following additional uses shall be permitted on the lands described in
Section 7.5.4.36.1:
(a) temporary sales trailer which shall:
(i) only be used to sell the Buildings located within the limits of the area
identified on Schedule "1" to this By-law;
(ii) provide at least 1 temporary parking stall; and,
(iii) be removed within sixty (60) days after the completion of the last
Building.

The following persons appeared before the East York Community Council in connection with the
foregoing matter:
- Mr. Mark Frampton, East York, expressing concerns with respect to the height of the development and shadowing;
- Mr. Chris Chalaidopoulos, East York, expressing concerns with respect to the height of the development, shadowing, and parking; and
- Mr. Chico Mineque, East York, expressing concerns with respect to shadowing during the winter and that he does not know what the rear view of the development will look like.

Parking Regulations on Airdrie Road
(City Council on May 11 and 12, 1999, struck out and referred this Clause back to the East York
Community Council for further consideration.)
The East York Community Council, on condition that the issues with respect to signage and
parking limits have been addressed to the satisfaction of those residents concerned,
recommends that:
(1) a 12 hour maximum parking limit be implemented on the north side of Airdrie Road,
from a point 15 metres east of Heather Road to a point 19 metres further east thereof,
from May 1, to September 30;
(2) parking be prohibited on the north side of Airdrie Road from a point 15 metres east of
Heather Road to a point 19 metres further east thereof from October 1, to April 30;
(3) parking be prohibited on the south side of Airdrie Road, from a point 24 metres east
of Heather Road to a point 10 metres further east thereof, from May 1, to
September 30; and
(4) the appropriate City officials be authorized and directed to take the necessary action,
including the introduction of the necessary Bill in Council, to give effect thereto.
The East York Community Council reports having requested the Manager, Traffic Operations,
District 1, and Councillor Pitfield, to meet with the concerned residents with respect to the signage
issues and parking limits and to submit a report thereon directly to Council for its meeting to be held
on May 11, 1999, when this matter is to be considered.
The East York Community Council submits the following report (March 11, 1999) from the
Director, Transportation Services, District 1:
Purpose:
To respond to a request from East York Community Council regarding an amendment to parking
regulations on Airdrie Road to accommodate local residents during the summer months
(May - September) when starlings return and roost in trees on Airdrie Road.
Funding Sources:
The funds associated with the implementation of the proposed parking regulation amendments in
the estimated amount of $600.00 can be accommodated within the 1999 Transportation Services
Division Operating Budget request.
Recommendations:
It is recommended that:
(1) a 12 hour parking restriction be implemented on the north side of Airdrie Road, from a point
15 metres north of Heather Road to a point 19 metres further north thereof, from May 1 to
September 31;
(2) parking be prohibited on the north side of Airdrie Road from a point 15 metres north of
Heather Road to a point 19 metres further north thereof from October 1 to April 30;
(3) parking be prohibited on the south side of Airdrie Road, from a point 15 metres north of
Heather Road to a point 19 metres further north thereof, from May 1 to September 31; and
(4) the appropriate City Officials be requested to take whatever action is necessary to give effect
thereto, including the introduction in Council of any Bills that are required.
Background:
East York Community Council, at its meeting on September 18, 1998, under Clause 14(b) in
Report No. 13, recommended that the Commissioner of Works and Emergency Services report on
the results of discussions with Mr. Gardiner and interested residents on Airdrie Road to develop an
acceptable solution to the problem of starlings residing in trees directly overhead of private
driveways and on the feasibility of implementing a special permit system to allow parking for longer
than the 3 hour limit.
Comments:
In 1998, Mr. Gary Gardiner, 31 Airdrie Road, resubmitted a petition requesting that permit parking
be implemented on Airdrie Road during the summer months in order to allow him to be able to park
on the street legally for longer than the 3 hour limit. Mr Gardiner states that Starlings roost in the
tree on his front yard during the summer months and soil his vehicle on a continual basis. Staff have
investigated parking options available to Mr Gardiner and other affected residents on Airdrie Road,
including permit parking and relaxed parking regulations. One potential measure which may resolve
this matter to some extent would be the introduction of a 12 hour parking regulation on the north side
of Airdrie Road which would allow for the parking of 2-3 vehicles.
The option of providing a permit for residents on Airdrie Road to park their cars on the street for the
summer months is not recommended. Permit parking is implemented on streets in the City where
the demand for parking exceeds the supply. It is not used to allocate specific on-street parking
spaces to local residents. Permits are also issued to prevent non-residents from parking for extended
periods of time during the day or night. This situation typically occurs close to subway stations or
commercial centres which attract motorists from outside the area. There are no current permit
parking streets in Leaside other than a recently implemented section of Randolph Road.
Permits are not required where the supply of parking exceeds the demand. There is no advantage
to providing permits to residents on a street block when only 1 or 2 persons would buy them.
Relaxing the parking restrictions would provide a more cost effective solution for both the residents
and the City. The residents would not have to pay for permits and the City would not incur the
administrative costs of providing a specialized permit for the street. It should also be noted that a
poll conducted in 1998 to determine the residents perspective on introducing permit parking on
Airdrie Road yielded the following results:

Relaxed parking restrictions, in this case in the form of a 12 hour parking restriction for the months
of May, June, July, August and September also provide a measure of equity since the spaces will be
available for the entire street. This will provide residents with starling problems as well as other
residents with equally valid personal parking concerns with on-street parking for the summer
months. For example, the concern for starlings soiling Mr. Gardiner's vehicle may be equally
important to another residents reasons for wanting temporary on-street parking. By providing
parking for all residents of the street, staff are not deemed to be providing personal parking privileges
for a few at the inconvenience of others.
It is necessary to locate the proposed parking spaces on the north side of the street in front of
No. 1 Heather Road so that they are not located underneath trees where the starlings roost. This
could present an inconvenience to the resident of No. 1 Heather Road and others since parking will
occur on the street adjacent to their home for 5 months. To provide some relief, staff recommend
that parking also be prohibited during the remainder of the year at this location. After consulting
with area residents, staff also recommend that parking be prohibited on the south side of Airdrie
Road directly opposite the proposed 12 hour parking restriction during the summer months. Copies
of this report have been distributed to affected residents on Airdrie Road, including No. 1 Heather
Road, whom Transportation staff were unable to contact prior to the agenda deadline.

Background:
East York Community Council, at its meeting on March 30, 1999, referred a March 11, 1999 report
from the Director, Transportation Services, entitled "Parking Regulations - Airdrie Road" back to
staff with a request to investigate further the feasibility of designating a total of 5 parking spaces on
Airdrie Road as permit parking spaces allocated to specific addresses on Airdrie Road.
Comments:
The East York Community Council has requested staff comments with respect to a proposal to
introduce a permit system which allows only those residents with starling problems (Nos. 27, 29, 31,
33, and 37 Airdrie Road) access to parking permits for June to September while other residents on
the street would not be allowed to purchase permits and would be subject to the existing unsigned
3 hour parking restriction.
Staff do not recommend that parking permits be designated for purchase for selected residents on
a street. All parking permits currently issued by the City of Toronto are available on a block by
block or area basis. The City does not currently provide permit parking spaces which are designated
to certain residences on a street block or area at the exclusion of other residents who would be
eligible under the City's typical permit program. Permits are available on a first come, first served
basis to all residences on a specific street block, with a priority given to residences with no available
on-site parking. Permits are used by the City to manage the supply of parking for local residents.
The East York Overnight Permit Parking By-law includes a clause which provided a 2 year
moratorium on re-polling a street in the event of a negative poll result unless Council instructs
otherwise. In this case, 9 out of 16 persons responding to the poll conducted in June, 1998 voted
against the implementation of permit parking on Airdrie Road. In our opinion, a permit parking
system, which excludes certain residents on the street from participating, would receive even less
support that the standard overnight permit parking program.
The introduction of a permit program which designates eligible and non-eligible residents could not
be accommodated by the current East York Permit Parking By-law. A new By-law, specific to
Airdrie Road would need to be developed and passed by Council. There are currently no By-laws
in the City which offer specific residents parking permits at the exclusion of other residents on the
street.
Staff continue to recommend a maximum 12 hour parking limit on the north side of Airdrie Road
during the summer months as a means of accommodating residents with starling and other parking
concerns. An additional 2 parking spaces are available on the north side of Airdrie Road, west of
Heather Road, in front of No. 8 Heather Road.

(1) that the Summer Festival to be held on Saturday and Sunday, June 19 and 20, 1999,
and the Wine Festival to be held on Saturday, Sunday and Monday, July 31,
August 1 and 2, 1999, hosted by the Cypriot Community of Toronto Inc., be deemed
as Community Festivals in the community of East York; and
(2) that Council sanction and grant the Community Festival permits for the Summer and
Wine Festivals, subject to the following terms and conditions:
(i) the receipt of the second $250.00 Licence Fee to be applied against the Wine
Festival;
(ii) the receipt of a certificate of insurance evidencing a policy of insurance held by
the Registered Owner of the Festival Site beyond July 31, 1999;
(iii) that Section 3.2(f) of the former Borough of East York By-law No. 67-95
regarding security provisions for the Wine Festival and the Summer Festival be
waived provided that the Cypriot Community of Toronto Inc. provides
approximately five to ten security officers from their membership who will
oversee the security for each festival;
(iv) the applicant shall be responsible for arranging the private collection and
disposal of all waste generated from the two festivals;
(v) adequate garbage containers shall be supplied to the outdoor festival area to
control litter within the permitted area or the surrounding properties;
(vi) appropriate barriers for liquor control shall be erected, portable washrooms
and increased security to be implemented as appropriate;
(vii) the festival shall close at 1:00 a.m. in accordance with the submitted applications
and that amplified sound cease in accordance with the following schedule:
Summer Festival: Saturday, June 19, 1999 at 12:00 midnight;
Sunday, June 20, 1999 at 11:00 p.m.;
Wine Festival: Saturday, July 31, 1999 at 12:00 midnight;
Sunday, August 1, 1999 at 11:00 p.m.; and
Monday, August 2, 1999 at 11:00 p.m.;
(viii) the applicant shall adhere to the standard conditions imposed by the City of
Toronto Fire Services as follows:
(1) no open flames, i.e., candles, permitted on tables, etc.;
(2) all decorative materials are to be of non-combustible material or treated
for flame resistance;
(3) provide and maintain clear aisles to all exit doors;
(4) all food preparation will be done in the kitchen area;
(5) provide additional portable fire extinguishers as may be required;
(6) flammable compressed gas cylinders (propane) are not to be stored or
used inside the building; and
(7) provide a hydro certificate for all new outside electrical work; and
(ix) the applicant shall remove all stages, tent framework and other accessory

The East York Community Council submits the following report (April 26, 1999) from the
City Clerk:
Purpose:
To advise the East York Community Council and City Council that a Community Festival Permit
Application from the Cypriot Community of Toronto Inc. was received by the City Clerk's East York
Office on April 23, 1999, respecting two proposed community festivals to be held at
6 Thorncliffe Park Drive on June 19 and 20, 1999 for a Summer Festival, and July 31, August 1 and
2, 1999 for a Wine Festival. The purpose of the events is to raise funds for the Cypriot community.
Funding Sources, Financial Implications and Impact Statement:
The applicant has submitted the appropriate application fee for the Summer Festival (the application
fee for the Wine Festival is to be submitted at a later date) and the required deposit. The applicant's
insurance coverage expires July 31, 1999. However, the applicant has agreed to supply proof of
insurance coverage from July 31, 1999 onwards before the issuance of a community festival permit
for the Wine Festival.
Recommendation:
It is recommended that this report be received for information.
Council Reference/Background/History:
When an event is categorized as a community festival, under the liquor licensing requirements,
the Alcohol and Gaming Commission of Ontario requires the person/organization to acquire a
sanction from the municipality where the event is to be held. To manage the various issues relating
to community festivals, such as noise by-law requirements, parking issues, health regulations and
garbage control, the former Borough of East York, on June 19, 1995, adopted By-law No. 67-95 to
regulate and license community festivals and other places of amusement (the Community Festival
By-law).
Under the Community Festival By-law, the Clerk is entitled to issue a permit for a community
festival subject to the applicant submitting a completed application form with all accompanying
documentation, as set out in subsection 3.2 of the By-law. If the Clerk determines that it is
appropriate to impose conditions, the application may be referred to Council and Council may grant
the License subject to certain terms and conditions being met.
Comments:
Upon receipt, an application for two community festivals (together with supporting documentation)
was circulated to the Medical Officer of Health, the Commissioner of Economic Development,
Culture and Tourism, the Commissioner of Urban Planning and Development Services, and the
Fire Chief with the request that, in view of the tight timeline, they report directly to the meeting of
the East York Community Council on April 28, 1999.
The applicant advises having notified the Toronto Police Service of the two proposed festivals.
However, it is the responsibility of the applicant to ensure appropriate security is provided. The
applicant has been requested to review the security plans with the Police and to provide comments
to the Clerk's East York Office prior to the East York Community Council meeting on
April 28, 1999.
It is necessary for Council to impose conditions on the approval of the permits to ensure noise is kept
within reasonable levels and that garbage is appropriately maintained and consistent with the type
of event proposed.
The Cypriot Community of Toronto Inc. requires City Council to sanction the events at this time to
enable them to apply for the liquor licence permit for the Summer Festival which must be submitted
within 30 business days of the event. Council may also approve the permit applications subject to
the applicant meeting noted conditions. Should the applicant fail to meet all the conditions imposed,
the Clerk will not issue the permit. If there are any concerns with the ability of the applicant to meet
the conditions a further report may be submitted to the May 26, 1999, meeting of the East York
Community Council.
Conclusion:
The Cypriot Community of Toronto Inc. has submitted a Community Festival Permit Application
and provided supporting documentation including the following:
(i) $250.00 Licence Fee (a second Licence Fee to be submitted at a later date);
(ii) $2,000.00 deposit; and
(iii) certificate of insurance evidencing a policy of insurance held by the Registered Owner of the
Festival Site up to July 31, 1999.
Should the East York Community Council wish to support the issuance of Community Festival
Licences to the Cypriot Community of Toronto Inc., it may wish to recommend to City Council:
(1) that the Summer Festival to be held on Saturday and Sunday, June 19 and 20, 1999, and the
Wine Festival to be held on Saturday, Sunday and Monday, July 31, August 1 and 2, 1999,
hosted by the Cypriot Community of Toronto Inc., be deemed as Community Festivals in the
community of East York; and
(2) that Council sanction and grant the Community Festival permits for the Summer and Wine
Festivals, subject to the following terms and conditions:
(i) the receipt of the second $250.00 Licence Fee to be applied against the Wine
Festival;
(ii) certificate of insurance evidencing a policy of insurance held by the Registered
Owner of the Festival Site beyond July 31, 1999; and
(iii) any further terms and conditions specified by any or all of the following:

number of complaints from neighbouring businesses about the structures, enforcement action was
not taken.

Current public health practice is to contact the organizers with respect to safe food handling
methods. Our past experience with this event has revealed that food storage, preparation and serving
practices have been carried out in a satisfactory manner. Preliminary investigations and on-site
inspections conducted last year revealed no public health concerns.
Should our investigation of this event reveal that the same practices are in place as in the past, Public
Health requirements will be filled. We anticipate that this preliminary investigation will take place
over the next week.

Pedestrian Safety Concerns
O'Connor Drive at Coxwell Boulevard

The East York Community Council recommends that staff of the Transportation Services
Division be directed to replace the existing 2.4m (8 foot) fence with a 1.8m (6 foot) chain link
fence and necessary grading to accommodate a widening of the existing walk by about 0.5m
(2 feet) at the northwest corner of O'Connor Drive and Coxwell Boulevard.
The East York Community Council submits the following report (April 13, 1999) from the Director,
Transportation Services, District 1:
Purpose:
To report to the East York Community Council on the feasibility of replacing the fence located on
the northwest corner of O'Connor Drive and Coxwell Boulevard with a new chain link fence set
back from the sidewalk and to widen the paved walk area for additional pedestrian space.
Funding Sources:
The estimated cost to replace the fence at the northwest corner of O'Connor Drive and
Coxwell Boulevard, install additional asphalt paving, and make the necessary grade adjustments to
widen the pedestrian areas is $5,000.00 which can be accommodated within the 1999 Transportation
Services Division Operating Budget request.
Recommendation:
It is recommended that the East York Community Council direct staff of the Transportation Services
Division as to whether it wishes to proceed with the replacement of the existing 2.4m (8 foot) fence
with a 1.8m (6 foot) chain link fence and necessary grading to accommodate a widening of the
existing walk by about 0.5m (2 feet) at the northwest corner of O'Connor Drive and
Coxwell Boulevard.
Comments:
At the request of Councillor Michael Prue, staff of Transportation Services have reviewed concerns
related to pedestrian safety at the northwest corner of O'Connor Drive and Coxwell Boulevard.
Currently, there is a sidewalk approximately 1.5m in width adjacent to the pavement and a chain link
fence in somewhat deteriorated condition at the back of the walk. The lands beyond are City owned
ravine with a fairly steep down slope.
In October, 1998, local residents requested that bollards be installed at the intersection to protect
pedestrians waiting on the corner. Staff investigated these concerns and concluded that there is
insufficient space to install bollards. Furthermore, bollards are typically not used as safety barriers
since they have limited effectiveness in redirecting vehicles away from the corner. For these reasons,
the installation of bollards is not a safe solution at this intersection.
The solution we feel is most viable to facilitate concerns expressed by local residents is to replace
and relocate the fence approximately 1.0 metre further back from the sidewalk. We also recommend
an additional 0.5 mere wide asphalt strip be constructed next to the sidewalk to increase the area
available to pedestrians and provide additional separation from the travelled portion of the roadway.
The fence could be replaced and additional asphalt installed at this location for a relatively modest
cost (in the range of about $5,000.00). Adjacent residents should be consulted respecting this
proposal.
The revised $5,000.00 cost estimate is significantly less than the $25,000.00 estimate quoted by staff
in the March 8, 1999 letter to Councillor Prue. A more detailed review since that time has indicated
that a fence could be installed with a minimal re-grading of the area and therefore at a substantially
less cost than originally estimated.

(h) Recycling Programme - Pilot Project.
The East York Community Council reports having:
(1) endorsed, in principle, the concept of a pilot project with respect to a proposed
recycling programme; and
(2) referred the communication (April 13, 1999) from Mr. Kevin McGroarty,
Toronto, to the Commissioner of Works and Emergency Services with the
request that he submit a report to the Works and Utilities Committee and the
East York Community Council on how this programme could be implemented,
such report to include comment with respect to exclusivity.
(April 13, 1999) from Mr. Kevin McGroarty, President, Home Again Recycling Depot,
Toronto, requesting the East York Community Council to consider a "pilot project" with
respect to a proposed recycling programme to be implemented through the Building and
Planning Services, East York Office.

Mr. Kevin McGroarty, President, Home Again Recycling Depot, Toronto, appeared before
the East York Community Council in connection with the foregoing matter.
(i) Installation of Traffic Control Signs at O'Connor Drive at Northridge Avenue; O'Connor Drive at Glenwood Crescent; and O'Connor Drive at Four Oaks Gate - ( Ward 1, East York).
The East York Community Council reports having recommended to the
Urban Environment and Development Committee:
(1) adoption of the report (April 20, 1999) from the Director, Transportation
Services, District 1, subject to amending Recommendation No. (1) to provide
that turn restrictions be instituted at St. Clair Avenue and St. Columba Place,
and St. Clair Avenue and Rexleigh Drive, at the same time as the installation of
traffic control signals at the O'Connor Drive/Glenwood Crescent intersection,
to ensure that there is no infill of traffic in the morning;
(2) for the 90 days following the installation of the traffic control signals at the
O'Connor Drive/Glenwood Crescent intersection, the Toronto Police Services
be requested to give top priority to the enforcement of the turn restrictions in
both directions in the morning and afternoon;
(3) that the Commissioner of Works and Emergency Services be requested to
conduct further studies on additional means of improving Glenwood Crescent,
in particular, the feasibility of turning Glenwood Crescent south of
O'Connor Drive into a one-way street;
(4) that north bound left turn restrictions be implemented at Rexleigh Drive and
Glenwood Crescent during the morning peak period;
(5) that, should City Council not implement a left turn restriction on
St. Clair Avenue at St. Columba Place, that there be a right hand turn
restriction implemented on St. Columba Place and Glenwood Crescent;
(6) that right hand turns on a red light be prohibited at Glenwood Crescent and
O'Connor Drive;
(7) that consideration be given to implementing one-way east bound operation on
Glenwood Crescent, east of St. Columba Place;
(8) that the Community Safety Zone currently in effect on O'Connor Drive between
Pape Avenue and Woodbine Avenue be extended to St. Clair Avenue.
The East York Community Council reaffirms its previous recommendation with
respect to the intersection of O'Connor Drive and Four Oaks Gate; viz:
"That traffic control signals be installed at the intersection of
O'Connor Drive and Four Oaks Gate."
The East York Community Council reports having requested the Commissioner of
Works and Emergency Services to submit a report to the Urban Environment and
Development Committee when this matter is being considered with respect to:
(i) the feasibility of introducing an extended cycle length at the proposed traffic control
signal at O'Connor Drive and Glenwood Crescent to discourage people from using
that intersection;
(ii) the feasibility of installing speed bumps on Glenwood Crescent;
(iii) further comment on "squaring-off" the corner of Glenwood Crescent;
(iv) the possibility of moving the location of the cross-walk at Glenwood Crescent and
O'Connor Drive; and
(v) adjusting the prohibition times of left hand turns to 6:30 a.m. to 9:30 a.m.
(April 20, 1999) from the Director, Transportation Services, District 1, recommending
adoption of the report (February 5, 1999) from the General Manager Transportation Services,
subject to traffic conditions in the Glenwood Crescent environs being assessed three months
after the installation of traffic control signals at the O'Connor Drive/Glenwood Crescent
intersection, as follows:
(1) that the Urban Environment and Development Committee be advised that based on
a technical assessment, staff concur with the recommendations of the East York
Community Council with respect to the installation of traffic control signals at the
O'Connor Drive/Glenwood Crescent intersection, coincident with the removal of the
existing pedestrian crossover, and that traffic conditions on Glenwood Crescent be
investigated 6 months after installation of the traffic control signals to determine the
degree of traffic infiltration during the morning and afternoon peak periods, with the
findings reported to the East York Community Council;
(2) that in order to implement the East York Community Council recommendation to
"square-off" the corner of O'Connor Drive and Glenwood Crescent, approval be
given to realign the existing curbs at the northeast and southwest corners of
O'Connor Drive/Glenwood Crescent intersection; and
(3) that the appropriate City officials be authorized and directed to take the necessary
action to give effect thereto, including the introduction of the necessary Bill in
Council;
(April 16, 1999) from the City Clerk forwarding Clause No. 2 of Report No. 4 of the
Urban Environment and Development Committee which was adopted, as amended, by
City Council at its meeting on April 13, 14 and 15, 1999;
(April 20, 1999) from Mr. Derek Gomes, East York, opposing the proposed installation of
traffic control signals;
(April 22, 1999) from Mr. and Mrs. J. Cribben, East York, opposing the proposed installation
of traffic control signals;
(April 22, 1999) from Mr. C. Kyroglou, East York, in support of the proposed installation

presentation with respect to the proposed replacement of the existing pedestrian crossover

before the East York Community Council with respect to the proposed installation of traffic
control signals at O'Connor Drive and Four Oaks Gate.

The East York Community Council reports having received the following
communication:
(April 8, 1999) from Councillor Michael Prue, East York, forwarding a communication
(March 30, 1999) from Mr. George Strathearn, Forestry Technician, Central Forestry
Services, Ontario Hydro Services Company, regarding the removal of non-compatible brush
and the trimming of branches away from power lines in the Ontario right-of-way located
throughout East York.
(k) Toronto Police Service Divisional Boundaries.
The East York Community Council reports having:
(1) referred the written brief submitted by Ms. Shaida Addetia, Co-ordinator,
Family and Children's Services, Thorncliffe Neighbourhood Office, East York,
to the Toronto Police Services Board with a request that they submit a report
thereon to the next meeting of the East York Community Council; and
(2) requested the Toronto Police Services Board to assign a representative to meet
with Members of the East York Community Council to discuss the issues raised
by Ms. Addetia in her deputation, such meeting to be held at the
Thorncliffe Community Centre.
(April 8, 1999) from Councillor Michael Prue, East York, forwarding correspondence from
the Toronto Police Service regarding the proposed Toronto Police Service divisional
boundaries affecting the community of East York.

(l) Parking Concerns on South Side of Fairside Avenue between Mortimer and Barker Avenue.
The East York Community Council reports having referred the following
communication to the Commissioner of Works and Emergency Services with the
request that he submit a report thereon to the next meeting of the Community Council:
(April 21, 1999) from Mr. Dympna Callaghan, East York, expressing concern with respect
to parking problems at the above-captioned location.
(m) Toronto Region Conservation Authority Shoring Up of Eroding Ravine Properties.
The East York Community Council reports having adopted the following
communication:
(April 23, 1999) from Councillor Jane Pitfield, East York, recommending that the East York
Community Council request the Toronto Region Conservation Authority to complete the
shoring up of eroding ravine properties in East York as soon as possible to avert potential
tragedy.

Councillor Prue declared a conflict of interest with respect to this matter and advised that the
nature of his interest is that his principal residence is immediately adjacent to Toronto
Region Conservation Authority property.
(Councillor Prue, at the meeting of City Council on May 11 and 12, 1999, declared his
interest in Item (m), headed "Toronto Region Conservation Authority Shoring Up of Eroding
Ravine Properties", embodied in the foregoing Clause, in that his principal residence is
immediately adjacent to Toronto Region Conservation Authority property.)
(n) Sewer Easement between 53 - 55 Douglas Crescent.
The East York Community Council reports having recommended to the
Budget Committee and Council adoption of the following recommendations embodied
in the confidential report (April 27, 1999) from Mr. C.M. Loopstra, Loopstra, Nixon
and McLeish:
(1) that the owners of 53 and 55 Douglas Crescent be offered a lumpsum payment
of $30,000.00 ($15,000.00 to each property owner) in full settlement of all claims
known or which could be reasonably known to the owners against the City with
respect to the easement, the City works located within the easement, the
damages to the easement and adjoining lands and buildings and incidental
damages;
(2) that the settlement funds include the cost of replacing the semi-detached garages
by the owners;
(3) that the City will undertake all necessary restoration work of the driveway and
landscaping damaged by the restoration and repair work;
(4) that the owner be required to execute a release satisfactory to the
City Solicitors; and
(5) that the City provide the owners with an engineering opinion, on the completion
of all restoration and repair work, confirming that the work on stabilizing the
soils and completing the underground repairs since September 1996, has not
had a detrimental impact on the adjoining residential buildings, namely, 53 and
55 Douglas Crescent.

(o) Installation of Footbridge Over CP Rail Tracks by Loblaws.
The East York Community Council reports having requested the Commissioner of Urban
Planning and Development Services to submit a report to the meeting of the East York
Community Council scheduled to be held on May 26, 1999, with respect to the previous
intention of Loblaws on Redway Road to install a footbridge over the CP Rail tracks to
enable residents of Southvale Avenue and Millwood Road more easy access to Loblaws.
(p) Feasibility of Installation of A Sidewalk on the North and East Sides of Leaside Memorial Gardens.
The East York Community Council reports having requested the Commissioner of
Works and Emergency Services to submit a report to the meeting of the East York
Community Council scheduled to be held on May 26, 1999, on the feasibility of
installing a sidewalk on the north and east sides of the Leaside Memorial Gardens
property, extending from the entrance to Leaside Memorial Gardens to the foot of the
CPR bridge overpass; and that the sidewalk be set back from the curb with foliage for
shade and security.
(q) Postal Trucks on Krawchuk Lane.
The East York Community Council reports having received a petition, submitted by
Councillor Pitfield on behalf of the residents of the Cornerstones of Millwood
townhouse complex, with respect to the flow of postal trucks on Krawchuk Lane from
the postal outlet on Laird Drive; and, further, requested the Commissioner of Works
and Emergency Services to submit a report thereon to the next meeting of the
East York Community Council scheduled to be held on May 26, 1999.
(r) Customer Parking on East Side of Bayview Avenue.
The East York Community Council reports having received a parking survey
conducted by Councillor Pitfield, with respect to the implementation of customer
parking on the east side of Bayview Avenue between 7:00 a.m. and 9:00 a.m. in addition
to the existing hours allowed; and, further, having requested the Commissioner of
Works and Emergency Services to submit a report to the next meeting of the East York
Community Council scheduled to be held on May 26, 1999, with respect to the
feasibility of conducting a pilot study with respect thereto.
(s) Resurfacing of Roads.
The East York Community Council reports having requested the Commissioner of
Works and Emergency Services to submit to the next meeting of the Community
Council, scheduled to be held on May 26, 1999, a list of roads scheduled to be
re-surfaced.
