Release of Hydro Easement on 21 Oak Street

(City Council on February 4, 5 and 6, 1998, adopted this Clause, without amendment.)

The York Community Council recommends The York Community Council recommends adoption of the following report (November 4, 1997) from the Solicitor:

Purpose:

The Solicitors, McCarthy Tetrault, representing the owner of the property known municipally as 21Oak Street, requested by letter dated October 21, 1997, that a hydro easement which was registered on November 21, 1972 as Instrument No. 584524 York, be released from title to the property.

Source of Funds:

None required.

Recommendation:

It is recommended that the Mayor and Clerk be authorized to execute on behalf of the City a release to the hydro easement which was registered against a portion of the subject property on November21, 1972, as Instrument Number 584524 York.

Council Reference/Background/History:

The Hydro Electric Commission for the City of York has advised that the easement was originally needed to protect overhead hydro distribution wires, poles, and anchors when the property was used for the operation of an industrial facility. That facility has since been demolished and all of York Hydro's plant has been satisfactorily removed and recovered. Accordingly, York Hydro advises that there is no longer a need for the easement and that it may be released.

Comments:

If the hydro easement is not released, it will continue to encumber the property and may deter redevelopment of the site.

Conclusions:

Given that the subject hydro easement is no long required, it should be released from title to the property.

Appeal of Committee of Adjustment Applications

106 Gloucester Grove, Ward 27

28 Guestville Avenue, Ward 28

573 Blackthorn Avenue, Ward 28

The York Community Council recommends adoption of the following report (January 7, 1998) from the Commissioner of Development Services:

Purpose:

To provide information on the status of appeals regarding Committee of Adjustment decisions on applications.

Source of Funds:

Not applicable.

Recommendations:

It is recommended that:

(1) appropriate staff be directed to attend the Ontario Municipal Board Hearing to be scheduled for 573 Blackthorn Avenue to recommend refusal of the minor variance application which would permit front yard parking; and

(2) the information presented in this report for the appeal of Committee of Adjustment decisions regarding 106 Gloucester Grove and 28 Guestville Avenue be received.

The Committee of Adjustment on June 17, 1997, considered a minor variance application to permit construction of a second storey addition above the rear one storey part of an existing 2 storey detached dwelling. The Development Services Department reported to Committee no objection to the application.

The Committee, after deferring the application for 3 months to receive survey information and a revised site plan, granted the application on July 29, 1997.

The abutting owner of 104 Gloucester Grove has appealed Committee's decision. The Ontario Municipal Board has not scheduled a hearing to date.

(2) Application CA-97-77 - 28 Guestville Avenue

(Ref. Appendix C & D)

The Committee of Adjustment on May 27, 1997, considered a minor variance application to permit construction of a second storey rear addition above the rear one storey portion of an existing two storey semi-detached dwelling. The Development Services Department reported to Committee no objection to the application.

The Committee deferred the application to its next meeting to permit the applicant to address concerns of an opposing abutting neighbour. On June 17, 1997, the Committee granted the application.

The abutting owner at 30 Guestville Avenue has appealed Committee's decision. The Ontario Municipal Board has not scheduled a hearing date.

(3) Application CA-97-98 - 573 Blackthorn Avenue

(Ref. Appendix E & F)

Committee of Adjustment on July 8, 1997, considered a minor variance application for permission to create a front yard parking space, notwithstanding that a parking space is already provided on the lot in a rear yard garage which is accessed by a driveway of sufficient width. The Development Services Department reported recommending refusal of the application. The rationale for the recommendation was that the applicant has access to an existing rear yard garage and also can access another part of the rear yard to provide an additional parking space. The existing driveway access provided exceeds the minimum standards to be eligible for front yard parking.

The Committee of Adjustment on July 8. 1997, refused the application noting that at present, three vehicles can be accommodated on this site, and that this application may set a precedent for other properties in the neighbourhood.

The owner of the property has appealed the Committee's decision. The Ontario Municipal Board has not scheduled a hearing to date.

Comments:

The Development Services Department has no objection to the minor variance applications for 106Gloucester Grove and 28 Guestville Avenue, and therefore, there is no need to attend the Municipal Board Hearings to be scheduled for these applications.

In regard to the minor variance application for 573 Blackthorn Avenue, the Department recommended refusal of the application because of the opportunity to provide additional parking in the rear yard and because the application would not meet the intent of Zoning By-law No.1-83. The By-law provisions allow for front yard parking where a minimum of one parking space for each dwelling unit is not provided on the lot in a garage, side yard or rear yard and where such parking space is accessed by a driveway greater than 2.4 metres in width. In light of the Department's recommendation and rationale, staff should be directed to attend the Ontario Municipal Board to recommend refusal of the minor variance application to permit a front yard parking space.

Conclusions:

It is recommended that the appropriate staff be directed to attend the Ontario Municipal Board for 573 Blackthorn Avenue to recommend refusal of the application once a hearing date is determined. It is further recommended that the information presented in this report regarding the appeal of the Committee of Adjustment applications for 106 Gloucester Grove and 28 Guestville Avenue be received.

Removal of Parking Meters on Times Road,

North of Eglinton Avenue West

(City Council on February 4, 5 and 6, 1998, adopted this Clause, without amendment.)

The York Community Council recommends adoption of the following report (December 16, 1997) from the Commissioner of Operations Services:

Purpose:

To advise City Council of the results of a review respecting a request to remove the parking meters on Times Road, just north of Eglinton Avenue West.

Source of Funds:

None required.

Recommendation:

It is recommend that on-street metered parking on the east side of Times Road between the Municipal Lane and Livingstone Avenue not be removed.

Council Reference/Background/History:

Clause No. 37.20, Report No. 5, Works and Parks Committee meeting on December 16, 1997.

Comments:

The Works and Parks Committee at its meeting held on February 26, 1996, received a request to consider removing the on-street parking meters on Times Road between the Municipal Lane and Livingstone Avenue and passed the following motion:

That the acting General Manager of the Parking Authority be instructed to report on the request for removal of parking meters on Times Road just north of Eglinton Avenue West.

Times Road is a local roadway between Eglinton Avenue West and Hopewell Avenue, traversing in a north/south direction. The street is currently by-lawed and signed in a one-way southbound direction.

Parking Authority, in the early part of 1990, installed a total of three (3) on-street parking meters on the east side of Times Road between the Municipal Lane and Livingstone Avenue to control and regulate illegal long-term parking. This parking currently serves the business community along Eglinton Avenue West, as well as the three municipally addressed businesses located on the west side of Times Road, immediately north of Eglinton Avenue West.

A recent review of this matter reveals in fact that the parking meters are serving this very purpose to provide additional short-term parking for customers within the area. In fact a revenue audit of monies received from these three parking meters reveals a total of $ 2,258.05 over a one-year period.

Obviously the on-street parking is beneficial to the business community along Eglinton Avenue West and those businesses municipally addressed on Times Road.

As Committee is aware, this area was identified as experiencing current parking capacity problems, within York Eglinton B.I.A. Parking Study. As part of the parking study, a personal interview was undertaken to access parking characteristics, which concluded 96 percent of the parking demand is for short-term parking, that being two hours or less in duration.

Committee may wish to request that the Director of Council Services and City Clerk poll the municipally addressed properties fronting, as well as flanking Times Road between Eglinton Avenue West and Livingstone Avenue to determine support for removing on-street parking on the east side of Times Road between the Municipal Lane and Livingstone Avenue.

Conclusion:

On-street parking on the east side of Times Road between the Municipal Lane and Livingstone Avenue is providing a benefit to the surrounding business community, wherein its removal would only add to the existing parking capacity problems. Based on this we do not support, nor recommend its removal.

Installation of Disabled Parking at 16 Hertford Avenue

(City Council on February 4, 5 and 6, 1998, adopted this Clause, without amendment.)

The York Community Council recommends adoption of the following report (December 10, 1997) from the Commissioner of Operations Services:

Purpose:

To provide information regarding a request for a disabled parking space in front of 16 Hertford Avenue to permit Mrs. Evelino Vieira to park in front of her home, which request was supported by a disabled parking permit issued by the Province of Ontario.

Source of Funds:

Traffic budget.

Recommendations:

It is recommended that:

(1) the Uniform Traffic By-law Nos. 196-84 and 2958-94 be amended to establish a designated disabled parking space on the north side of Hertford Avenue, directly in front of municipally addressed residence 16 Hertford Avenue;

(2) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto; and

(3) that Mrs. Evelino Vieira receive a copy of this report.

Council Reference/Background/History:

Memorandum (December 9, 1997) from Councillor B. Rowland on behalf of Mrs. Vieira to install a disabled parking space in front of her residence.

Comments:

Mrs. Evelino Vieira, 16 Hertford Avenue, through Councillor Barry Rowland is requesting the feasibility of establishing a designated disabled parking space in front of her residence.

Hertford Avenue is a local roadway extending between Bicknell Avenue and its westerly terminus. The street traverses in an east/westerly direction, providing two-way vehicular traffic flow.

The property municipally addressed as 16 Hertford Avenue is located on the north side of the street. On-street parking is presently permitted exclusively on the north side of the street. The current parking regulation is a signed maximum one-hour limit, between the hours 8:00 a.m. to 7:00p.m., and a maximum unsigned three-hour limit for all other times.

Mrs. Evelino Vieira is requesting a designated disabled parking space be established directly in front of her residence, where parking is presently permitted.

As Committee is aware, any person currently possessing a valid provincial permit bearing the international symbol of access is exempt from the following Metropolitan Toronto on-street traffic regulations:

(1) payment to engage a parking meter;

(2) "No Parking" for a period longer than 3 hours;

(3) "No Parking" restrictions, other than rush hour prohibitions,

i.e., 7:00 to 9:00 a.m. or 4:00 to 6:00 p.m.; and

(4) signed maximum parking duration regulations, i.e. 1 hour.

Mrs. E. Vieira does possess a valid Province of Ontario Disabled Parking Permit #112414, expiring in July, 2001.

Committee may wish to only advise Mrs. E. Vieira that her Province of Ontario Disabled Parking Permit entitles her to legally park on either side of Hertford Avenue, rather than establishing a designated disabled parking space, directly in front of her residence.

Conclusion:

Based on this information, Mrs. E. Vieira could legally park on the south side of Hertford Avenue, where on-street parking is presently prohibited, which would result in an impediment to the safe two-way vehicular traffic flow on the street.

We are more inclined to recommend prohibiting parking on the north side of Hertford Avenue, where on-street parking is legally permitted, directly in front of Mrs. E. Vieira's residence, located at 16Hertford Avenue. This would enable Mrs. E. Vieira to park in the prohibited disabled parking area by virtue of her provincial permit, without disrupting traffic flow on the street.

It is, therefore, recommended that a designated disabled parking space be established, directly in front of 16 Hertford Avenue.

Revitalisation of the Black Creek Business Area

(City Council on February 4, 5 and 6, 1998, adopted this Clause, without amendment.)

The York Community Council recommends that the arrangement between the Black Creek Business Area Association and the City of Toronto be continued, regarding initiatives to rejuvenate the Black Creek Business Area through the creation of the Black Creek Business Association.

The York Community Council submits the following communication (January 13, 1998) from the Vice-Chair, Black Creek Business Area Association:

On behalf of all the stakeholders and members of the Black Creek Business Area Association, we wish to congratulate you on your nomination to Chair the York Community Council.

At this time, we are requesting Council to continue the mandate initiated by the former Council of the City of York, to rejuvenate the Black Creek Business Area through the creation of the Black Creek Business Association. This partnership between the former Cities of York and North York, local business and property owner, area residents, and other interested participants, is a vital tool in the proposed economic redevelopment structure for the new City of Toronto.

We are seeking the continued staff and resource support from the York Community Council and staff which has allowed the Black Creek Business Area to achieve the successes we have experienced during our three years of existence.

We wish you success in your new position and look forward to working with you in the future.

(a) Community Council Briefings.

The York Community Council reports having received and noted information provided in slide presentations by the following senior staff respecting the roles, responsibilities and authority of the Council:

(ii) directed the City Clerk to prepare and distribute a public information package outlining the role, responsibilities and authority of Community Councils, including relevant sections of the Procedural By-law, and inviting the public to attend the next meeting to make suggestions in this regard, and on capital and operating budget expenditures; and

(iii) requested a representative from the committee chaired by Councillor DavidMiller to attend the next meeting, scheduled to be held on February 18, 1998, to hear public suggestions.

Mr. Gord Garland appeared before the York Community Council and made submissions with respect to strengthening the role of Community Councils and citizen participation:

(b) Proposal for Traffic Calming Measures on Greenbrook Drive,

York Eglinton, Ward 27.

The York Community Council reports having:

(i) confirmed its interest in continuing to construct further traffic calming measures (pinch points) on Greenbrook Drive in accordance with the poll results by a majority of residents on the street, referred to in the following communication;

(ii) requested the Acting Executive Commissioner of Emergency and Protective Services to submit a report detailing cost estimates to the Budget Committee for its consideration;

(iii) authorized the City Solicitor to submit to City Council a by-law to alter the Greenbrook Drive road allowance, subject to the Budget Committee approving the necessary funds; and

(iv) directed the City Clerk to provide Notice of the road alteration in accordance with The Municipal Act:

(January 5, 1998) from the Clerk's Department advising of the results of a poll conducted on Greenbrook Drive to determine majority interest with respect to the continuation of traffic control measures.

(c) Sign on Public Property at Eglinton Avenue West

and Guestville Avenue.

The York Community Council reports having referred the following matter to Mr.Bruce Ashton of the Sign By-law Review Committee, to arrange a meeting with Dr. Wolfs, Councillor Nunziata, and the Acting Executive Commissioner of Emergency and Protective Services, to address safety concerns, including visibility obstruction and any other pertinent issues, and to submit a report back to the Community Council with an illustration of the proposed signage:

(January 9, 1998) from the Zoning Administrator submitting for consideration a request from the Mount Dennis Health Services respecting a proposal to place a sign on City of Toronto property and road allowance for advertising purposes, and advising that this proposal is not a permitted use.

(d) Application for Site Plan Control Approval - 2213 Dufferin Street.

The York Community Council reports having received the following communication:

(December 16, 1997) from the Commissioner of Development Services to Thomas E. Brown Architect Inc. advising that the subject application will be forwarded to the next regular meeting of the Land Use Committee for information, and that staff will review the application and plans and submit a report to the Land Use Committee for consideration and subsequently to Council for adoption.

(e) Application for Site Plan Control Approval - 36 King Street.

The York Community Council reports having deferred consideration of the following communication to the next meeting of the Community Council, scheduled to be held on February 18, 1998:

(h) Zoning By-law Amendment for 723 and 725 Jane Street

The York Community Council reports having received the following communication:

(November 20, 1997) from the Clerk's Department embodied in Clause No. 104 of Report No. 17 of the Land Use Committee adopted by the Council of the City of York on December9, 1997, recommending that:

(1) the new City Clerk be authorized to provide notification for a Planning Act Public Meeting at the earliest possible date.

(2) the application and the draft Zoning By-law (Schedule 1), worded to the satisfaction of the City Solicitor, be considered for approval, subject to holding a Planning Act Public Meeting and submission of a supplementary report addressing any issues arising from the Public Meeting and written submissions.

(3) the Owner enter into a Development Agreement with the City prior to the enactment of the Zoning Bylaw.

(i) Request for Stop Sign at Haverson Boulevard and Donald Avenue.

The York Community Council reports having deferred consideration of the following report to its next meeting scheduled to be held on February 18, 1998:

(December 11, 1997) from the Commissioner of Operations Services recommending that an all-way stop control not be installed at the intersection of Haverson Boulevard and DonaldAvenue, as the results of a recent traffic study have indicated that an all-way stop control is not warranted.

(j) Request for Parking Prohibition on Avalon Avenue.

The York Community Council reports having authorized the action in the following report:

(December 5, 1997) from the Commissioner of Operations Services recommending that the local Councillors hold a public meeting with the residents of Avalon Road, including the principal of Roseland Junior Public School, to determine support for the implementation of a parking prohibition on the west side of Avalon Road between Bexley Crescent and the northerly terminus of the street.

(k) Request for Alternate Parking on Silverthorn Avenue

or a Portion Thereof.

The York Community Council reports having deferred the following report to the next meeting of the Community Council scheduled to be held on February 18, 1998, to enable Councillor Nunziata to invite area residents to make deputations on this matter:

(December 16, 1997) from the Commissioner of Operations Services advising on the results of a review undertaken regarding a proposal to reverse the legal on-street parking regulation from the west side to the east side of Silverthorn Avenue between Harlton Crescent and Donald Avenue.

(l) Request to Reverse On-Street Parking from the

North to the South Side of Lambton Avenue

between Cliff Street and Arnold Avenue.

The York Community Council reports having authorized the action in the following report from the Commissioner of Operations Services, and having directed this matter to the Acting Executive Commissioner of Emergency and Protective Services, to undertake the poll and to also include a question on majority interest for alternate side parking:

(December 23, 1997) from the Commissioner of Operations Services advising that on street parking is feasible on either side of Lambton Avenue between Cliff Street and ArnoldAvenue, and recommending that the Clerk's Department poll the residents of Lambton Avenue between Cliff Street and Arnold Avenue to determine majority interest in reversing on-street parking from the north to the south side of the street; and that Mr.John Niemeyer receive a copy of the poll results.

(m) Request for Lane Lighting at the Rear of

316-326 Oakwood Avenue.

The York Community Council reports having received the following communication:

(December 29, 1997) from the Manager of Engineering, York Hydro, forwarding a copy of their letter (December 4, 1997) to Councillor Joe Mihevc, wherein they advised that they have incorporated the installation of 1 - New 70 W High Pressure Sodium luminaire at the rear of 326 Oakwood Avenue (adjacent to O'Leary Avenue) facing the laneway, as part of the 1997City Lane/Street Lighting Approved Program, scheduled for in service this month; and that their file notes suggest a possible additional pole/luminaire half way down the laneway towards Earlsdale Avenue (rear of 318/320 Oakwood Avenue) would inhibit parking.

(n) Request for Section of Cedarvale Park to be

Designated an Off-Leash Zone for Dogs.

The York Community Council reports having referred the following communication to the Community and Neighbourhood Services Committee, and that the Medical Officer of Health be requested to report on a City wide policy with respect to this matter:

Clause No. 143 in Report No. 16 of the Works and Parks Committee which was adopted by the Council of the City of York, wherein the Council recommended that the new City of Toronto be requested to develop a uniform policy with respect to leashed and unleashed dogs in city parks; and that the new City Council review all of Cedarvale Park and establish, with community consultation, an unleashed dog area that is larger or different than the one that already exists.

(o) Toronto and Region Conservation Authority.

The York Community Council reports having received the following communication:

(December 22, 1997) from the Chair, Toronto and Region Conservation Authority advising that the new name for the Metropolitan Toronto and Region Conservation Authority effective January 1, 1998 will be the Toronto and Region Conservation Authority.

(p) Proposed Parking Prohibition on the West Side

of Scarlett Road at the Lambton Golf and

Country Club Driveway.

The York Community Council reports having received the following communication:

(December 19, 1997) from the Metropolitan Clerk, forwarding for information and any action deemed necessary, Clause No. 5 embodied in Report No. 21 of The Planning and Transportation Committee, adopted by Metropolitan Council on December 10 and 18, 1997.

(q) Request for Traffic Control Signals on

and Wright Avenue/Wilby Crescent.

(v) Association of Municipalities of Ontario.

The York Community Council reports having received the following communications from the Association of Municipalities of Ontario:

(i) (December 12, 1997) entitled "Province Announces New Funding Arrangement and Savings Targets and Releases Final Numbers";

(ii) (December 18, 1997) entitled "Special Meeting of the Members Called to Formulate Plan of Action for Dealing with the Provincial Government";

(iii) (December 19, 1997) entitled "AMO calls for Release of Background Information relating to Financial Data"; and

(iv) (December 19, 1997) entitled "AMO Requests an Opportunity to Find Solutions to the $500 Million Financial Shortfall".

(w) Bell Canada Telephone Booth Advertising.

The York Community Council reports having:

(1) requested the Urban Environment and Development Committee to defer consideration of the following matter for one month to allow the Commissioner of Development Services (York Civic Centre) to report to the Community Council on any concerns with respect to safety, possible contravention of the Sign By-law, and the impact of such advertising on a City wide basis; and

(2) to allow the members of the York Community Council to debate the issue, prior to making a deputation at the Urban Environment and Development Committee:

(January 13, 1998) from the City Clerk advising of the action taken by the Urban Environment and Development Committee, and inviting members of Community Councils and interested parties to appear before the Committee at its meeting to be held on February 9, 1998.

(x) Televised Cable Coverage of

York Community Council Meetings.

The York Community Council reports having requested the City Clerk to arrange for televised cable coverage of York Community Council meetings in the Council Chamber, 2700 Eglinton Avenue West.

(y) Traffic Safety at Dufferin Street

and Eglinton Avenue West.

The York Community Council reports having approved in principle the following communication, and having referred this matter to the Urban Environment and Development Committee for staff to undertake a traffic study of the area and to report to back to Committee.

(January 19, 1998) from Councillor Rob Davis, York Eglinton, requesting a staff report on:

(i) replacing the yield sign on the southeast corner with a stop sign;

(ii) adding signals "Walk/Don't Walk" to the existing traffic control signals at this intersection; and

(iii) extending the green and red signals to allow seniors more time to cross the intersection.

(z) 1997 Capital Works Projects.

The York Community Council reports having:

(1) forwarded this matter to the Budget Committee with a recommendation that all outstanding 1997 Capital Works Projects, which were approved by the Councils of the former area municipalities but not commenced or completed during 1997, be identified and carried forward; and

(2) requested the Budget Committee to automatically consider these projects as fully funded 1998 Capital expenditures, and to commence funding for any new capital projects from this level of previous commitment.

The City Manager verbally reported to the York Community Council on a number of capital works projects for the Parks Department which had been approved, and which formed part of the City's 1997 Capital Works Projects, but which had not commenced during 1997, and advised the Community Council that these projects had not been identified or included in the Parks Department's wish-list for capital funding during 1998.

(aa) Councillors' Offices at Community Council Locations.

The York Community Council reports having discussed the following communication, and having reached a decision with respect to allocation of office space in the Councillors' area.

(January 15, 1998) from the City Clerk advising of the policy adopted by City Council and forwarding a summary of services to be provided to Council members at each area location.

(bb) Parking Prohibition in Front of 55 Lacey Avenue.

The York Community Council reports having referred the following communication to the Commissioner of Operations Services (York Civic Centre) for further report on either relocating the parking to the west side of Lacey Avenue or on implementing alternate side parking:

(November 28, 1997) from the Commissioner of Operations Services recommending that:

(1) the parking not be restricted on the east side of Lacey Avenue directly in front of 55Lacey Avenue; and

(2) that Mr. Raffaele Papa of 55 Lacey Avenue receive a copy of this report.

Mr. R. Papa appeared before the York Community Council in connection with the foregoing matter.

(Councillor Balkissoon, at the meeting of City Council on February 4, 5 and 6, 1998, declared his interest in Item (w), headed "Bell Canada Telephone Booth Advertising", embodied in the foregoing Clause, in that he is an employee of Bell Canada.)
