Reporting on requested advice on the provisions of the Procedural By-law and suggested amendments; and recommending 1. that Council delegate the following hearing functions to the community councils: (a) The hearing required by section 300 of the Municipal Act of persons who claim that their land will be prejudicially affected by a proposed by-law to stop up, alter, widen, divert, sell or lease a highway or establish or lay out a highway, except any such proposed by-law in relation to roads designated as arterial, minor arterial and collector roads by an applicable official plan; and (b) The hearing required by paragraph 146 of section 210 of the Municipal Act of persons who apply to be heard in relation to a proposed sign by-law or amendment which would apply solely to lands totally within the urban area represented by the community council; and 2. That Notices of Motion be prepared and presented to City Council to effect the delegation of these hearing functions.

 

2. REQUEST FOR STOP SIGN AT THE CORNER OF HAVERSON BOULEVARD AND DONALD AVENUE.

Reporting on the results of a traffic study; and recommending that an all-way stop control not be installed at the intersection of Haverson Boulevard and Donald Avenue, as the results of a recent traffic study have indicated that an all-way stop control is not warranted.

 

3. REQUEST FOR ALTERNATE PARKING ON SILVERTHORN AVENUE OR A PORTION THEREOF.

Advising on the results of a review undertaken regarding a proposal to reverse the legal on-street parking regulation from the west side to the east side of Silverthorn Avenue between Harlton Crescent and Donald Avenue; recommending that the Uniform Traffic By-laws

not be amended to reverse the current on-street parking regulation and that Mrs. Mary Curtis receive a copy of the report.

 

4. TORONTO TRANSIT COMMISSION - PROPOSALS FOR 1999 SERVICE PLAN.

5. PARKING PROBLEMS ON VAUGHAN ROAD, SPECIFICALLY WEST OF NORTHCLIFFE BOULEVARD.

Advising of the complaints from residents on Vaughan Road about the lack of parking available in the area and requesting discussion and a possible resolution to the problem by implementing parking on the south side of Vaughan Road.

 

6. TRAFFIC ON ARLINGTON AVENUE SOUTH OF VAUGHAN ROAD.

Requesting York Community Council to direct staff to conduct a traffic count on Arlington Avenue south of Vaughan Road for a one week period to determine traffic volumes to assist in deciding on the feasibility of removing the Ano right hand turn restrictions from 4:00 to 6:00 p.m.@ on the sign located at Vaughan Road southbound onto Arlington Avenue southbound, as requested by one of his constituents.

 

7. REMOVAL OF NEW STOP SIGN ON AVA ROAD AT HILL PLACE.

Requesting York Community Council to direct staff to conduct a poll in the immediate area to determine if the majority of the residents are in favour of the removal of the Stop Sign at Ava Road at Hill Place and to report the results, as he has received requests from his constituents for its removal because of the increase in noise and air pollution and the inconvenience to drivers.

 

8. 2 ENNERDALE ROAD - INSTALLATION OF A BENCH AND MAINTENANCE

OF PROPERTY.

Requesting that staff investigate and report back on the installation of a bench at the top of the hill in the area of 2 Ennerdale Avenue and if City staff cannot arrange to cut the grass that consideration be given to pay an area resident to maintain this property.

 

9. PERMIT PARKING ON ALAMEDA AVENUE BETWEEN EGLINTON AVENUE WEST AND BELVIDERE AVENUE.

24. AMENDMENT TO THE COMMUNITY IMPROVEMENT PLAN FOR THE WESTON, MOUNT DENNIS AND OAKWOOD-VAUGHAN/OAKWOOD-ROGERS COMMUNITY IMPROVEMENT PROJECT AREAS.

Reporting on the addition of the Eglinton Avenue West Community Improvement Plan Area to the above-noted Community Improvement Plan; advising that a request for $300,000 to continue funding of the Commercial Facade Improvement Grant Program (initiated by the former City of York Council in 1997) has been submitted for consideration in the 1998 City of Toronto Capital Budget and that a portion of this funding would be dedicated for use on Eglinton Avenue West; that on May 28, 1997, the former City of York Council adopted a Community Improvement Plan for the Weston, Mount Dennis and Oakwood-Vaughan/Oakwood-Rogers Community Improvement Project Areas; that the Plan, approved by the Ministry of Municipal Affairs and Housing on July 31,1997, introduced details of a Commercial Facade Improvement Grant Program offered by the City in 1997 to commercial property owners within the three subject areas; that Municipalities may offer grants only to property owners within areas covered by an approved Community Improvement Plan; that

the former City of York Council budgeted $120,000 towards the Facade Program in 1997 with applicants being eligible for a grant covering 50% of the cost of the proposed facade improvement work, to a maximum of $12,500.00; that on June 25, 1997, City of York Council adopted the recommendation that a comprehensive Community Improvement Plan be prepared for Eglinton Avenue West with the intention that the Community Improvement Plan would include, among other programs, provisions for a commercial facade improvement grant program; that on October 8 and 9, 1997, Metro Council adopted a motion identifying Eglinton Avenue West, from the Allen Road west to Dufferin Street and beyond, as Aa high priority area for attention by the appropriate committees and departments of the new City of Toronto Council@ based upon the recent creation of three new Business Improvement Areas, and the eagerness of the business community and local residents to enhance the vitality of Eglinton Avenue West with traffic management also cited as an issue for the area; and recommending that Council adopt the Community Improvement Plan Amendment contained in the report.

 

25. DESIGNATION OF THE AREA FORMERLY KNOWN AS THE CITY OF YORK AS A COMMUNITY IMPROVEMENT PROJECT AREA.

Reporting on bringing forward a by-law designating the former City of York as a Community Improvement Project Area; advising that on May 28, 1997, the former City of York Council adopted an Official Plan Amendment which established new, simplified policies for Community Improvement that were approved by the Minister of Municipal Affairs and Housing on July 29, 1997, that the main objective of the Amendment is to provide Council with an effective policy framework from which to improve the amenity, appearance and safety of all areas of York; that one of the new policies designates the entire former City as a Community Improvement Area; that at the same meeting, Council instructed the City Solicitor to prepare a By-law designating the entire City as a Community Improvement Project Area; and recommending that City Council enact a by-law in accordance with the Draft By-law attached as Schedule 1 to the report.

 

26. AMENDMENT TO CITY OF YORK INTERIM CONTROL BY-LAW 3432-97 LANDS - 2007, 2009, AND 2011 LAWRENCE AVENUE WEST.

Requesting the extension, for an additional year, of the prohibition of any new Banquet Hall on the subject lands until April 1, 1997 as imposed by Interim Control By-law 3432-97; and recommending that the Solicitor bring forward the necessary By-law for enactment by Council at its meeting on March 4, 1998.

 

27. APPEAL OF COMMITTEE OF ADJUSTMENT APPLICATIONS.

Providing information on appeals of the following Committee of Adjustment applications and advising that as there is no matter of significance to Council policy, staff need not attend at the Ontario Municipal Board Hearings: (1) Application CA-97-108 - 55 St. Marks Road regarding variances approved by the Committee to permit a residential addition that have been appealed by a neighbour; (2) Application CA-97-189, 190, and 191 - 15 Winfield Avenue regarding the Committee=s refusal of a consent to create a new residential lot and its refusal of variances to retain the existing house and build a new house have been appealed by the applicant; (3) Application CA-97-198 - 3 Strathearn Road regarding the Committee=s refusal of a consent to create a new residential lot has been appealed by the applicant.

 

28. DEVELOPMENT APPLICATIONS RECEIVED.

Reporting on new development applications within the former City of York as information to be received: (1) 19 Kenora Crescent - zoning amendment to legalize a one storey rear yard garage; (2) 460 Rogers Road - site plan approval for seven new townhouses and a second storey conversion of an existing commercial building for four apartment units; and 3617-3619 Dundas Street - two storey addition to an existing one storey warehouse for warehouse and office purposes.

 

29. ZONING BY-LAW AMENDMENT APPLICATION LANDS - WEST SIDE OF GILBERT AVENUE (SOUTH OF EGLINTON AVENUE WEST FORMING PART OF THE CNR RIGHT-OF-WAY

Reporting on the zoning by-law amendment application to change the zoning of the lands on the west side of Gilbert Avenue, adjacent to the CNR rail line from T- Transportation and Utilities District to PE - Prestige Employment; advising that the zoning amendment is requested in recognition of the fact that a portion of the CNR lands at the rear of the industrial properties on the west side of Gilbert Avenue are occupied by light industrial and warehouse uses, or accessory parking facilities, and have been used as such for many years; that the uses are legal non-conforming as a result of a Borough of York rezoning of railway and utility corridors from M - Manufacturing District to T - Transportation and Utilities District in 1974; that the application follows from an application to Committee of Adjustment requesting consent to sever these surplus lands from the adjacent CNR right-of-way; that this rezoning fulfils one of the Committee of Adjustment=s conditions of approval, which was recommended by the Development Services Department; and recommending (1) the application be approved; and (2) a Zoning by-law to amend Zoning By-law 1-83 be passed in accordance with the draft Zoning By-law.

 

30. YORK WEST SENIORS= CENTRE.

Reporting on the proposed expenditure of $90,000.00 from the York Humber Reserve Account; that in 1989, there was a site plan agreement (Hickory Tree Development) implemented which set aside $225,000.00 for the purpose of providing funds to use towards capital requirements for seniors in the immediate area; that in 1994, $60,000.00 was approved by Council for capital improvements to its present location 1901A Weston Road; that presently there is $285,000.00 in the reserve account dedicated for seniors; that the relocation of the York West Seniors Centre to 2100 Lawrence Avenue would better service the needs of its members for accessibility, programming space, and work environment; that York West Meals on Wheels, which has a close working relationship with York West Seniors, has just moved into this new site; that the linkage is a very important aspect to the community and would benefit everyone if they were located within the same building; and recommending that (1) the amount of $90,000.00 from the York Humber Reserve Account #004-433 2680, be allocated towards the upgrading and renovations at 2100 Lawrence Avenue for the new site of the York West Seniors Centre; (2) the lease and business arrangements be identified to reflect the centre=s financial objectives; and (3) the lease arrangements should be reviewed and deemed reasonable by appropriate staff.

 

 

31. RECOMMENDATION 21 OF THE FINAL REPORT OF THE TORONTO TRANSITION TEAM PERTAINING TO ONE COUNCILLOR PER WARD REPRESENTATION.

Advising that City Council had before it a motion that AWHEREAS the Toronto Transition Team on December 11, 1997, submitted to Council the final report of the Team, entitled >New City, New Opportunities=, which embodies 136 recommendations for the new City; and WHEREAS Council also has before it a report dated December 30, 1997, from the City Clerk submitting a draft Procedural By-law proposed by the Transition Team; NOW THEREFORE BE IT RESOLVED THAT Council give consideration to the final report of the Toronto Transition Team and the draft Procedural By-law proposed by the Transition Team.@; and that Council, in adopting, as amended, the recommendations of the final report of the Toronto Transition Team, directed, in part, that Recommendation 21 of the final report of the Toronto Transition Team pertaining to one Councillor per ward representation be referred to the Urban Environment and Development Committee and circulated to the Community Councils for consideration and report thereon to Council.

33. ZONING BY-LAW AMENDMENT FOR 725 TO 729 JANE STREET AND

120 CORBETT AVENUE.

Reporting on a rezoning application for the lands at 725 to 729 Jane Street and 120 Corbett Avenue whereby the applicant wishes to change the zoning of the site so that the existing uses are permitted, as-of-right, and a new accessory parking lot with 12 spaces can be created to service the pharmacy and medical offices with the bungalow at 120 Corbett Avenue to be demolished to accommodate the parking lot; advising that the pharmacy and medical offices are minor commercial uses which conform to the Official Plan but not the Zoning By-law; the expansion of the commercial uses to include an accessory parking lot with landscape buffering and fencing will not adversely affect the residential neighbourhood, but will increase the available street parking for residential uses; the zoning district change to an LCR zone with a site specific zoning will allow a full range of commercial and residential uses, except for restaurants and public garages; will permit the current use and future commercial uses; and recommending that the application be approved and Zoning By-law 1-83 be amended subject to the Owner executing a Development Agreement with the City prior to the By-law=s enactment.
