Preliminary Evaluation Report

The Scarborough Community Council recommends the adoption of the following report (January 29, 1998) from
the Commissioner of Planning and Buildings, Scarborough, wherein it is recommended that the subject application
be refused:
Purpose:
Fred Schaeffer, on behalf of Green Desk Developments Inc., has submitted rezoning and consent applications to facilitate
the development of two single family lots. The rezoning application proposes to amend the Highland Creek Zoning By-law
by reducing:
- the minimum lot area from 696 mē (7,500 square feet) to 500 mē (5,382 square feet);
- the minimum front yard building setback from 6 metres (20 feet) to 4 metres (13 feet); and
- the minimum rear yard building setback from 7.5 metres (25 feet) to 3 metres (9.8 feet).
Approval of the application would provide for the development of two wide shallow lots.
Recommendation:
It is recommended that Council refuse the rezoning application (Z97049) by Fred Schaeffer, on behalf of Green Desk
Developments Inc. with respect to Block 23, Registered Plan 66M-2276 as approval of this application will prohibit the
opportunity for future development of these lands in conjunction with the abutting lands to the north.
Background:
The lands are located on the north side of Claresholme Drive, west of Meadowvale Road. Amendment No. 988 pending
Ministerial approval designates the lands Low Density Residential providing for single-detached dwellings. The current
zoning for the property permits one single-family dwelling per parcel of land with a minimum of 15 metres (50 feet)
frontage on a public street and a minimum area of 696 mē (7,500 square feet). The land is a vacant remnant parcel from a
registered plan of subdivision registered on May 12, 1994. This parcel was included as a Block within the plan with the
intent that the block would eventually be developed in conjunction with abutting lands to the north as the area of this block
was seen as insufficient to permit the creation of lots that would be consistent with the existing lots in the vicinity as well
as the lots within the proposed plan of subdivision. The subdivision agreement which included these lands notes that the
lands are to be deferred for their future development with the abutting lands to the north. The development of Block 23 in
combination with lands to the north would provide for the creation of four lots consistent in depth and area with existing
lots.
Comments:
The applicant has also submitted an application for consent (B62/97) in conjunction with this application to permit the land
to be severed into two lots. The consent has been appealed to the Ontario Municipal Board on the basis that the
municipality has not made a decision on the application within 60 days of its receipt. The proposed division would result in
the creation of lots having front and rear yard setbacks that are not consistent with existing lots, within both the immediate
neighbourhood and the wider community. For the most part, lots within the Highland Creek Community have a front yard
setback of 6 metres (20 feet) with a minimum rear yard setback of 7.5 metres (25 feet). These setbacks provide separation
for the residents from street activities, together with providing a rear yard amenity area for outside activities.
While the proposed lots have lot areas that are consistent with existing lots in the vicinity, the orientation of the property to
Claresholme Drive will result in the creation of two lots each having a depth of 15.8 metres (52 feet). There are no existing
lots of this depth in the Highland Creek Community. Lots in the vicinity range in depth from 31 metres (103 feet) to 61
metres (200 feet). Lots within the plan of subdivision from which this parcel was a remnant have depths that range from 33
metres (108 feet) to 36 metres (118 feet). Council recently approved an infill development to the west of the subject lands.
The lots within that development range in depth from 30.9 metres (101 feet) to 50 metres (164 feet), providing for the
creation of lots that are consistent and compatible in depth with existing lots in the vicinity.
The development of the subject lands as proposed will prohibit the opportunity for future development in conjunction with
the abutting lands to the north. The depth of this parcel is insufficient to provide for the creation of lots that are consistent
with the existing lots in the community or the abutting plan of subdivision from which this is a remnant parcel.

Minor Variance Appeals

The Scarborough Community Council recommends the adoption of the following report (January 20, 1998) from
the Commissioner of Planning and Buildings, Scarborough, subject to amending Recommendation No. (1) by
striking out the word "not"; so that Recommendation No. (1) shall read as follows:
"(1) Council direct the City Solicitor to attend any Ontario Municipal Board Hearing with respect to Minor
Variance Application A208/97;":
Purpose:
This report seeks direction from Council as to the City Solicitor's role at pending Ontario Municipal Board hearings on
three current minor variance appeals and one consent appeal, as further detailed below.
Recommendations:
It is recommended that:
(1) Council direct the City Solicitor not to attend any Ontario Municipal Board hearing with respect to Minor Variance
Application A208/97;
(2) Council direct the City Solicitor to attend any Ontario Municipal Board hearing with respect to Minor Variance
Application A312/97, in support of the Committee of Adjustment's decision, and further, that the Board be requested to
hear this appeal at the earliest opportunity; and
(3) Council direct the City Solicitor to attend any Ontario Municipal Board hearing with respect to Minor Variance
Application A279/97, in support of the Committee of Adjustment's decision and with respect to Consent Application
B61/97, in support of the Commissioner of Planning and Buildings decision.

The owner has appealed the October 8, 1997 decision of the Committee of Adjustment which refused a minor variance to
permit a reduced parking requirement for restaurants on this site (as detailed in the attached decision). Approval of the
variance would have permitted approximately 192 square metres (2,066 square feet) of additional restaurant space, for a
total of 1 200 square metres (13,000 square feet) of restaurant uses on this site, with no increase in the current 196 space
on-site parking supply. The appeal does not raise issues of sufficient significance to the Corporation to warrant expenditure
of the City's limited resources on the Board hearing.

On December 17, 1997, the Committee of Adjustment approved a minor variance application to recognize building
setbacks of an existing structure on the former City of Scarborough Upton Road Works Yard (as detailed in the attached
decision). The abutting westerly owner of 40 Upton Road, Paisley Products of Canada Inc., has now appealed that decision.
The closest Paisley building is approximately 38 metres (125 feet) away from the subject structure.
Final approval of this variance is one of the last conditions to be met to conclude an agreement of purchase and sale of the
subject lands by the City to D.A. Stuart Inc., 43 Upton Road. The sale was authorized by the former Scarborough City
Council on November 12, 1996 (reference Clause No. 6 of Report No. 26 of The Administrative Committee), and the
agreement was entered into on September 30, 1997. Time is now of the essence and in order to conclude this important
transaction, I am recommending that the City Solicitor be directed to attend the Board in support of the Committee's
decision, and further, to request that the Board assign the earliest possible hearing date to this matter.
3. Minor Variance Application A279/97

The owners have appealed the December 17, 1997 decision of the Committee of Adjustment which refused a minor
variance to permit approximately 25 percent reductions in required minimum lot frontage and area (as detailed in the
attached decision and staff report) and the December 31, 1997 decision of the Commissioner of Planning and Buildings to
refuse a consent application to create two residential lots to enable construction of a new single family dwelling on each.
Letters and a petition objecting to the proposal, representing over 100 residents in the area, were also considered by the
Committee.
As indicated in the staff opinion, the Committee decision, the staff report and the Commissioner's decision, approval of
these applications would result in uncertainty about similar proposals and erosion in the stability of what is a unique,
established, large lot neighbourhood. As the proposal does not meet the intent and purpose of either the Official Plan or
Zoning By-law, and would not be desirable for the appropriate development of the land, I am recommending that the City
Solicitor attend the Board in support of both the Committee's decision and the decision of the Commissioner of Planning
and Buildings.

Draft Plan of Condominium Application C97015

The Scarborough Community Council recommends the adoption of the following report (January 30, 1998) from
the Commissioner of Planning and Buildings, Scarborough:
Purpose:
The application is for Draft Plan of Condominium approval for a 178-unit, 16 storey residential apartment building and
seven multiple family dwellings nearing completion on the north side of Bonis Avenue, west of Kennedy Road (See
Figures 1 and 2). A total of 312 parking spaces will be provided including 16 visitor parking spaces. An additional 85
surface and underground visitor spaces are available to the immediate east of the apartment building in the visitor parking
lot of the existing Phase I Greens at Tam O'Shanter development at 168 Bonis Avenue (See Figure 3). The resident and
visitor parking provided meets the minimum By-law parking requirement. The Condominium Description and Declaration
for the Phase I development contains provisions with respect to shared visitor parking, recreation facilities, and necessary
easements in favour of the apartment building currently under construction.
All technical agencies circulated had no comments or their requirements have been incorporated into the recommendations.
There are no concerns under the current High Density Residential provisions of the Official Plan raised by this application,
and the development complies with the 'Apartment Residential' (A) and 'Multiple-Family Residential' (M) zoning
requirements of the Tam O'Shanter Community By-law. The development is being constructed in accordance with the Site
Plan Control approval granted in November 1996, and represents the fourth phase of a five phase residential development
on the north side of Bonis Avenue (See Figure 3).
Recommendations:
It is recommended that Draft Plan of Condominium C97015 for The Greens at Tam O'Shanter Inc., with respect to 138
Bonis Avenue, being Part of Block 1, Registered Plan M-2255, be approved subject to the following conditions:
(1) plans as stamped "Recommended" this date (Figure 2);
(2) the owner to sign the City's Standard Tax Agreement for payment of taxes and local improvement charges;
(3) the owner shall be responsible for distributing "Condominium" brochures supplied by the Works and Environment
Department;
(4) the owner to make satisfactory arrangements with the Public Utilities Commission with regards to water and electrical
servicing, their acceptable completion, including any agreements and/or easements that may be required;
(5) the owner to complete all conditions of the Site Plan approval prior to registration, or enter into a development
agreement with the City, secured by a performance guarantee in a form and amount satisfactory to the City Solicitor, to
guarantee completion of the site work if the owner chooses to register the condominium prior to completion of the project;
and
(6) prior to registration, the owner shall submit the final Condominium Description and Declaration for the approval of the
Commissioner of Planning and Buildings with respect to all easements and rights-of-way to ensure mutual access between
the apartment building and multiple family dwellings and 168 Bonis Avenue (Condominium Number 1027) for vehicular
and pedestrian movements, visitor parking and servicing.

Removing a Portion of the Twelve Hour Parking Restriction

Queen Street - Scarborough Bluffs

The Scarborough Community Council recommends the adoption of the following report (January 23, 1998) from
the Director, Road and Traffic Services, Scarborough, subject to adding thereto the following new
Recommendation No. (4) and renumbering the remaining recommendation accordingly:
"(4) a No Stopping 7:00 a.m. to 6:00 p.m. sign be installed on the north side of Queen Street in front of 2378
(Estonian apartment building) and 2780 Queen Street (private residence) to allow for solid waste pick-up from these
two addresses;":
Purpose:
To remove a section of previously installed 12 hour parking on Queen Street near Victoria Park Avenue and to install a 40
kilometre per hour speed limit.
Funding Sources:
The $400.00 (approximate) funds associated with the removal of the parking prohibition signs are available in the Road and
Traffic Services 1998 Budget Account Number 20000-70200-72260.
The $600.00 (approximate) funds associated with the installation of the 40 kilometre per hour speed limit signs are
available in the Road and Traffic Services 1998 Budget Account Number 20000-70200-72240.
Recommendations:
It is recommended that:
(1) the current parking regulations identified in Appendix 1 of this report be rescinded;
(2) the parking regulations identified in Appendix 2 of this report be adopted;
(3) the 40 kilometre per hour speed limit identified in Appendix 3 of this report be adopted; and
(4) the appropriate by-laws be amended accordingly.
Background:
The existing 12 hour parking limit was installed on Queen Street as part of the traffic calming initiatives in the East
Beaches area. By allowing long duration parking on both sides of the road we would narrow the effective width of the road
while providing additional on-street parking for area residents. A 50 kilometre per hour speed limit exists on the section of
Queen Street East of the former west limit of the City of Scarborough while it is 40 kilometres per hour in the former City
of Toronto.
Discussion:
Parking:
The 12 hour limit that was posted on both sides of Queen Street between Victoria Park Avenue and Blantyre Avenue did
result in cars parked on both sides of this section of Queen Street. This resulted in motorists having to slow down to pass
each other through this area, which was the intention. However, with the snow on the road, some motorists are not able to
pull as close to the curb as they normally would; therefore, further reducing the effective road width. This situation has
resulted in safety concerns being expressed to staff by residents in the area.
Another concern of the management of the Estonia House Apartment at 2368 Queen Street, as well as Solid Waste
Division staff, is that the long duration parking in front of this apartment hampers access to the curb side pick-up of solid
waste on the north side of Queen Street, west of Victoria Park Avenue.
In the short term, the 12 hour parking limit signs have been removed in this area to try to alleviate these two situations;
however, replacing the 12 hour limit with No Parking Anytime prohibitions in these two areas would alleviate the
problems. In front of the Estonia House Apartment we are recommending that a section of the 12 hour parking limit zone
be retained to maintain the original traffic calming initiatives, as well as provide some overnight parking for approximately
three vehicles. This should not hamper the pick-up of solid waste at this location.
40 Kilometre Per Hour Speed Limit:
The section of Queen Street in the former City of Toronto, as well as all roads intersecting Queen Street in the former City
of Scarborough, all contain 40 kilometre per hour speed limits. As such, to install a 40 kilometre speed limit on this
remaining section of Queen Street would create area uniformity and complement our traffic calming measures.
Conclusions:
In an effort to improve safety and solid waste pick-up, we recommend that No Parking Anytime prohibitions be installed on
the north side of Queen Street, west of Victoria Park Avenue. On the south side, between Victoria Park Avenue and
Blantyre Avenue, we recommend the No Parking Anytime prohibition in order to increase the effective road width. For
area uniformity and to assist our traffic calming program a 40 kilometre per hour speed limit is also recommended on
Queen Street.

The Scarborough Community Council recommends the adoption of the following report (January 23, 1998) from
the Director, Road and Traffic Services, Scarborough:
Purpose:
To remove a previously installed parking prohibition in front of 110 Lakeside Avenue.
Funding Sources:
The funds associated with the removal of the parking prohibition signs are available in the Road and Traffic Services 1998
Budget Account No. 20000-70200-72260.
Recommendations:
It is recommended that:
(1) the current No Parking regulations identified in Appendix 1 of this report be rescinded; and
(2) the appropriate by-law be amended accordingly.
Background:
The existing No Parking Anytime restriction was installed at 110 Lakeside Avenue in 1995 to facilitate a bus picking up a
handicapped child at this property. A representative of the Scarborough Baptist Church, located on the southwest corner of
Kingston Road and Lakeside Avenue, had requested that the parking prohibition in front of 110 Lakeside Avenue be
removed.
Discussion:
The residents of 110 Lakeside Avenue, who originally requested that the handicapped parking space be installed in front of
this property, have since moved. Therefore, the need for this parking prohibition no longer exists.
Conclusions:
Based on this new information, and considering the sole purpose of erecting this no parking restriction was to facilitate
handicapped bus access, we are now recommending that the parking prohibition by-law be rescinded.

To present the information relating to a 40 kilometre per hour speed limit on Claremore Avenue in conformance with the
former Scarborough Council Speed Limit Procedure.
Funding Sources:
The $1000.00 (approximate) funds associated with the installation of the speed limit signs are available in the Road and
Traffic Services 1998 Budget, Account No. 20000-70200-72240.
Recommendations:
It is recommended that:
(1) the 40 kilometre per hour speed limit identified in Appendix 1 of this report be adopted; and
(2) the appropriate by-law be amended accordingly.
Background:
At the request of former Scarborough Councillor Harvey Barron, on behalf of a resident of Claremore Avenue, Road and
Traffic Services staff is presenting this report to enact a 40 kilometre per hour speed limit on Claremore Avenue without
any staff recommendations.
Discussion:
Based on the former Scarborough Council adopted 40 Kilometres Per Hour Speed Limit Procedure, (Appendix 2) speed
study results were not applied to the 40 Kilometre Per Hour Speed Limit Warrant. The adopted procedure allows a
councillor to propose a speed limit of 40 kilometre per hour on any Scarborough road with a pavement width of 9.7 metres
or less.
Conclusions:
Based on the Scarborough Council adopted 40 kilometre per hour Speed Limit Procedure, this report proposes the
installation of a 40 kilometre per hour speed limit on Claremore Avenue.

(3) the appropriate by-laws be amended accordingly.
Background:
With the installation of traffic control signals at the intersection of Pharmacy Avenue and Rosscowan Gate, a 30 metre
corner parking restriction would be installed on both sides of Rosscowan Gate. As a result, there would be a very small 60
minute maximum permitted parking area. As such, staff recommended replacing the 60 minute maximum permitted
parking with a No Parking Anytime prohibition.
Discussion:
At present, parking is prohibited along the entire north side of Rosscowan Gate. The existing parking restrictions on the
south side of the roadway includes a section of No Parking Anytime from Pharmacy Avenue to a point 15 metres further
east, 60 minute maximum permitted parking, and a 15 metre corner parking restriction at the intersection of Rosscowan
Crescent.
With the introduction of the 30 metre corner parking restriction at Pharmacy Avenue and Rosscowan Gate, this will
eliminate all but one or two legal parking spaces on the roadway. Therefore, in an effort to reduce confusion we
recommended to the former area Councillor the prohibition of parking on both sides of Rosscowan Gate from Pharmacy
Avenue to Rosscowan Crescent. This will also assist in creating an unrestricted traffic flow on approach to the traffic
signals.
Discussions with the former Councillor revealed no objections to the restriction of parking on both sides of Rosscowan
Gate. However, based on the concern of one of the area residents, we also support the request for the installation of a stop
sign on Rosscowan Gate at Rosscowan Crescent to clearly define the right-of-way and stop motorists in advance of the
existing sidewalks.
Conclusions:
We recommend restricting parking on both sides of Rosscowan Gate and installing a stop sign on Rosscowan Gate at
Rosscowan Crescent to improve traffic flow and safety.

Background:
Road and Traffic Services was requested by Councillor Berardinetti, to investigate Ranstone Gardens for a 40 kilometre per
hour speed limit due to speeding on this roadway.
Discussion:
Ranstone Gardens provides access to both Kennedy Road and Birchmount Road, south of Lawrence Avenue, and functions
as a residential collector roadway. An all-way stop control exists at the intersection of Ranstone Gardens and Yorkshire
Road and traffic control signals were recently installed at Kennedy Road and Ranstone Gardens.
40 Kilometre Per Hour Speed Limit Warrant:
The justification for the introduction of a 40 kilometre per hour speed limit on a roadway in the former City of Scarborough
is based on a technical warrant established by Road and Traffic Services, and adopted by the former Scarborough Council.
Ranstone Gardens meets the necessary requirements for a 40 kilometre per hour speed limit on this roadway based on the
following criteria:
- traffic volume
- safe speed on curve
- pavement width
- minimum distance between controls
- horizontal control curve

Automatic 24-hour speed studies conducted on Thursday, October 2, 1997 on Ranstone Gardens are summarized as

Collision History:
A review of the collision history on Ranstone Gardens reveals six reported collisions over the past three years, January 1,
1994 to December 31, 1996. Three collisions occurred in 1996 and three in 1994. None of these collisions was the result of
speeding.
Conclusions:
Based on the fulfilment of the 40 Kilometre Per Hour Speed Limit Warrant, a reduced speed limit is recommended on
Ranstone Gardens. As Yorkshire Road acts as a logical extension of this 40 kilometre per hour speed limit, it is also
recommended on this road.

Background:
Road and Traffic Services received a request from a Metro Police Officer to slightly adjust a parking prohibition sign on
the west side of Eppleworth Road, in front of The Reorganized Church of Jesus Christ of Latter Day Saints.
Discussion:
The current No Parking Anytime prohibition extends through the turning basin at the north end of Eppleworth Road. The
concern is that the walkway to the church is not accessible for parishioners arriving on the church bus or handicapped
pedestrians. By relocating the No Parking Anytime sign an additional five metres to the south, we would make this
walkway more accessible for receiving and discharging passengers. This prohibition will eliminate only one on-street
parking space.
Conclusions:
To assist the church in loading and unloading passengers at the front walkway, we are recommending that the existing No
Parking Anytime restriction be extended by five metres.

Services investigated the need for a stop sign southbound on Griselda Crescent at Pegasus Trail, west intersection.
Discussion:
The west intersection of Griselda Crescent and Pegasus Trail is located in the community to the northwest of Ellesmere
Road and Scarborough Golf Club Road. Griselda Crescent is a minor local road while Pegasus Trail is a residential
collector road.
Staff have conducted traffic investigations and determined that a stop sign would be beneficial at this intersection. This stop
sign would clearly define the right-of-way and stop motorists behind the sidewalk that exists on the north side of Pegasus
Trail crossing Griselda Crescent. The installation of this stop sign will not require the trimming or removal of any trees in
the area of the sign, as would be the case with other intersections in the area.
Conclusions:
The installation of a stop sign on Griselda Crescent at Pegasus Trail, west intersection, will improve traffic operation at the
intersection and have little impact on boulevard landscaping.

Background:
Road and Traffic Services received a request from an employee at Altamont Nursing Home, 92 Island Road to restrict
parking on Island Road in front of the nursing home. The specific complaint is with regard to the sight line problems
created for motorists exiting from the nursing home's driveway when vehicles are parked on the north side of the road. This
parking is especially prevalent when the Black Dog Pub, located on the southwest corner of East Avenue and Island Road,
is busy. Currently, stopping is restricted on the north side of the road from East Avenue to 60 metres west of East Avenue.
Discussion:
Parking does not appear to be a problem during the day in front of 92 Island Road. However, our investigation has
determined that in the evening, especially on weekends, on-street parking is much more prevalent. As such, we could
foresee that parking in this area would restrict sight lines for motorists exiting from the driveway of this property.
Conclusions:
We recommend restricting parking in front of the nursing home at 92 Island Road to improve the sight lines at the
driveway.

Background:
At the request of former City of Scarborough Councillor David Soknacki, on behalf of an area resident, Road and Traffic
Services investigated concerns of speeding on Highcastle Road and the need for an all-way stop control at the north
intersection of Highcastle Road and Oakmeadow Boulevard.
Discussion:
Highcastle Road and Oakmeadow Boulevard are residential collector roads located north of Ellesmere Road and west of
Neilson Road. A 40 kilometre per hour speed limit is posted on both of these roads. St. Edmund Campion School is located
on Highcastle Road and a pedestrian crossover assists pedestrians crossing Highcastle Road at the south intersection of
Oakmeadow Boulevard. Turn restrictions were installed in October 1996 to prevent motorists from cutting through the
community, eastbound during the a.m. and westbound during the p.m. peak weekday periods.
Speed Studies:
Automatic 24-hour speed studies conducted on Highcastle Road at two locations over a six-day period revealed a reduction
in the volume of traffic and excessive speeders on this road compared to our 1995 study. A sample of this count, in
comparison with a previous study, is as follows:

We must highlight that these recorded 24-hour vehicle volumes verify that Highcastle Road is functioning well within the
traffic parameters of a residential collector road, 1500 to 3500 vehicles per day. These volumes have also decreased by
approximately 700 vehicles per week day following the installation of the aforementioned turn restrictions. Therefore, the
motorists now travelling at excessive speeds on this road would likely be area residents.
In addition, these speed studies confirm that Highcastle Road is similar to many other residential collector roads.
Specifically, a small percentage of motorists elect to drive at an excessive speed in total disregard for public safety.
Police Speed Enforcement Results:
The Toronto Police Service has indicated that between August 19, 1997 and September 16, 1997, over approximately two
hours, five tickets were issued on Highcastle Road. The officers have indicated that this is not a location that they would
regularly visit without specific direction to do so. We have requested that the speed enforcement continue on Highcastle
Road, however, only limited enforcement can realistically be expected considering our study results.
All-Way Stop Control:
The justification for the installation of an all-way stop control is based on a technical warrant established by the Ministry of
Transportation of Ontario (MTO), and adopted as the City Policy by the former Scarborough Council.
A traffic study conducted on Tuesday, September 16, 1997 at the north intersection of Highcastle Road and Oakmeadow
Boulevard produced the following results which illustrate that the Warrant's vehicle volume requirements are not
completely satisfied:

This intersection is controlled by stop signs on Oakmeadow Boulevard and, on account of this, Oakmeadow Boulevard is
assumed to be the minor road. However, our latest traffic studies revealed that the heaviest approach vehicular movement is
on Oakmeadow Boulevard. As a result of this unique situation, during both study periods, investigation staff observed
incidents of confusion due to the treatment of this intersection as an all-way stop control by some motorists on Highcastle
Road.
One solution would be to reverse the stop signs and stop traffic on Highcastle Road. However, as the community has
become accustomed to the current stop sign positions, we doubt that this measure would be supported.
Therefore, although the vehicle volume requirements are not completely achieved, to eliminate any confusion among
motorists, the introduction of an all-way stop control at this intersection is recommended.
Collision History:
A review of the collision history on Highcastle Road reveals no problems relating to motorists speeding on this road. A

Conclusions:
In summary, our traffic studies reveal that an all-way stop would improve traffic movements at the north intersection of
Highcastle Road and Oakmeadow Boulevard. In addition, our speed study also reveals that some excessive speeding is
occurring on Highcastle Road. Therefore, we have requested continued selective police enforcement of the 40 kilometre per
hour speed limit.

Scarborough Community Complex - Project Status Report

Purpose:
To provide a report on the status of the Scarborough Community Complex project.
Funding Sources:
Funding for this project has been previously approved by the Council of the City of Scarborough and is available in
Account No. 59309-00000-96541-OBJ.
Recommendation:
It is recommended that appropriate staff be authorized to approve and execute an operating agreement with the Chinese
Cultural Centre of Greater Toronto.
Background:
Scarborough Community Council, at its meeting held on Wednesday, January 21, 1998, directed that the Commissioner of
Works and Environment report on the items raised during his briefing to the Community Council on the Scarborough
Theatre/Art Gallery.
Discussion:
(1) Project History and Description
Approval to proceed with the design and construction of the project was given by the Council of the City of Scarborough at
its meeting on January 23, 1996.
The project is located at the south-east corner of Sheppard Avenue East and Progress Avenue, Scarborough. It was initiated
as an agreement between the City of Scarborough, the Chinese Cultural Centre of Greater Toronto (CCC) and CMS
Investments Inc., now Metrus. A site plan of the project is attached to this report as Appendix 'A'.
The project budget was approved at $7.9 million and includes the following components:
(a) a Community Centre/Library building of 12,060 square feet and 7,350 square feet respectively;
(b) site development and parking;
(c) a new park development on the balance of the 8.24 acre property; and
(d) funds in the amount of $280,000.00 for the future formal Chinese Garden.
The CCC funded, and is simultaneously constructing, an adjoining Chinese Cultural Centre of 23,140 square feet at a
budget of approximately $5.2 million.
The agreement between the City and the CCC provides that the City will provide HVAC plant, shared parking, shared site
development and 1.057 acres of land for their building. The land is to be transferred at the time of substantial performance
of the project.
Future phases include a one and one-half acre formal Chinese Garden and a 600 seat theatre. The garden is planned to be
built in phases. The first phase is contemplated to cost $5 million with a total build-out cost of $13 million. The design
work is proceeding on the formal Chinese Garden under the direction of the Planning and Buildings Department.
Construction funding is to be provided through fundraising, currently expected to commence in the spring. Since
construction will be coordinated with funds received from the fundraising effort, a start date for the work is not yet
available. The theatre is also planned to be funded and to be constructed by the CCC in the future.
Adjacent to the park site is a vacant property owned by the Metropolitan Separate School Board (MSSB). Future plans
include a shared entrance and contemplate a shared parking arrangement. A Memorandum of Understanding has been
executed between the MSSB and the City.
(2) Schedule and Budget Status
The Burrows Hall Recreation Centre and Library building, the CCC building and related sitework are on schedule at 80
percent complete and scheduled for completion in April 1998.
The park is complete except for walkway lighting.
Funding in the amount of $7.9 million has been approved for this project. Our latest review indicates that the Burrows
Hall Recreation Centre and Library/sitework portions of the project should be completed $300,000.00 below budget. The
park and the Garden items are within budget.
(3) Outstanding Issues
(a) There are two issues with regard to the CCC which are currently underway:
(i) completing legal surveys and easements to transfer the 1.057 acres of property from the City to the CCC; and.
(ii) completing and executing the operating agreement for the shared HVAC system and site areas.
The agreement between the City and the CCC authorizes the transfer of the CCC site to the CCC on substantial completion
of the project, subject to completion of the legal documentation. The operating agreement, however, does require further
approvals.
(b) The Burrows Hall Recreation Centre and Library building and site will be ready to be handed over to the Parks and
Recreation Department and Library Board in April 1998 for them to operate.
The Toronto Public Library Board is currently reviewing operations to operate the new Library as of September 1998.
The Parks and Recreation Department is reviewing operating scenarios to open the new Community Centre as of May
1998.
Conclusions:
This capital project is being completed on schedule and under budget.

Rouge Park Alliance

Purpose:
This report responds to Community Council's request that the former Acting City Manager report to the next meeting of
Community Council with respect to Rouge Park Alliance matters raised in his briefing on January 21, 1998.
Funding Sources, Financial Implications and Impact Statement:
There are no financial or funding implications from matters raised in this report.
Recommendations:
It is recommended that the draft Partnership Memorandum sent by Rouge Park Alliance staff be referred to Virginia West,
Commissioner, Urban Planning and Development Services, for a report after provincial Cabinet recommends the new
Rouge Park structure.
Background:
Rouge Park was created in 1994 by the Province of Ontario. In 1995, David Crombie prepared an organization structure
and funding report recommending that Rouge Park be created as a partnership park managed by a Board of Directors made
up of federal, provincial and municipal agencies and one non-governmental group, Save the Rouge Valley System Inc.
(SRVS). The Board of Directors has subsequently called itself, the Rouge Park Alliance.
Provincial Cabinet endorsed Mr. Crombie's report to create the Rouge Park Alliance but only for a period of three years to
allow time to get the partnership working. Last fall, the Rouge Park Alliance recommended a new structure and submitted
its preferred option for Cabinet approval. It is expected that Cabinet will deal with this matter in March. The three year
partnership comes to an end on March 31, 1998.
Discussion:
In January 1998, Rouge Park Alliance staff wrote to the Toronto Clerk requesting appointments to the Rouge Park
Alliance. The letter was referred to the Mayor's office to consider who will be appointed to represent Toronto. Last year the
Rouge Park Alliance partner representatives have been:
MTRCA Member - Councillor Raymond Cho, alternate Mr. Brian Denny
Metro Toronto Member - Councillor Dick O'Brien, alternate Mr. Ray Biggart
Scarborough Member - Mayor Frank Faubert, alternate Councillor Edith Montgomery
Metro Zoo Member - Mr. Calvin White, alternate Ms. Susan Gunton
In the interim, Councillor Frank Faubert /alternate Edith Montgomery and Councillor Dick O'Brien/ alternate Raymond
Biggart continue to attend the Rouge Park Alliance meetings on behalf of the City of Toronto and Councillor Raymond
Cho/alternate Mr. Brian Denny will continue on behalf of TRCA until there are the new appointments. Metro Zoo recently
appointed Councillor Doug Mahood/alternate Mr. Cal White.
Rouge Park staff also wrote to the Scarborough and Metro Toronto Clerks in December 1997 requesting staff to review a
draft 'partnership memorandum'. This document was prepared to clarify the role of Rouge Park partners on 'implementing
the Rouge Park Management Plan through the land development process'. Rouge Park was not staffed to comment on
planning applications so the memorandum was drafted to clarify who will comment on planning applications on behalf of
the Park. The Planning and Land Use Subcommittee of the Rouge Park Alliance concluded that as this is a partnership
park, each municipal partner together with the Toronto and Region Conservation Authority have a role to ensure that
comments on applications will implement the Rouge Park Management Plan. The Partnership memorandum was created to
confirm this process.
Conclusion:
We suggest that this matter also be referred to Virginia West, Commissioner, Urban Planning and Development Services
for consideration. The Rouge Park Alliance mandate will be considered by Cabinet by the end of March 1998. Once it is
clear how Rouge Park will operate in the future, it will be clearer whether the draft partnership memorandum is
appropriate.

(2) that the flag of the former City of Scarborough be the flag of the Community of Scarborough.
The Scarborough Community Council reports, for the information of Council, having requested that the City Clerk report
back to Scarborough Community Council on the protocol and process for adopting a flag for the Scarborough community,
and include in such report, reference to other symbols of the former City that may require adaptation.

In response to the answer we received to our letter to ex-Mayor Frank Faubert, I am submitting our flag design utilizing the
Scarborough Bluffs and Lake Ontario background for your Community Council's approval. The only change we are making
to the City of Scarborough's flag is the substitution of our crest - twelve inches in diameter - for the red maple leaf.
As was mentioned in our original request, we are a Scarborough organization that would like to keep as much of the
Scarborough flag visible before the public.
The reason for us requesting to have a flag of our own at this time is that one of our widows would like to purchase it for us
in memory of her husband.

Removal of Litter and Debris
375 Danforth Road - Scarborough Bluffs

The Scarborough Community Council recommends the adoption of the following report (February 3, 1998) from
the Commissioner of Planning and Buildings, Scarborough, and further, that the Commissioner of Planning and
Buildings, Scarborough, be requested to position concrete blocks on this site, in a manner that would prevent
further dumping:
Purpose:
The purpose of this report is to seek Council approval for the clean up of a property known municipally as 375 Danforth
Road.
Financial Implications and Impact Statement:
Charges associated with the clean up of a property are charged back to the property owner and are collected in like manner
as taxes.
Recommendation:
It is recommended that Council concur in the proposed action by the Commissioner of Planning and Buildings,
Scarborough, to remove the litter and debris from the site owned by Keyvan Ontario Limited and known municipally as
375 Danforth Road.
Background/History:
The subject property is located south of the intersection of Danforth and Birchmount Roads. The property has frontage on
both streets and currently has a partially demolished building located on the site.
The property has been vacant for a number of years and has been subjected to unauthorized dumping. In this regard, notices
under By-law No. 24222, as amended, dating back to early 1995 have been issued to the owner to remove the waste. As a
follow-up to these notices, charges with dates of offence of September 5, 1997, September 23, 1997 and December 8, 1997
have been initiated against the owner.
The amount of garbage at the site is increasing almost daily and a number of residents have contacted the division
expressing concern. The owner has advised that he is attempting to redevelop the property and, while expressing concern
over the amount of debris on the site, will only remove the debris once the final go ahead to develop has been received. In
the meantime, tenders have been called for the removal of the debris and these figures will be available prior to the
Community Council meeting.
Justification:
Section 9 (1) of By-law No. 24222, as amended, states that:
"Where the owner is in default of doing the matter or thing required to be done under this by-law, the City may: (c) remove
debris or litter."
The authority granted in the by-law is found under Section 326 of the Municipal Act which states:
"326 Where a Council has authority to direct or require by law or otherwise that any matter or thing be done, the Council
may by the same or another by-law direct that, in default of its being done by the person directed or required to do it, such
matter or thing shall be done at his expense, and the Corporation may recover the expense incurred by doing it by action, or
the same may be recovered in like manner as taxes, or the Council may provide that the expense incurred by it, with
interest, shall be payable by such person in annual installments not exceeding ten years and may borrow the money to cover
such expense by the issue of debentures of the corporation payable in not more that ten years."

sponsored by the Agincourt Garden Club, the Scarborough Garden Horticultural Society and the City, through the Parks
and Recreation Department.
In 1997, 250 gardens were nominated and more than 40 volunteer judges working in teams were involved in the judging.
At the October awards evening, over 300 people attended as the owners of 35 properties were recognized.

The following persons appeared before the Community Council in connection with the foregoing matter:
- Mr. R. J. Stuart; and
- Mr. David Warren, General Manager, Scarboro Golf and Country Club,
(x) Request for 40 kilometre per hour Speed Limit on Brimorton Drive near
Churchill Heights Public School - Scarborough Highland Creek.
The Scarborough Community Council reports having deferred consideration of the following report sine die to
permit community consultation:
(January 23, 1998) from the Director, Road and Traffic Services, Scarborough, recommending that:
(1) the speed limit on Brimorton Drive remain at 50 kilometres per hour;
(2) oversized School Area signs with Reduce Speed tabs be installed on Brimorton Drive in advance of Churchill Heights
Public School; and
(3) the Toronto Police Service, 42 Division, provide a period of concentrated enforcement of the 50 kilometre per hour
speed limit on Brimorton Drive, specifically between Gander Drive and Painted Post Drive.
(y) Future Uses of the Scarborough Civic Centre
The Scarborough Community Council reports having:
(1) amended the recommended process for review by the Facilities Management Group, embodied in the following
report, by adding thereto:
(a) that the amount in the Scarborough Civic Centre Reserve Fund be identified;
(b) that the Terms of Reference be referred to the Scarborough Community Council for comment;
(c) that space ancillary to the Civic Centre be included in the Terms of Reference;
(d) that Section (2) entitled "Process" be amended as follows:
(i) Item (1) be amended to include timelines for receipt of comments from the Scarborough Community Council;
(ii) Item (7) be amended to insert the words "the needs of the volunteer community" after the words "Cultural
Centre";
(2) supported the continued use of the Scarborough Civic Centre as a location for municipal government services
and a centre for community gatherings and that the Commissioner of Corporate Services be so advised; and
(3) requested that the Commissioner of Corporate Services report to the Scarborough Community Council with
proposals to commemorate and celebrate the 25th Anniversary of the Scarborough Civic Centre.
(February 2, 1998) from the Commissioner, Works and Environment, Scarborough, reporting, as requested by Community
Council at its January 21, 1998 meeting, on a process whereby the Facilities Management Group may review future uses of
the Scarborough Civic Centre including a Theatre/Art Gallery, Central Library or Cultural Centre, and recommending that
this report be received for information.
(z) Response from the Financial Advisory Board with respect to
the Clearing of Snow Windrows on Metro Roads.
The Scarborough Community Council reports having received the following report:
(February 5, 1998) from the Commissioner, Works and Environment, Scarborough, reporting, as requested by Community
Council at its January 21, 1998 meeting, on the status of the situation regarding the clearing of snow windrows across
driveways on Metro roads; the response from the Financial Advisory Board indicating that it did not approve of the action,
and recommending that this report be received for information.
(aa) One Councillor per Ward Representation.
The Scarborough Community Council reports having:
(1) considered Recommendation No. (21) of the Final Report of the Toronto Transition Team which was referred to
the Community Council through the following communication from the City Clerk;
(2) endorsed the principle of splitting the Wards;
(3) directed that Scarborough Community Council's position on this matter be forwarded to the Urban
Environment and Development Committee, and that the Committee be requested to deal with this issue as
expeditiously as possible; and
(4) requested that the City Solicitor report to the Urban Environment and Development Committee on the process
necessary to implement this change.
(January 15, 1998) from the City Clerk, advising that City Council, on January 2, 6, 8 and 9, 1998, in adopting, as
amended, the recommendations of the final report of the Toronto Transition Team, directed, in part, that Recommendation
No. (21) of the Final Report of the Toronto Transition Team pertaining to one Councillor per Ward representation be
referred to the Urban Environment and Development Committee and circulated to the Community Councils for
consideration and report thereon to Council.
(bb) Best Practices Information.
The Scarborough Community Council reports having received the following report:
(February 5, 1998) from the Commissioner, Parks and Recreation, Scarborough, submitting for information, as requested
by Community Council at its January 21, 1998 meeting, a report on the Best Practices associated with the former
Scarborough government function.
(cc) Manson Property at 5421 Lawrence Avenue East.
The Scarborough Community Council reports having approved the following reports, and further, having directed
that the Interim Lead, Real Estate, Scarborough, continue negotiations with the owners of the other properties
involved in the Village Common issues:
(i) (February 6, 1998) from the Commissioner, Works and Environment, Scarborough,recommending that this report be
forwarded to Budget Committee as part of the 1998 Corporate Budget process and considered in conjunction with Part II;
and further, that all reporting be through the Commissioner of Urban Planning and Development Services;
(ii) (February 6, 1998) confidential report from the Commissioner, Works and Environment, Scarborough, respecting the
foregoing.

Mr. William A. Dempsey, Honorary Secretary, Centennial Community and Recreation Association, appeared before the
Community Council in connection with the foregoing matter.
(dd) 1998 Budget Overview.
The Scarborough Community Council reports having received the following report:
(February 18, 1998) from the Chief Financial Officer and Treasurer, providing, as requested by Community Council at its
January 21, 1998 meeting, an overview of Scarborough's 1998 budget and its integration into the Toronto budget process,
and recommending that this report be received for information.
(ee) "Any Other Matters" Section on Scarborough Community Council Agenda.
The Scarborough Community Council reports having requested that the City Clerk ensure that all future agendas
of the Scarborough Community Council contain an item entitled "Any Other Matters".
(ff) Response to Statements by The Honourable Ernie Eves, Minister of Finance.
The Scarborough Community Council reports having approved the following motion by Councillor Bas Balkissoon
and having directed that the Interim Contact forward same to The Honourable Ernie Eves, Minister of Finance:
WHEREAS, as a member of Scarborough Council for nine years, I had the privilege of serving Scarborough Council and
the community on its Budget Committee; and
WHEREAS, my residents and myself are very proud of the work of the Budget Committee of implementing new policies,
reducing costs and improving efficiency and rightsizing the administration; and.
WHEREAS the City of Scarborough was very proud of being able to deliver quality services to its residents and
businesses by freezing its tax bill for six of the past seven years; and.
WHEREAS, The Honourable Ernie Eves, Minister of Finance, Province of Ontario, in a public speech at the Chamber of
Commerce Executives conference in February, attacked the integrity, reputation and work ethics of all past Scarborough
Councillors; and
WHEREAS, The Honourable Ernie Eves has labelled me in a stereotypical and degrading manner by stating that City of
Toronto Councillors are responsible for:
- "decades of irresponsible spending decisions and questionable programs approved by successive Toronto Councils";
- "Toronto politicians raised spending year after year and took the easy way by loading taxes onto businesses;"
- "problematic past decisions of Toronto school boards and municipal governments that resulted in Toronto businesses
paying inappropriately high levels of education property taxes;" and
WHEREAS the Minister and his government have forced the amalgamation of the former City of Scarborough residents
into the New City of Toronto; and
WHEREAS the Minister is unaware of the many tax incentives implemented for the benefit of Scarborough businesses in
our "Going to Bat for Business" strategy; and
WHEREAS the Minister has chosen to ignore the excellent work of Scarborough Council and the businesses within
Scarborough by being inconsistent and discriminating on the issue of higher education taxes on businesses by further
stating:
- "This problem cannot be resolved by raising taxes in municipalities that have worked hard to keep their taxes low and
manage public funds efficiently. This is simply inappropriate and unfair."
NOW THEREFORE BE IT RESOLVED THAT Scarborough Community Council request the Minister to publicly, in
person at a Scarborough Community Council meeting, in the near future, withdraw his statements that attacked the
reputation, integrity and also the stereotyping of all current and former Councillors representing Scarborough as "spend
crazy" and "irresponsible" politicians; and
BE IT FURTHER RESOLVED THAT the Minister be requested to advise how he intends to address the high education
tax on businesses within the Scarborough Community and give recognition to the excellent work of the previous City of
Scarborough Council; and
BE IT FURTHER RESOLVED THAT the Economic Development Scarborough Division forward this motion to the
Scarborough Chamber of Commerce and to all businesses within Scarborough, requesting that they communicate to the
Minister their support of this Council position.
(gg) Visual Arts Component of the Dunkers Flow Balancing Facility.
The Scarborough Community Council reports having referred the issue of the Visual Arts Component of the
Dunkers Flow Balancing Facility to the Commissioner of Works and Emergency Services, to secure the funding
from the Federal Government and report thereon to City Council through the Works and Utilities Committee.
(hh) Morningside Heights/Ontario Hydro Corridor Lands.
The Scarborough Community Council reports having requested that the Commissioner of Planning and Buildings,
Scarborough, submit the Preliminary Evaluation Reports on the following matters to its meeting scheduled to be
held on April 1, 1998:
(1) Morningside Heights;
(2) Ontario Hydro Corridor Lands.
(ii) Snow Windrows Clearing Program.
The Scarborough Community Council reports having resolved to continue its support of the Snow Windrows
Clearing Program, and that the Program be continued in Scarborough.
(jj) Special Meeting of the Scarborough Community Council
to consider the 1998 Capital Budget.
The Scarborough Community Council reports having:
(1) been advised by the Chair that the Chief Financial Officer and Treasurer requests that Community Council
establish a date and time for consideration of the 1998 Capital Budget; and
(2) approved that a Special Meeting of Scarborough Community Council be held on Monday, March 23, 1998 at
7:00 p.m. for this purpose.
