REPORT NO. 1 OF THE POLICY AND FINANCE COMMITTEE
Clause No. 1 - "2000-2004 Capital Budget and Five Year Capital Program".
Council adopted the recommendations of the Policy and Finance Committee embodied in this Clause, subject to the
following amendments:
Parks and Recreation:
(1) by amending Recommendation No. (I)(i) of the Policy and Finance Committee by deleting Recommendation No. (16)
under Parks and Recreation, viz.:
"(16) the Commissioner of Economic Development, Culture and Tourism and the Chief Financial Officer and Treasurer be
requested to report back on the feasibility of selling the golf courses;";
(2) to provide that the location of the North District Major Soccer Facility, which was previously approved by Council in
the 1999 Capital Budget, be changed from Elm Park Secondary School to Regina Pacis Catholic Secondary School or
Cardinal James C. McGuigan Secondary School, with no additional funding; and
(3) having regard for the decision of Council in Item No. (2) above, and that the proposed change in scope for the North
District Major Soccer project, which would have required additional funding, is no longer before Council for consideration,
the following Recommendation No. (II) of the Policy and Finance Committee was deemed redundant:
"(II) that with respect to the recommendation of the Budget Advisory Committee regarding the deletion of $1 million for
the North District Soccer Facility, the Commissioner of Economic Development, Culture and Tourism be requested to
report to the Economic Development and Parks Committee on this request being a new project and that the project not
receive any approval without the identification of funds available and a report thereon to the Budget Advisory Committee
from the Commissioner of Economic Development, Culture and Tourism;"; and
(4) by adding thereto the following:
"It is further recommended that:
(a) the Commissioner of Economic Development, Culture and Tourism be requested to determine if the Soccer Facility in
the Jane Finch Area could be established in a manner which would permit its future expansion into a regional soccer
facility, if Council so determines, and submit a report thereon to the Economic Development and Parks Committee;
(b) the issue of the safety audit for the Lakeshore Grounds/Colonel Samuel Smith Park be referred to the Commissioner of
Economic Development, Culture and Tourism and the Acting Commissioner of Corporate Services for a joint report
thereon to the Budget Advisory Committee, for consideration as part of the 2000 Operating Budget process;
(c) the Commissioner of Economic Development, Culture and Tourism be requested to submit a report to the Economic
Development and Parks Committee on the needs assessment for the Edithvale Community Centre and whether such
assessment could be done utilizing in-house resources; and further that funding in the amount of $15,000.00 be allocated in
the 2000 Capital Budget, to be available in the event the Commissioner of Economic Development, Culture and Tourism
recommends that the needs assessment be conducted, in 2000, using external resources; and
(d) the Commissioner of Economic Development, Culture and Tourism be requested to submit a report to the Economic
Development and Parks Committee on whether a needs assessment of ravines forest management can be conducted by
in-house resources or whether external resources would be required."
Urban Development Services:
(5) by increasing the 2000 Capital Budget for the Sheppard Provost Streetscape Improvements by $40,000.00 and reducing
the 2001 Capital Budget by a corresponding amount for the same project; and
(6) by adding thereto the following:
"It is further recommended that the Acting Commissioner of Urban Development Services be requested to submit a report
to the Budget Advisory Committee on any requirements in the year 2000 for preparatory works for Kingston Road, from
Midland Avenue to St. Clair Avenue East."
Transportation:
(7) by adding thereto the following:
"It is further recommended that:
(a) the Commissioner of Works and Emergency Services be requested to submit reports to the Works Committee on:
(i) whether the reconstruction of the southeast corner of Dufferin Street and Eglinton Avenue West can be accommodated
within the existing 2000 Capital Budget or, alternatively, if a suitable source of funding and/or timing can be identified for
this project;
(ii) whether the reconstruction of Ranee, Bentworth and Dufferin Streets can be accommodated within the existing 2000
Capital Budget or, alternatively, if a suitable source of funding and/or timing can be identified for this project; and
(iii) options for the re-design/reconstruction of the Dundas Street West bridge at Kipling Avenue, prior to the award of any
contract or tender for this project, such report to be prepared in consultation with the Acting Commissioner of Urban
Development Services;
(b) the Commissioner of Works and Emergency Services be requested to submit a report to the appropriate Standing
Committee and the Toronto Cycling Committee on the possibility of the creation of bicycle lanes on roads that are being
considered for re-surfacing this year, and to highlight, in particular, those lanes which could form part of the proposed
bicycling master plan; and
(c) Council adopt the following motion:

'WHEREAS a number of City of Toronto Departments and other agencies, such as the Toronto Police Service, Works and
Emergency Services, Urban Development Services and Economic Development, Culture and Tourism, are responsible for
various elements of the review, processing, permitting, planning and delivery of services and management of Special
Events on City of Toronto highways and streets; and
WHEREAS, on City of Toronto streets last year, some:
(a) 500 special events;
(b) 15 major races resulting in extensive street closures;
(c) 300 parades; and
(d) 5,000 film permits;
were accommodated, and the demand for the use of streets for these purposes is increasing; and
WHEREAS the proposed Capital Works Programs for Transportation Services and the various utility companies for the
year 2000 will provide for additional maintenance of the road and utility infrastructure; and
WHEREAS the combined annual construction programs and increasing number of events, races, parades and filming
activities represent a serious potential for disrupting access and routing alternatives that can affect business and tourism;
and
WHEREAS it is essential that better methods be found to communicate and mitigate the impacts of such activities; and
WHEREAS the Commissioner of Works and Emergency Services agrees with the recommendations of this motion;
NOW THEREFORE BE IT RESOLVED THAT the Commissioner of Works and Emergency Services, in consultation
with the Managing Director of Economic Development, appropriate representatives of the Toronto Police Service, Toronto
Transit Commission, Emergency Services and Urban Development Services be requested to meet with major stakeholder
groups, such as the Utility Companies, Tourism Toronto and the Board of Trade, to develop a strategic plan for the overall
management of traffic during planned events and construction projects and report back in four months' time on the plan
framework, including any necessary resources, through the Works Committee.' "
Toronto Transit Commission (excluding RTEP):
(8) by adding thereto the following:
"It is further recommended that:
(a) the following motion be referred to the Commissioner of Economic Development, Culture and Tourism and the Chief
Financial Officer and Treasurer for report thereon to the Special Meeting of the Economic Development and Parks
Committee scheduled to be held on February 17, 2000, in conjunction with the issue of the Olympic Bid:
Moved by Councillor Moscoe:
'It is further recommended that the Chair, Toronto Transit Commission, in consultation with the Chief Financial Officer
and Treasurer, be requested to submit a report to the Policy and Finance Committee on the capital requirements of the
Toronto Transit Commission Olympic Transportation Plan that must be initiated within the 2000 Capital Budget year, and
to identify a source of funding for this project.'; and
(b) the following motion be referred to the Chief Financial Officer and Treasurer for report thereon to the Policy and
Finance Committee:
Moved by Councillor Moscoe:
'That Recommendation No. (2)(b) embodied in the report dated January 11, 2000, from the Chief Financial Officer and
Treasurer, be amended to read as follows:
"(2)(b) $5 million of the City of Toronto's share of the GO Transit budget surplus for January 1 through August 7, 1999,
estimated to be $6.3 million, be set aside for the construction of commuter parking spaces identified by the Toronto Transit
Commission as a priority, and the balance be applied against tax-supported capital borrowing requirements in 2000;" '."
General:
(9) by inserting in Recommendation No. (1)(d) embodied in the communication (January 14, 2000) from the City Clerk,
after the words "operating budget impact,", the words "including those recommended for approval,", so that such
recommendation shall now read as follows:
"(d) the operating budget impact, including those recommended for approval, identified in Appendix 'E', that result in a
cumulative net expenditure impact of $2.1 million in 2000; $1.3 million by 2001; ($0.1) million by 2002; $1.3 million by
2003 and $2.9 million by 2004 be reviewed in conjunction with the 2000 Operating Budget submission within the
respective program areas;"; and
(10) by adding thereto the following:
"It is further recommended that:
(a) the Chief Administrative Officer, in consultation with the Chief Financial Officer and Treasurer, be requested to submit
a report to the Policy and Finance Committee outlining Capital funding issues related to the Toronto Transit Commission
(TTC) and GO Transit expansion plans currently being discussed at the TTC and the Greater Toronto Services Board; such
report to address the relationship between the City of Toronto's transportation capacity and the economic viability of
business in Southern Ontario;
(b) the Chief Financial Officer and Treasurer be requested to submit a report to the Policy and Finance Committee on the
$2 million of reserve funding from the former City of York being allocated for the construction of a community centre in
the Eglinton - Black Creek area;
(c) the following motions be referred to the Chief Administrative Officer for report thereon to the Policy and Finance
Committee:
Moved by Councillor Davis:
'It is further recommended that:
"WHEREAS the City of Toronto has $1.7 billion in outstanding debt obligations in the form of bonds and debentures; and
WHEREAS the cost of servicing such debt is estimated at $118 million per annum; and
WHEREAS all interest income from municipal debt instruments are fully taxable to the holders; and
WHEREAS tax free interest income would facilitate a lower lending rate to all creditors of the City of Toronto; and
WHEREAS such a lower lending rate could save the City of Toronto in excess of $60 million per year, if applied to the
existing debt load under the existing market conditions; and
WHEREAS it is common practice in major U.S. municipalities to issue tax free municipal bonds to pay for infrastructure,
such as roads, water treatment plants, etc.; and
WHEREAS the federal and provincial governments are in the process of budget consultations for the fiscal year
2000-2001; and
WHEREAS the City of Toronto and all municipalities in the Province of Ontario and Canada could benefit from tax free
bonds and debentures;
NOW THEREFORE BE IT RESOLVED THAT the City of Toronto endorse, in principle, the proposal for legislation
that would deem interest income from municipal debt instruments to be free from federal and provincial taxation;
AND BE IT FURTHER RESOLVED THAT Council establish a Working Committee on Municipal Debt composed of
five members of City Council working with staff to establish a proposal for presentation to federal and provincial finance
Ministers and/or officials, Councillors Davis and Sinclair to be appointed to such committee." '

'It is further recommended that the Chief Administrative Officer, in the preparation of the draft 2001 Capital Budget, be
requested to consult with Members of Council, on an individual basis, to ensure that geographic or ward priorities are
integrated with departmental priorities.'; and
(d) City Council convey its appreciation to the Members of the Budget Advisory Committee, the Chief Administrative
Officer, the Chief Financial Officer and Treasurer, staff of the Finance Division and the Administrator of the Budget
Advisory Committee for their efforts in preparing the 2000 Capital Budget."

"WHEREAS CHIN 1540 Limited, the current license holder of CHIN Radio 1540, began broadcasting to the Toronto
market on June 6, 1966, and was conceived and nurtured on the precepts of diversity and the celebration of differences; and
WHEREAS CHIN Radio's philosophy that there is strength in our diversity reflects the true cosmopolitan nature and
'make up' of our city; and
WHEREAS throughout the years in its programming in 30 languages, this radio station has served Toronto's many ethnic
communities and has devoted itself to reaching out to people, irrespective of their colour, race and religion; and
WHEREAS this radio station serves all generations locally and has brought its philosophy and message of strength in
cultural diversity to all corners of the continent via satellite programming, and in doing so has fostered communication and
introduced Toronto's varied cultures and our progressive communities to many towns and cities; and
WHEREAS CHIN Radio has submitted an application to the Canadian Radio-Television and Telecommunications
Commission (Public Notice CRTC 1999-119) for the purpose of seeking Commission approval for a new broadcasting
license to carry on an ethnic radio programming undertaking using frequency 740 kHz, serving the Greater Toronto Area;
and
WHEREAS the CRTC will hold hearings to considered this application on January 31, 2000; and
WHEREAS over 100 languages are spoken in the Greater Toronto Area, and the acquisition of 740 AM service by CHIN
Radio would allow for the expansion of its service to serve the needs of additional cultural and linguistic groups that are
currently not served;
NOW THEREFORE BE IT RESOLVED THAT the City of Toronto Council support the application by CHIN 1540
Limited for a new broadcasting license to carry on an ethnic radio programming using frequency 740 kHz;
AND BE IT FURTHER RESOLVED THAT the City Clerk be directed to indicate Council's support to the Canadian
Radio-Television and Telecommunications Commission for its hearing to take place on January 31, 2000."

"WHEREAS residents of Toronto have been justifiably proud of the independent, impartial and effective policing services
provided by all members of the Toronto Police Service; and
WHEREAS Operation True Blue conducted by the Police Association has caused extreme concern amongst many of the
residents of Toronto who have advised Councillors that they feel intimidated and threatened; and
WHEREAS the idea of a Police Association conducting political campaigns in the manner stated by the leader of the
Police Association is an affront to basic principles of democracy whereby the Police are responsible to civilian overseers;
and
WHEREAS it appears the Police Association intends to continue this campaign, despite near universal condemnation;
NOW THEREFORE BE IT RESOLVED THAT the Council of the City of Toronto condemn the campaign 'Operation
True Blue' conducted by the Toronto Police Association;
AND BE IT FURTHER RESOLVED THAT the Council of the City of Toronto request the Chief of Police, the Mayor,
and the Police Services Board to take all possible immediate steps to end this campaign;
AND BE IT FURTHER RESOLVED THAT unless the Toronto Police Association stops its activities known as
'Operation True Blue' by January 27, 2000, and if no other injunction has been put in place, that City Council request the
Police Services Board to prepare an injunction against the Toronto Police Association's activities known as Operation True
Blue, including the maintenance of these fundraising lists, and that the Police Services Board prepare the documents for
that injunction as soon as possible;
AND BE IT FURTHER RESOLVED THAT the Chief of Police be requested to review the recent conduct of the
executive members of the Toronto Police Association within the context of the Police Services Act to determine whether
breaches of discipline have taken place and act accordingly;
AND BE IT FURTHER RESOLVED THAT the Council of the City of Toronto clearly state that private investigation or
intimidation of public officials is not condoned and is considered an unacceptable activity by police officers, the police
service or anyone acting on behalf of the Toronto Police Association;
AND BE IT FURTHER RESOLVED THAT City Council request the Police Services Board to enact a by-law at its
Board meeting of February 2, 2000, which prohibits the solicitation of funds by any member of the Toronto Police
Association for political activity, as set out in the Police Services Act, and for the use of private investigators or other
measures of intimidation."
Disposition: The Motion was adopted, subject to:
(1) amending the penultimate Operative Paragraph embodied therein by inserting, after the words "intimidation of
public officials", the words "or any member of the public", so that such Operative Paragraph shall now read as
follows:
"AND BE IT FURTHER RESOLVED THAT the Council of the City of Toronto clearly state that private investigation
or intimidation of public officials or any member of the public is not condoned and is considered an unacceptable
activity by police officers, the police service or anyone acting on behalf of the Toronto Police Association;";
(2) adding to the last Operative Paragraph embodied therein the following words:
"based on the following draft by-law:
'WHEREAS, pursuant to Regulation 123/98 of the Police Services Act, police officers who are engaged as authorized
representatives of a police association do not commit misconduct under subclause 2(1)(f)(iii) of the Code of Conduct
only by virtue of the fact that they are engaged in the solicitation of gratuities, subscriptions or other similar
contributions; and
WHEREAS, pursuant to subclause 2(1)(a)(xi) of Regulation 123/98, such activities must nevertheless be conducted in a
manner which is not likely to bring discredit upon the reputation of the police service; and
WHEREAS any method of such solicitation which involves or could possibly give rise to the appearance of coercion,
intimidation or the conferring of any preferred status is likely to bring discredit upon the reputation of the police
service;
NOW THEREFORE BE IT RESOLVED THAT the Toronto Police Services Board hereby enacts the following by-law
pursuant to s.31(6) of the Police Services Act:
(1) the solicitation and/or receipt of funds by any member of the Toronto Police Service for the purpose of engaging in
any political activity is prohibited;
(2) any solicitation of funds by any member of the Toronto Police Service in which the means, manner or method
employed involves or could possibly involve the appearance of:
(a) coercion, intimidation, or the possibility of any contribution which is not entirely voluntary; or
(b) the conferring of any preferred status;
is prohibited;
(3) without limiting the generality of the foregoing, this by-law prohibits the following:
(a) solicitation by way of telemarketing, e-mail, facsimile or any other method whereby the party solicited can be
identified; and
(b) solicitation whereby any party making a contribution receives a decal, insignia, button, card or any other object
which identifies the bearer as a contributor to the association; and
(4) the foregoing prohibitions apply to actions taken, whether directly or indirectly, by or on behalf of members of the
police service as they may relate to solicitations on behalf of any police association.'; and
(3) adding thereto the following new Operative Paragraphs:
"AND BE IT FURTHER RESOLVED THAT Council request changes to the federal Criminal Code and to provincial
legislation which would make it illegal to harass citizens elected to provincial, municipal and school board office;
AND BE IT FURTHER RESOLVED THAT Council request that an emergency meeting of the Police Services Board
be held within 24 hours;
AND BE IT FURTHER RESOLVED THAT the Toronto Police Association be requested to hold their 'Toronto Police
Association Lobby 2000 of City of Toronto Councillors' as an open forum to be held in the Toronto Council Chamber
and the citizens of Toronto be invited to attend;
AND BE IT FURTHER RESOLVED THAT the Acting Commissioner of Corporate Services be requested to arrange a
contract with a security company to sweep the offices, cars and homes of any Councillor, who so requests, for recording
devices, and further that any bugging devices discovered be immediately reported to the Ontario Provincial Police for
investigation;
AND BE IT FURTHER RESOLVED THAT the City Solicitor be requested to submit a report directly to Council for
its meeting to be held on February 1, 2 and 3, 2000, on the status of this matter before the Police Services Board;
AND BE IT FURTHER RESOLVED THAT the City Solicitor be requested to submit a report to the Policy and
Finance Committee on how the Police Services Act could be amended to respond to the concerns voiced by several
Councillors respecting the issue of possible civil litigation being taken against Members of Council for their critical
remarks in this regard, and on what the Criminal Code of Canada provides in respect of harrassment of federal and
municipal elected officials;
AND BE IT FURTHER RESOLVED THAT the media package submitted by Councillor Layton of the Press
Conference held by the Law Union of Ontario (January 25, 2000), entitled 'Operation True Blue', be referred to the
Toronto Police Services Board, all Members of Council and the City Solicitor for their attention."
