(1) the request for an exemption to the North York Fence By-law No. 30901, as amended, be refused as the fence will be constructed greater than 30" (0.76m) in height within 8' (2.40m) of the north front property line (Section 3.1.10 of By-law No. 33006); and

(2) the applicant be advised that a swimming pool will not be permitted in the front yard of the premises.

COMMUNICATIONS/REPORTS:

4. PROPOSED SALE OF CITY-OWNED ROAD ALLOWANCE - NORTHWEST CORNER OF WILSON HEIGHTS BOULEVARD AND SHEPPARD AVENUE WEST, DESIGNATED AS PART 3, PLAN RS-1060 - NORTH YORK SPADINA.

Providing a report to declare as surplus the portion of Wilson Heights Boulevard, more particularly described as (the "Highway Lands") and to authorize the sale to the adjoining owner, and recommending that subject to City Council enacting a by-law to stop-up and close and authorize the sale of the Highway Lands, that:

(1) the Highway Lands, be declared surplus to the City's requirements and notice of the proposed sale to the adjoining property owner 1261075 Ontario Inc. be given to the public in accordance with the requirements of By-law No. 551-1998;

(2) the Highway Lands be sold to the adjoining owner, 1261075 Ontario Inc. on the following terms and conditions:

(a) 1261075 Ontario Inc. shall pay to the City the sum of $150,000.00 for the fee in the Highway Lands;

(b) the City shall relocate any municipal services and public utilities that may be located within the Highway Lands, at the City' s expense with the work being done either prior to or within 90 days after the closing of the transaction and the City and the public utilities shall have access to the Highway Lands at all times for these purposes;

(c) each party shall pay all of its own costs associated with the transaction; and 1261075 Ontario Inc. shall comply with such other terms and conditions as the City Solicitor may deem necessary or advisable to protect the City's interests;

(3) authority be granted for the City to execute an agreement of purchase and sale with 1261075 Ontario Inc. incorporating the terms and conditions set out in the body of this report and such other terms and conditions as the City Solicitor and the Executive Director of Facilities and Real Estate deem necessary or appropriate;

(4) the City Solicitor, in consultation with the Executive Director of Facilities and Real Estate, be authorized to complete this transaction on behalf of the City, including making payment of any necessary expenses and amending the closing date to such other earlier or later date as he considers reasonable; and

(5) the appropriate City Officials be authorized and directed to take the necessary action to give effect thereto.

5. ALL WAY STOP CONTROL - CARMICHAEL AVENUE AT ALLARD AVENUE - NORTH YORK CENTRE SOUTH.

Recommending that Schedules XVIII and XIX of By-law No. 31001, of the former City of North York, be amended to require traffic to stop on all approaches to the intersection of Carmichael Avenue and Allard Avenue.

6. ALL WAY STOP CONTROL AND PARKING/STOPPING PROHIBITIONS - KENNETH AVENUE AND PEMBERTON AVENUE - NORTH YORK CENTRE.

Recommending that:

(1) Schedules XVIII and XIX of By-law No. 31001, of the former City of North York, be amended to require traffic to stop at all approaches to the intersection of Kenneth Avenue and Pemberton Avenue;

(2) Schedule VIII of By-law No. 31001, of the former City of North York, be amended to delete the "No Parking Anytime" prohibition on the east side of Kenneth Avenue, between Pemberton Avenue and Bishop Avenue;

(3) Schedule VIII of By-law No. 31001, of the former City of North York, be amended to delete the "No Parking Anytime" prohibition on the west side of Kenneth Avenue, between Finch Avenue East and Bishop Avenue;

(4) Schedule VIII of By-law No. 31001, of the former City of North York, be amended to install "No Parking Anytime" prohibitions on both sides of Kenneth Avenue, from the southerly limit of Pemberton Avenue to the southerly limit of Bishop Avenue;

(5) Schedule X of By-law No. 31001, of the former City of North York, be amended to delete the "60 Minute Permitted Parking, 8:00 a.m. to 6:00 p.m., Monday to Friday", regulation on the east side of Kenneth Avenue, from a point 34 metres north of Finch Avenue East to a point 38.5 metres northerly thereof; and

(6) Schedule IX of By-law No. 31001, of the former City of North York, be amended to install "No Stopping Anytime" prohibitions on both sides of Kenneth Avenue, from the northerly limit of Finch Avenue West to the southerly limit of Pemberton Avenue.

7. INSTALLATION OF SPEED HUMPS ON ROADWAYS ADJACENT TO SCHOOLS - ALL WARDS.

8. STOPPING PROHIBITIONS - TORRESDALE AVENUE, NORTH OF FINCH AVENUE WEST - NORTH YORK SPADINA.

(July 14, 1999) from the City Clerk, advising that the Works Committee at its meeting held on July 14, 1999, referred the report (June 29, 1999) from the Commissioner of Works and Emergency Services respecting a Proposed Road Classification System to all Community Councils for consideration and requested that comments be submitted to the Works Committee for consideration at its November 3, 1999 meeting.

10. SPEED LIMITS WITHIN THE YORK MILLS VALLEY COMMUNITY - NORTH YORK CENTRE SOUTH.

11. BULK LIFT COLLECTION SERVICES IN NORTH YORK COMMUNITY COUNCIL AREA.

Providing a report on the review of the policy of using only one operator per vehicle for multi-residential bulk lift garbage collection services in the North York Community Council area and recommending that the one person per bulk collection vehicle policy remain in effect throughout the City of Toronto, including the North York Community Council area.

12. NOMINATION OF CITIZENS FOR APPOINTMENT TO HERITAGE BOARDS - ALL WARDS IN FORMER CITY OF NORTH YORK.

Forwarding to Council recommendations for the appointment of citizens to the North York LACAC Panel and to the Gibson House/Zion Schoolhouse Museum Management Board and recommending that:

(1) Council appoint the following citizens to serve on the North York LACAC Panel for a term to begin January 1, 2000 and to expire on November 30, 2003: Pietro Ferrari, Edith Geduld, Judith P. Goldstein, Alex M. Grenzebach, and Tanya Grujich;

(2) Council appoint the following citizens to serve on the Gibson House / Zion Schoolhouse Museum Management Board for a term to begin January 1, 2000 and to expire on November 30, 2003: Gillian Elias, Wilf Neidhardt, Basil Stevens, Yvonne Verberg, and Frank Whilsmith; that Lorraine O'Byrne be appointed to represent TRCA / Black Creek Pioneer Village; and that Jane Saunders be appointed to represent the North York Historical Society;

(3) future citizen appointments to these boards be for three-year terms coincident with the term of Council; and

(4) the appropriate City Officials be authorized and directed to take the necessary action to give effect thereto.

13. PRELIMINARY EVALUATION REPORT - ZONING AMENDMENT APPLICATION UDZ-99-29 AND SUBDIVISION APPLICATION UDSP-1243 - WESTON CONSULTING GROUP INC. FOR METRODOME PROPERTIES INC. - 5365 LESLIE STREET - SENECA HEIGHTS.

Providing further information as requested by the North York Community Council at its meeting held on November 9, 1999, and recommending that the report be received as information.

a. (October 18, 1999) from Acting Commissioner of Corporate Services providing a report to declare as surplus the southerly portion of Longview Drive, the stub-end of Woodward Avenue west of Uphill Avenue and the stub-end of Woodward Avenue east of Pine Street, more particularly described as ("the Highway Lands") and to authorize the sale of the Highway Lands to the abutting owner, Humber River Regional Hospital, at a sale price to be determined by City Council following the conclusion of negotiations with the Hospital; and recommending that subject to City Council approving the stopping up and closing of the Highway Lands as public highway, that:

(1) the Highway Lands be declared surplus to municipal requirements and notice of the proposed sale be given to the public in accordance with the requirements of By-law No. 551-1998;

(2) notice be given to the public of a proposed by-law to sell the Highway Lands in accordance with the requirements of the Municipal Act;

(3) the Planning and Transportation Committee hold a public meeting concerning the proposed by-law, in accordance with the requirements of the Municipal Act;

(4) subject to the Official Plan Amendment and the rezoning of the lands required for the expansion of the Hospital at 200 Church Street being approved and coming into full force and effect, the Highway Lands be closed and sold to the Hospital on terms and conditions to be determined by City Council;

(5) recommendation (2), of the December 18, 1998 report from the Commissioner of Urban Planning and Development Services to the Urban Environment and Development Committee be amended as follows:

Change and replace the words "Prior to the enactment of the zoning by-law" to "Following the enactment of the zoning by-law";

(6) the Acting Commissioner of Corporate Services be directed to enter into negotiations with the Hospital for the sale of the Highway Lands at fair market value and to report back to the Community Council on the outcome of the negotiations; and

(7) the appropriate City officials be authorized and directed to take the necessary action to give effect to the foregoing.

17. 2:30 p.m. SUPPLEMENTARY REPORT - ZONING AMENDMENT APPLICATION UDZ-97-40 AND SITE PLAN APPLICATION UDSP-97-222 - PREMIUM PROPERTIES - C/O BRUCE ENGELL, WEIR AND FOULDS - YONGE STREET, POYNTZ AVENUE, FRIZZELL ROAD AND BOGERT AVENUE - NORTH YORK CENTRE.

Providing a supplementary report respecting an application to amend the Zoning By-law to permit two 29-storey residential buildings, and recommending that:

(1) Zoning By-law Amendment application UDZ-97-40 and Site Plan Approval application UDSP-97-222 be revised in accordance with the recommendations and comments made in this report;

(2) the applicant include, with a submission of revised plans pursuant to Recommendation (1) above, a use or development proposal and/or clarification on their intentions for their lands on the west side of Beecroft Road;

(3) the applicant's request to rezone their lands on the west side of Beecroft Road, including the Lansing United Church site, to implement the applicable policies of the Part D.2, Downtown Plan, as amended by OPA 393, which would permit densities to be transferred and used for residential purposes, is in principle supportable;

(4) if 31 Bogert Avenue and City-owned lands, described as a 186 m2 strip of land adjacent to the east side of Beecroft Road and a 72 m2 portion of the north-south public lane located west of Yonge Street, are acquired by Premium Properties Limited, while the current application remains active, that such lands be subject to the policies of the Part D.2, Downtown Plan, as amended by OPA 393;

(5) the applicant be advised that an application to amend the Part D.2, Downtown Plan, as amended by OPA 393, would be required:

(a) for indoor recreational amenity space to be considered for exemption from the calculation of density; and

(b) for the building heights proposed to be considered;

(6) the applicant be advised that a 1.5 metre wide conveyance is required across the Bogert Avenue frontage of the site to attain a 23-metre wide right-of-way, as discussed in the Status Report, dated May 12, 1999;

(7) the applicant be advised that the City will not sell and transfer densities from the Beecroft Road extension and the closed portion of Bogert Avenue to the development block as proposed by the Zoning By-law amendment application;

(8) should Council determine that densities should be sold and transferred from the Beecroft Road extension and the closed portion of Bogert Avenue to the applicant, that such densities be used for non-residential or commercial-only purposes;

(9) the applicant be requested to withdraw their appeal of OPA 447; and

(10) the City Solicitor and City staff be requested to attend the Ontario Municipal Board, scheduled to commence February 7, 2000, to defend the recommendations of this report and oppose the applicant's appeal of OPA 447, if necessary.
