Wednesday, June 23, 1999.
The North York Community Council met on Wednesday, June 23, 1999, in the Council
Chamber, North York Civic Centre, commencing at 12:30 p.m.
The North York Community Council, in accordance with subsection 4(1) of the Procedural
By-law, waived the requirement of the 9:30 a.m. commencement time in order to allow the
members of the North York Community Council to attend the funeral services of the late
Councillor Frank Faubert.
The North York Community Council, in accordance with subsection 11(8) of the Council
Procedural By-law, waived the requirement of the 12:30 p.m. recess, in order to complete
consideration of the items on the agenda, which carried, more than two-thirds of members
having voted in the affirmative.

Confirmation of Minutes
On motion by Councillor Li Preti, Black Creek, the minutes of the meetings of the North
York Community Council held on May 26, 1999, were confirmed.

6.0 PROCLAMATION - "LESBIAN AND GAY PRIDE WEEK" - JUNE 21-27, 1999.
Councillor Feldman, Chairman, North York Community Council, read out loud, at the
commencement of the meeting, the following Proclamation on behalf of Mayor Mel
Lastman:
"WHEREAS the new City of Toronto is proud to be one of the most diverse
cities in the world, believing in equality, safety, prosperity and hope; and
WHEREAS Toronto's Lesbian and Gay Pride Committee received the City
of Toronto's 1998 Tourism Toronto Award for "Best Festival/Event", and
1999's "One Pride Fits All" event promises to be an even bigger and better
celebration in our city; and
WHEREAS Toronto's Lesbian and Gay Pride Week is the result of months
of hard work by an all-volunteer organization and Pride Committee, as well
as hundreds of volunteers and community partners; and
WHEREAS Toronto's Lesbian and Gay Pride Week celebrations have now
become among the largest in North America, with more than 600,000 people
enjoying the parade and other events during the week; and
WHEREAS Toronto's Lesbian and Gay Pride Week is also one of the largest
and most important cultural events in the city, playing an important part in
Toronto's economic vitality by bringing in thousands of visitors and guests
for a week of fun and celebration; and
WHEREAS Toronto has a strong, vibrant and proud Gay and Lesbian
community - the third largest in North America - and an important part of the
rich fabric of our diverse City; and
WHEREAS I can personally confirm the warmth, enthusiasm, excitement and
tremendous spirit of Lesbian and Gay Pride Week, and its participants,
sponsors and attendees;
NOW THEREFORE, I Mel Lastman, Mayor of the City of Toronto, on behalf
of the people of our great City, am pleased to proclaim June 21-27, 1999, as
'Lesbian and Gay Pride Week' in Toronto and invite everyone to join in a
celebration of achievement and equality."

6.1 ROAD CLOSURE - UNNAMED PUBLIC STREET WEST OF VENICE DRIVE
EXTENDING NORTHERLY FROM QUEEN'S DRIVE - NORTH YORK HUMBER.
The North York Community Council had before it a draft by-law to stop up and close the
unnamed public street west of Venice Drive extending northerly from Queen's Drive and to
authorize the sale thereof.
Notice with respect to the proposed enactment of the draft by-law was advertised in The
Toronto Sun on June 1, June 7, June 14 and June 21, 1999.
No one addressed the North York Community Council in connection with the foregoing
matter.
On motion by Councillor Mammoliti, North York Humber, the North York
Community Council recommended to Council that, as the requirements of the
Municipal Act have been fulfilled and no evidence has been presented to the North
York Community Council to persuade it that the proposed by-law should not be
enacted, that the by-law to stop up and close the unnamed public street west of
Venice Drive extending northerly from Queen's Drive and to authorize the sale
thereof, in the form of the draft by-law, be enacted by Council.

6.2 SIGN BY-LAW VARIANCE REQUEST - WELDERS SOURCE INC. - 1881 WILSON
AVENUE - NORTH YORK HUMBER.
The North York Community Council had before it a report (June 4, 1999) from the Director
and Deputy Chief Building Official, reporting on a request by Mr. Howard Cane for a
variance from the Sign By-law to permit the erection of a first party two sided ground sign
at the rear of the property and recommending that the request for a variance from the Sign
By-law be refused.
The North York Community Council also had before it a communication (June 22, 1999)
from Ms. Lisa Cole, Permits Officer, Ministry of Transportation, advising that the Ministry
has approved the application for a sign permit for 1881 Wilson Avenue.
On motion by Councillor Mammoliti, North York Humber, the North York
Community Council recommended that the foregoing report (June 4, 1999) from the
Director and Deputy Chief Building Official, not be adopted; and that the request for
a variance from the Sign By-law be approved.

6.3 COMMUNITY FESTIVAL EVENT - 1999 DU MAURIER OPEN - CANADA'S
INTERNATIONAL WOMEN'S TENNIS CHAMPIONSHIPS - AUGUST 14-22, 1999 -
NATIONAL TENNIS CENTRE - YORK UNIVERSITY - BLACK CREEK.
The North York Community Council had before it a communication (May 25, 1999) from
Ms. Jane Wynne, Tournament Director, Canadian Tennis Association, advising North York
Community Council of the Canadian Tennis Association's intention in applying for a liquor
license for a community event to be held August 14-22, 1999.
The North York Community Council recommended to Council that the subject event
be declared a community festival event.

6.4 ENCROACHMENT AGREEMENT - 170 HORSHAM AVENUE - NORTH YORK
CENTRE.
The North York Community Council had before it a report (June 7, 1999) from the Director,
Transportation Services, District 3, reporting on an encroachment on the City road allowance
by the residents of 170 Horsham Avenue and recommending that the driveway encroachment
be approved subject to the owner(s) entering into an encroachment agreement with the City.
The North York Community Council recommended to Council the adoption of the
foregoing report.

6.5 ALL WAY STOP CONTROL - HONITON STREET AT KENNARD AVENUE -
NORTH YORK SPADINA.
The North York Community Council had before it a report (June 2, 1999) from the Director,
Transportation Services, District 3, recommending that Schedules XVIII and XIX of By-law
No. 31001, of the former City of North York, be amended to require traffic to stop on all
approaches to the intersection of Honiton Street and Kennard Avenue.
On motion by Councillor Moscoe, North York Spadina, the North York Community
Council recommended to Council the adoption of the foregoing report.

6.6 ALL WAY STOP CONTROL - FAIRMEADOW AVENUE AT UPPER CANADA
DRIVE - NORTH YORK CENTRE SOUTH.
The North York Community Council had before it a report (June 10, 1999) from the
Director, Transportation Services, District 3, recommending that Schedules XVIII and XIX
of By-law No. 31001, of the former City of North York, be amended to require traffic to stop
on all approaches to the intersection of Fairmeadow Avenue and Upper Canada Drive.
The North York Community Council recommended to Council the adoption of the
foregoing report.

6.7 NEIGHBOURHOOD TRAFFIC MANAGEMENT PLAN - UPPER CANADA DRIVE
- NORTH YORK CENTRE SOUTH.
The North York Community Council had before it a report (June 10, 1999) from the
Director, Transportation Services, District 3, recommending that:
(1) the two sets of speed cushions on Upper Canada Drive be removed;
(2) By-law No. 31878, of the former City of North York, be amended to delete the 40
km/h zone on Upper Canada Drive, from Lord Seaton Road (westerly limit) to the
easterly limit of Upper Canada Drive; and
(3) Schedule IX of By-law No. 31001, of the former City of North York, be amended to
delete "No Stopping at Any Time" restrictions adjacent to the speed cushions.
The North York Community Council recommended to Council the adoption of the
foregoing report.

6.8 PARKING/STOPPING PROHIBITIONS - PARENT AVENUE AND RODING
STREET - BLACK CREEK.
The North York Community Council had before it a report (May 18, 1999) from the
Director, Transportation Services, District 3, recommending that Schedules VIII and IX By-law No. 31001, of the former City of North York, be amended as follows:
(1) that parking be prohibited from 8:00 a.m. to 6:00 p.m., on the east side of Roding
Street between Calvington Drive and a point 52 metres north of Nash Drive;
(2) that the stopping prohibition be removed from the south side of Parent Avenue,
between Exbury Road and Roding Street; and
(3) that stopping be prohibited from 8:00 a.m. to 6:00 p.m., Monday to Friday, on the
north side of Parent Avenue, between Exbury Road and Roding Street.
The North York Community Council recommended to Council the adoption of the
foregoing report.

6.9 PARKING PROHIBITIONS - HILLCREST AVENUE - NORTH YORK CENTRE.
The North York Community Council had before it a report (May 19, 1999) from the
Director, Transportation Services, District 3, recommending that:
(1) Schedule VIII of By-law No. 31001, of the former City of North York, be amended
as follows:
(a) rescind the existing parking prohibition on the north side of Hillcrest Avenue,
from the easterly limit of Yonge Street to the westerly limit of Doris Avenue;
and
(b) prohibit parking at anytime on the south side of Hillcrest Avenue, from the
easterly limit of Yonge Street to the westerly limit of Doris Avenue; and
(2) the City Solicitor be directed to prepare the appropriate Bills for the installation of
fourteen (14) metered parking spaces on the north side and removal of two (2)
metered parking spaces on the south side of Hillcrest Avenue, between Yonge Street
and Doris Avenue.
The North York Community Council recommended to Council the adoption of the
foregoing report.

6.10 PARKING PROHIBITIONS - INEZ COURT - NORTH YORK CENTRE.
The North York Community Council had before it a report (June 1, 1999) from the Director,
Transportation Services, District 3, recommending that Schedule VIII of By-law No. 31001,
of the former City of North York, be amended to prohibit parking from 8:00 a.m. to 4:00
p.m., Monday to Friday, on the south side of Inez Court, from Fairchild Avenue to the
easterly limit of Inez Court.
The North York Community Council recommended to Council the adoption of the
foregoing report.

6.11 CLOSURE OF LEONA DRIVE - SOUTH OF SHEPPARD AVENUE EAST - NORTH
YORK CENTRE.
The North York Community Council had before it a report (June 1, 1999) from the Director,
Transportation Services, District 3, recommending that:
(1) by enactment of a confirmatory By-law adopting this report, Leona Drive, at a point
20 metres south of Sheppard Avenue East, be temporarily closed to through traffic
for a 40 month period beginning July 12, 1999;
(2) during the temporary closure, there shall be no use of the closed road for vehicle
traffic except under the authority of a permit issued by the Commissioner of Works
and Emergency Services; and
(3) staff of the Transportation and Technical Services Divisions of the Works and
Emergency Services Department be requested to submit within the temporary closure
period a detailed report for the future permanent closure of Leona Drive, as was
identified in the Addendum to the Environmental Study Report for the Downtown
Plan, South of Sheppard Avenue.
The North York Community Council recommended to Council the adoption of the
foregoing report.

6.12 TEMPORARY ROAD CLOSURE - 25 GRENADINE COURT - NORTH YORK
HUMBER.
The North York Community Council had before it a report (June 1, 1999) from the Director,
Transportation Services, District 3, recommending that:
(1) by enactment of a confirmatory By-law adopting this report, Grenadine Court should
be closed temporarily on Saturday, August 28, 1999, from 6:00 p.m. to 12:00 p.m.
and on Sunday, August 29, 1999, from 9:00 a.m. to 12:00 p.m., subject to the
applicant's compliance with Procedural By-law No. 27433 of the former City of
North York; and
(2) during the temporary closure, there shall be no use of the closed roadway for
vehicular traffic except under the authority of a permit issued by the Commissioner
of Works and Emergency Services.
The North York Community Council recommended to Council the adoption of the
foregoing report.

6.13 PRELIMINARY EVALUATION REPORT - ZONING AMENDMENT
APPLICATION UDZ-99-15 - MANJIT S. MANGAT - 150 FINCH AVENUE WEST -
NORTH YORK CENTRE.
The North York Community Council had before it a report (June 8, 1999) from the Acting
Director, Community Planning, North District, providing preliminary comments on an
application to amend the Zoning By-law to permit five freehold townhouses at 150 Finch
Avenue West; and recommending that staff continue processing the application in the
manner outlined in the report.
The North York Community Council received the foregoing report.

6.14 PRELIMINARY EVALUATION REPORT - ZONING AMENDMENT
APPLICATION UDZ-99-12 - ANNE JUDSON - 187 FINCH AVENUE WEST -
NORTH YORK CENTRE.
The North York Community Council had before it a report (June 8, 1999) from the Acting
Director, Community Planning, North District, providing preliminary comments on an
application to amend the Zoning By-law to permit an existing 1 ½ storey single family
dwelling to be converted to a real estate office; and recommending that staff continue
processing the application in the manner outlined in the report.
The North York Community Council received the foregoing report.

6.15 PRELIMINARY EVALUATION REPORT - OFFICIAL PLAN AND ZONING
AMENDMENT APPLICATION UDOZ-99-11 - WESTON CONSULTING GROUP
FOR 1333955 ONTARIO INCORPORATED - 1723 FINCH AVENUE WEST -
BLACK CREEK.
The North York Community Council had before it a report (June 8, 1999) from the Acting
Director, Community Planning, North District, providing preliminary comments on an
application to amend the Official Plan and Zoning By-law to permit the development of 24
condominium townhouse units on a private road; and recommending that staff continue
processing the application in the manner outlined in the report.
A. Councillor Li Preti, Black Creek, moved that the North York Community Council
recommend to Council that the foregoing report (June 8, 1999) from the Acting
Director, Community Planning, North District, be received.
B. Councillor Moscoe, North York Spadina, moved that the Acting Director,
Community Planning, North District, be requested to bring forward, prior to the final
report, a separate specific report on the top-of-bank, to be considered at a future
North York Community Council meeting.
Upon the question of the adoption of the foregoing motions A. and B., it was carried.

6.16 PRELIMINARY EVALUATION REPORT - ZONING AMENDMENT
APPLICATION UDZ-99-10 AND SITE PLAN APPROVAL APPLICATION
UDSP-99-029 - TERRAVENTURE GROUP - 76 SPRING GARDEN AVENUE -
NORTH YORK CENTRE.
The North York Community Council had before it a report (June 8, 1999) from the Acting
Director, Community Planning, North District, providing preliminary comments on an
application to amend the Zoning By-law and a related Site Plan Approval application to
permit three three-storey freehold townhouses at 76 Spring Garden Avenue; and
recommending that staff continue processing the application in the manner outlined in the
report.
The North York Community Council received the foregoing report.

6.17 APPLICATION FOR PART LOT CONTROL EXEMPTION UD54-99-03-REL -
LEXINGTON (GREEN) HOMES INC. - 2 TO 44 SAM FRUSTAGLIO DRIVE -
NORTH YORK HUMBER.
The North York Community Council had before it a report (June 8, 1999) from the Acting
Director, Community Planning, North District, reporting on an application for exemption
from part lot control in order that 22 semi-detached dwelling units may be conveyed into
separate ownership, and submitting recommendations with respect thereto.
The North York Community Council recommended to Council the adoption of the
foregoing report.

6.18 REPORT - NEW DEVELOPMENT APPLICATIONS FOR NORTH DISTRICT.
The North York Community Council had before it a report (June 8, 1999) from the Acting
Director, Community Planning, North District, reporting on new development applications
(zoning and official plan amendments, lifting of (H) holding zone designations and plans of
subdivision) received by the Planning Division, North District, from April 28, 1999 to May
26, 1999.
The North York Community Council received the foregoing report.

6.19 COUNCILLOR APPOINTMENTS TO LOCAL SPECIAL PURPOSE BODIES.
The North York Community Council had before it a communication (June 1, 1999) from the
City Clerk, advising that Council has directed that the nomination process for appointing
Members of Council to local special purpose bodies be conducted through the Community
Councils rather than the Striking Committee, and recommending that:
(1) consideration be given to Members' preferences outlined in Schedule 1, and
recommend to City Council the appointment of Members of Council to those special
purpose bodies outlined in such Schedule for a term of office expiring November 30,
2000, and until their successors are appointed, unless indicated otherwise; and
(2) leave be granted for the introduction of any necessary Bills in Council to give effect
thereto.
The North York Community Council also had before it:
(i) the Members Preferences for Appointment to the North York Emergency Home for
Youth (Eva's Place), Board of Directors; and
(ii) Schedule 1 referred to in the report (June 1, 1999) from the City Clerk.
The North York Community Council recommended to Council that:
(1) Councillor David Shiner be appointed to the North York Emergency Home
for Youth (Eva's Place) for a term of office expiring November 30, 2000, and
until a successor is appointed, unless indicated otherwise;
(2) leave be granted for the introduction of any necessary Bills in Council to give
effect thereto; and
(3) the appropriate City officials be authorized and directed to take the necessary
action to give effect thereto.

6.20 DOWNSVIEW AREA TRANSPORTATION MASTER PLAN AND OFFICIAL PLAN
AMENDMENT NO. 464 - NORTH YORK SPADINA.
On motion by Councillor Moscoe, North York Spadina, the North York Community
Council allowed individuals in attendance an opportunity to address the North York
Community Council in order to determine whether this matter should be discussed
in public or whether it should be discussed in camera.
The following persons appeared before North York Community Council in connection with
the foregoing matter:
- Mr. Vince Lombardi, who expressed concern about not being afforded an opportunity
to review and comment on the report. In his opinion, any modifications to Official
Plan Amendment 464 and amendments to the Downsview Area Transportation
Master Plan, regardless of how minor or technical, will affect the community. He
therefore requested that the June 7, 1999 supplementary report from the
Commissioner of Urban Planning and Development Services and the Commissioner
of Works and Emergency Services be made a public document; that proper notice be
given and a public meeting be held in order to provide the residents an opportunity
to make comments and submissions.
- Mr. David Birnbaum, who expressed concern about the report being confidential.
In light of the long history of misunderstandings regarding the future development
of these lands, he was of the opinion that the report should not be discussed in private
and the residents should be given an opportunity to review the proposed
modifications and amendments in order to determine for themselves whether or not
the changes are technical in nature.
The North York Community Council also had before it a communication (June 21, 1999)
from Mr. Jeffrey D. Chelin, Chief Financial Officer, ARC International Corporation,
objecting to Council taking any action dealing with public policy in a closed session, which
would preclude appropriate representation by any interested parties; requesting that Council
release any report on the Downsview Lands to the public in advance of the Community
Council meeting; and forwarding a copy of a communication (May 27, 1999) to Mr. Irvin
Shachter of the Legal Department, outlining issues of concern to ARC International
regarding OPA 464.
On motion by Councillor Chong, Don Parkway, the North York Community Council
decided to discuss this matter in camera and determine at that point whether the
confidentiality of the report should be lifted.
The North York Community Council met in camera to discuss the confidential report
(June 7, 1999) from the Commissioner of Urban Planning and Development Services and
the Commissioner of Works and Emergency Services, respecting the Downsview Area
Transportation Master Plan and Official Plan Amendment No. 464.
On motion by Councillor Moscoe, North York Spadina, the North York Community
Council lifted the confidentiality of the report and requested the Acting Director,
Community Planning, North District to:
(1) make copies of the said report available to the public; and
(2) provide notice of a public meeting to be held at the North York Community
Council meeting scheduled for July 15, 1999, to hear deputations on the
proposed amendments to the Downsview Area Transportation Master Plan
and modifications to Official Plan Amendment No. 464.

6.21 PROPOSED ONTARIO MUNICIPAL BOARD SETTLEMENT - OFFICIAL PLAN
AND ZONING AMENDMENT, PLAN OF SUBDIVISION AND SITE PLAN
APPLICATIONS - UDOZ-90-52, UDSB-1231 AND UDSP-97-012 - DON-
GREENBELT DEVELOPMENT LTD., 45 GREEN BELT DRIVE AND UDOZ-94-14,
UDSB-1218 AND UDSP-97-124 - GHODS BUILDERS IN TRUST, 39 GREEN BELT
DRIVE - DON PARKWAY.
The North York Community Council met in camera to discuss the following confidential
reports:
(i) Supplementary Report No. 4 (June 22, 1999) from the Acting Director, Community
Planning, North District; and
(ii) Supplementary Report No. 3 (June 8, 1999) from the Acting Director, Community
Planning, North District and the Director, Parks and Recreation, North District,
respecting a proposed Ontario Municipal Board settlement.
A. Councillor Minnan-Wong, Don Parkway, moved that the North York Community
Council recommend to Council the adoption of the following Resolution:
WHEREAS Don-Greenbelt Development Ltd. (Owner of 45 Green Belt Drive) and
Ghods Builders in Trust (owners of 39 Green Belt Drive) have signed a cost sharing
and servicing agreement and construction agreement to permit development on the
site; and
WHEREAS Don-Greenbelt Development Ltd. (Owner of 45 Green Belt Drive) and
Ghods Builders in Trust (owners of 39 Green Belt Drive) have separately signed
agreements with the local ratepayer association regarding built form; and
WHEREAS after a significant hearing process, the only outstanding matters involve
the City, Ghods Builders in Trust and Don-Greenbelt Developments Ltd.; and
WHEREAS the final modifications to the Official Plan and Zoning By-law attached
as Appendices to Supplementary Report No. 4 are supported by the City, Ghods
Builders in Trust and Don-Greenbelt Developments Ltd.;
THEREFORE BE IT RESOLVED THAT Supplementary Report No. 3
(June 8, 1999) from the Acting Director, Community Planning, North District, and
the Director, Parks and Recreation, North District and Supplementary Report No. 4
(June 22, 1999) from the Acting Director, Community Planning, North District, to
resolve matters at the Ontario Municipal Board, be adopted;
AND BE IT FURTHER RESOLVED THAT the contents of the Official Plan
Amendment, and By-law attached hereto are satisfactory; and
B. Councillor Chong, Don Parkway, moved that the appropriate city officials be
authorized and directed to take the necessary action to finalize the draft plan of
subdivision at the June 30, 1999, Ontario Municipal Board hearing, along with such
modifications as the Ontario Municipal Board may find appropriate.
Upon the question of the adoption of the foregoing motions A. and B., it was carried.

6.22 COMMUNITY FESTIVAL EVENT - ASSOCIACION CULTURAL COLOMBO
CANADIENSE - COLUMBIAN FESTIVITY - CALEDONIA/LAWRENCE PARK -
JULY 17 AND 18, 1999 - NORTH YORK HUMBER.
The North York Community Council had before it a communication (June 20, 1999) from
Ms. Sonia Castano, President, Associacion Cultural Colombo Canadiense, advising North
York Community Council of the Associacion Cultural Colombo Canadiense's intention in
applying for a Special Occasion Permit with the Liquor Control Board of Ontario for a
community event to be held July 17 and 18, 1999.
On motion by Councillor Li Preti, Black Creek, the North York Community Council
recommended to Council that the subject event be declared a community festival
event.

6.23 DRAFT OFFICIAL PLAN AMENDMENTS AND ZONING BY-LAW
AMENDMENTS TO PERMIT SECOND SUITES AS-OF-RIGHT.
Councillor Flint, North York Centre, moved that in the event the Planning and
Transportation Committee does not reach a resolution on this matter at its meeting to be held
on July 12, 1999, that this item be placed on the agenda of the North York Community
Council for its meeting scheduled for July 15, 1999, for comments.
The Chairman ruled the motion out of order because this matter is currently before the
Planning and Transportation Committee for consideration.
The North York Community Council adjourned its meeting at 1:45 p.m., Wednesday, June 23, 1999.
