Permit Parking on Jesmond Avenue between
Oakwood Avenue and Cedric Avenue
(City Council on March 4, 5 and 6, 1998, adopted this Clause, without amendment.)
The York Community Council recommends the adoption of the following report (January 23, 1998) from the
Commissioner of Operations Services (York Civic Centre):
Purpose:
Councillor Joe Mihevc, Ward 28, York Eglinton, is requesting a report on the feasibility of implementing on-street permit
parking on Jesmond Avenue between Oakwood Avenue and Cedric Avenue.
Funding Sources, Financial Implications and Impact Statement:
Traffic budget: the implementation of on-street permit parking on Jesmond Avenue between Oakwood Avenue and Cedric
Avenue could provide a potential annual revenue of $660.00.
Recommendations:
It is recommended that:
(1) By-law No. 3491-80 be amended to implement on-street permit parking on Jesmond Avenue between Oakwood
Avenue and Cedric Avenue; and
(2) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.

Internal memo, dated October 16, 1996, from Councillor Joe Mihevc, Ward 28, York Eglinton, to Stephen Brown,
Manager Traffic/Parking.
Comments:
Jesmond Avenue traverses in an east/west direction, between Glenholme Avenue and Vaughan Road.
Currently on-street parking is legally permitted exclusively on the south side of Jesmond Avenue between Oakwood
Avenue and Cedric Avenue, with a maximum unsigned three (3) hour parking regulation anytime, whereas on the section
of Jesmond Avenue between Cedric Avenue and Vaughan Road on-street parking is prohibited on both the north and south
sides of the street.
Field surveys reveal there is a total complement of eleven (11) curbside parking spaces available on the south side of
Jesmond Avenue between Oakwood Avenue and Cedric Avenue.
On-street permit parking provides those residents, without adequate off-street parking facilities to legally park their
vehicles on the streets on which they reside for extended periods of time, with impunity from the signed or unsigned
parking regulations. We, therefore, support the introduction of on-street permit parking on Jesmond Avenue between
Oakwood Avenue and Cedric Avenue.
Councillor Joe Mihevc is suggesting York Community Council forego having the Clerk's Department (York Civic Centre)
undertake a poll on Jesmond Avenue between Oakwood Avenue and Cedric Avenue to determine majority interest in
introducing on-street permit parking. The basis for his suggestion is the fact that there are no municipally addressed
properties fronting Jesmond Avenue between Oakwood Avenue and Cedric Avenue. We support the Councillor's
recommendation for the simple reason that it provides a direct service at minimal cost to those taxpayers requiring the
service.
Conclusions:
On-street permit parking is a service benefit for every municipally addressed taxpayer without adequate off-street parking
facilities. We, therefore, concur with Councillor Joe Mihevc's recommendation to forego the undertaking of a poll to
determine majority interest in introducing on-street permit parking on Jesmond Avenue between Oakwood Avenue and
Cedric Avenue, and recommend that By-law No. 3491-80 be amended accordingly.

Designation of the Area formerly known as the City of York
as a Community Improvement Project Area

The York Community Council recommends the adoption of the following report (February 3, 1998) from the
Commissioner of Development Services (York Civic Centre):
Purpose:
To bring forward a By-law designating the former City of York as a Community Improvement Project Area for Council's
consideration.
Funding Sources, Financial Implications and Impact Statement:
Not applicable.
Recommendations:
It is recommended that:
(1) City Council enact a by-law in accordance with the Draft By-law noted hereunder, and attached to this report as
Schedule 1; and
(2) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.
Background:
On May 28, 1997, the former City of York Council adopted an Official Plan Amendment which established new, simplified
policies for Community Improvement. Approved by the Minister of Municipal Affairs and Housing on July 29, 1997, the
main objective of the Amendment is to provide Council with an effective policy framework from which to improve the
amenity, appearance and safety of all areas of York. Accordingly, one of the new policies designates the entire former City
as a Community Improvement Area. At the same meeting, Council instructed the City Solicitor to prepare a By-law
designating the entire City as a Community Improvement Project Area.
Discussion:
The Planning Act defines a Community Improvement Project Area as any area within a municipality in which, in the
opinion of Council, community improvement is desirable. The Act provides local councils with the authority to pass
by-laws establishing Community Improvement Project Areas. Once such a by-law is passed, the City can prepare a
Community Improvement Plan for approval by the Minister of Municipal Affairs and Housing. Community Improvement
Plans allow Council to acquire land for community improvement purposes, such as municipal parking lots, or make grants
or loans to private property owners for such purposes as facade improvements.
The designation of only select areas of York as Community Improvement Project Areas, as is presently the case, is an
unnecessary restriction which only delays the development and implementation of Community Improvement Plans. All
areas of York could benefit from some form of community improvement, either presently or in the future. Therefore, it is
recommended that City Council approve the Draft By-law attached to this report designating all of the former City of York
as a Community Improvement Project Area.
Conclusion:
Designating the lands formerly known as the City of York as a Community Improvement Project Area will facilitate the
development and implementation of future community improvement programs. Therefore, I recommend that Council
establish this designation by enacting a By-law in accordance with the Draft By-law attached as Schedule 1 to this report.

Schedule 1 - Draft By-law
BY-LAW NO.
TO DESIGNATE the area consisting of the former City of York as a Community Improvement Project Area;
WHEREAS there is an Official Plan (herein called the "Official Plan") in force that contains provisions relating to
community improvement in that portion of the City of Toronto which was formerly the City of York;
AND WHEREAS the area formerly known as the City of York, and now known as Wards 27 and 28 of the City of Toronto,
is designated as a Community Improvement Area in the Official Plan;
AND WHEREAS the Council of the City of Toronto deems it in the interest of the Municipality to designate the area
formerly known as the City of York as a Community Improvement Project Area;
NOW THEREFORE THE COUNCIL OF THE CITY OF TORONTO ENACTS AS FOLLOWS:
Pursuant to Subsection 28(2) of the Planning Act, R.S.O. 1990 c.P.13, the area of the City of Toronto consisting of the
former City of York is hereby designated as a Community Improvement Project Area.

Amendment to Interim Control By-law No. 3432-97 (York)
Lands at 2007, 2009 and 2011 Lawrence Avenue West
Ward 27 - York Humber

The York Community Council recommends the adoption of the following report (February 2, 1998) from the
Commissioner of Development Services (York Civic Centre):
Purpose:
To extend, for an additional year, the prohibition applying to the subject lands as imposed by Interim Control By-law No.
3432-97 . The By-law prohibits the location of any new Banquet Hall on the lands until April 1, 1998.
Funding Sources, Financial Implications and Impact Statement:
Not applicable.
Recommendations:
It is recommended that:
(1) the Interim Control By-law relating to 2007, 2009, and 2011 Lawrence Avenue West be extended for an additional year;
(2) City Council, at its meeting of March 4, 1998, enact a By-law to amend Interim Control By-law No. 3432-97 (York) to
implement Recommendation No. (1); and
(3) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.
Council Reference/Background/History:
On April 2, 1997, Council adopted a resolution to study the provisions of City of York Zoning By-law No. 1-83 relating to
Banquet Halls as they apply to 2007-2011 Lawrence Avenue West. Council also passed an Interim Control By-law to
prohibit any new banquet hall from locating in the industrial condominium complex located on the lands. The Interim
Control By-law is in effect for one year and expires on April 1, 1998.
Comment:
The review of the Zoning By-law definitions and standards relating to Banquet Halls is incorporated into a broader study of
restaurants and other eating establishments. A report on the study is expected to be presented to Community Council in
April, 1998. This timing will not allow for the enactment of a by-law amendment to implement any of the report's
recommendations to change zoning provisions relating to Banquet Halls prior to the expiry of the Interim Control By-law
on April 1, 1998.
Should the Interim Control By-law lapse this year, there will be an opportunity for other banquet halls to locate on the
subject site, prior to any new By-law standards being put in place. The Interim Control By-law would be repealed when the
new By-law on eating establishments is in effect.
Conclusions:
The Interim Control By-law for the subject properties should be extended for another year to allow for the by-laws on
eating establishments to be in full force and effect prior to lifting the restrictions on the subject property.

York West Seniors' Centre, 2100 Lawrence Avenue West
Upgrading and Renovations

The York Community Council recommends the adoption of the following report (February 5 , 1998) from the
Commissioner of Community Services (York Civic Centre):
Purpose:
To provide a better quality of service for seniors at the York West Seniors' Centre.
Funding Sources, Financial Implications and Impact Status:
The Centre has requested and is proposing to spend $90,000.00 from the York Humber Reserve Account. In 1989 there was
a site plan agreement (Hickory Tree Development) implemented which set aside $225,000.00 for the purpose of providing
funds to use towards capital requirements for seniors in the immediate area.
In 1994, $60,000.00 was approved by Council for capital improvements to its present location 1901A Weston Road.
Presently there is $285,000.00 sitting in the reserve account dedicated for seniors.
Recommendations:
It is recommended that:
(1) the amount of $90,000.00 from the York Humber Reserve Account No. 004-433-2680, be allocated towards the
upgrading and renovations at 2100 Lawrence Avenue for the new site of the York West Seniors' Centre;
(2) the lease and business arrangements be identified to reflect the centre's financial objectives; and
(3) the lease arrangements should be reviewed and deemed reasonable by appropriate staff.
Council Reference/Background History:
The York West Seniors' Centre has been located in three storefronts at 1901 Weston Road a property of Metro Housing
Company for the past 18 years and has been searching since 1989 for a more suitable site for its Seniors Centre.
Over the years its membership programmes and services have increased to the point where they are limited in expanding
their Centre. The present location is fragmented and very limiting in providing quality service.
Comments and/or Discussion and/or Justification:
The relocation of the York West Seniors' Centre to 2100 Lawrence Avenue West would better service the needs of its
members for accessibility, programming space and work environment. York West Meals on Wheels who have a close
working relationship with York West Seniors have just moved into this new site. This linkage is a very important aspect to
the community and would benefit everyone if they were located within the same building.
We would support in principle, the allocation of $90,000.00 towards capital improvements for their proposed site.
Conclusions:
In conclusion we are supportive of this request but would ask that the York West Seniors' Centre further develop a business
plan to identify their fiscal requirements.

Amendment to Zoning By-law No. 1-83 (York)
725 to 729 Jane Street, and 120 Corbett Avenue
(City Council on March 4, 5 and 6, 1998, adopted this Clause, without amendment.)
The York Community Council, based on the findings of fact, conclusions and recommendations contained in the
following report (February 2, 1998) from the Commissioner of Development Services (York Civic Centre), and for
the reason that the proposal is an appropriate use of the lands, recommends that:
(1) the report of the Commissioner of Development Services (York Civic Centre) be adopted; and further that the
draft by-law attached to such report respecting Application No. OZ97-004 submitted by Balian Holdings regarding
a zoning by-law amendment, be approved, subject to the Owner executing a Development Agreement with the City
prior to enactment of the draft by-law; and
(2) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.
The York Community Council reports, for the information of Council, having held a statutory public meeting on February
18, 1998, in accordance with Section 34 of The Planning Act, and that appropriate notice of this meeting was given in
accordance with The Planning Act and the regulations thereunder.
The York Community Council submits the following report (February 2, 1998) from the Commissioner of
Development Services (York Civic Centre):
Purpose:
This report is for the approval of a rezoning application for the lands at 725 to 729 Jane Street and 120 Corbett Avenue.
Funding Sources, Financial Implications and Impact Statement:
Not applicable.
Recommendations:
It is recommended that:
(1) the application be approved; and,
(2) Zoning By-law No. 1-83 be amended in accordance with the attached draft Zoning By-law (Appendix 3) subject to the
Owner executing a Development Agreement with the City prior to the By-law's enactment.
Background:
(1) Application:
The applicant wishes to change the zoning of the site so that the existing uses are permitted, as-of-right, and a new
accessory parking lot with 12 spaces can be created to service the pharmacy and medical offices. The bungalow at 120
Corbett Avenue is to be demolished to accommodate the parking lot.
(2) Location:
The site is located on the north-east corner of Jane Street and Corbett Avenue and has an area of 940 m2. The frontage on
Jane Street is 33.5 m and the depth along on Corbett Avenue is 28 m. (See Map 1 - Location Map). An existing 2 storey
building, with a floor area of 715 m2, has White's Pharmacy on the ground floor and medical offices above. A one storey
detached bungalow is on the east portion of the site at 120 Corbett Avenue. Parking is currently provided on the boulevard.
Land uses abutting the site are as follows:
North: Hydro corridor and retail plaza
East: single and semi-detached houses
West: single and semi-detached houses
South: single and semi-detached houses
(3) Existing Official Plan and Zoning By-law:
The existing Official Plan places the site in a Low Density Residential Area. This designation allows for ancillary uses
including minor commercial facilities oriented to the local population. The pharmacy and medical offices are considered
minor commercial facilities oriented to the local population. The use, therefore, conforms with the Low Density Area
designation of the Official Plan.
The Zoning By-law places the site in an R2 area. Commercial uses are not allowed in this zone which primarily permits
single, semi-detached and duplex houses, along with some institutional and recreational uses. The existing use is legal
non-conforming. It and the proposed parking lot expansion are not permitted uses in an R2 zone.
Comment:
(1) Issues:
The following issues arise as a result of the review of the application by the Development Services Department and other
City of York departments:
- - allowing the existing uses to become conforming
- desirability of the expansion
- required improvement
- proposed zoning and exceptions
(2) Evaluation:
A. Allowing the Existing Uses to become Conforming:
The commercial building is adjacent to other zoned commercial uses to the north and conforms to the uses permitted in the
Official Plan.. The use has been in existence as a legal non-conforming use for many years and provides a valuable service
to the local community.
The Official Plan states that non-conforming uses should cease to exist over time and the land should revert to a
conforming use. The owner intends to continue the use and has applied to expand it by creating an accessory off-street
parking area for his customers.
The property abuts an arterial road. The site is suitable for the existing uses and the accessory parking, subject to controls
to limit the amount of development and the location of the uses on the site.
B. Desirability of the Expansion:
The expansion consists of the provision of an accessory parking lot with 12 spaces. A house which currently exists on the
site of the proposed parking lot will be removed. The lot will provide for customer parking which now takes place on the
street, thus improving the conditions for residents in the area.
While the parking lot extends the commercial uses into a residential area, the extension is marginal and remains at the
periphery of the stable residential area. The number of parking spaces required by the Zoning By-law for the existing
pharmacy and medical office is 12. These will be provided.
The nuisance factors of noise, fumes vibrations, etc. will not be increased by the addition of the parking lot, nor will it
generate more traffic. The homes to the east are proposed to be protected by a 1.8 metre high solid board fence and
landscape strip. Existing municipal services are adequate.
C. Required Improvements:
As a result of negotiations with Development Services Department staff, the parking spaces on the public boulevard have
been eliminated and replaced with a landscaped area. A 1.8 metre high solid board fence and a 3 metre wide landscaped
strip will separate the parking area from the abutting dwellings to the east.
The provision of landscaping and other buffers between the commercial and residential uses will be secured by the owner
entering into a Development Agreement.
D. Proposed Zoning and Exceptions:
A zoning district change from the existing residential zoning (R2) to the Local Commercial-Residential (LCR) zoning is
proposed for the property. It will allow a range of commercial uses, including the existing uses, and compatible residential
uses. The LCR zoning also allows restaurants and public garages which are not considered appropriate uses for this site due
to its proximity to neighbouring detached dwellings. A site specific zoning also is proposed to prohibit these uses from
locating on the site.
Conclusions:
The pharmacy and medical offices are minor commercial uses which conform to the Official Plan but not the Zoning
By-law. The expansion of the commercial uses to include an accessory parking lot with landscape buffering and fencing
will not adversely affect the residential neighbourhood, but will increase the available street parking for residential uses.
The zoning district change to an LCR zone with a site specific zoning will allow a full range of commercial and residential
uses, except for restaurants and public garages. This will permit the current use and future commercial uses.
It is recommended that the site be rezoned in accordance with the attached Draft Zoning By-law (Appendix 3).

Schedule 1 - Draft By-law
BY-LAW NO.
To AMEND City of York By-law No. 1-83
(Re: 725-729 Jane Street and 120 Corbett Avenue)
THE COUNCIL OF THE CITY OF TORONTO (1998) ENACTS AS FOLLOWS:
1. THAT Section 6 of the City of York By-law Number 1-83, as amended, be further amended by adding the following as
a new Subsection (53):
"(53) MAP 17
By changing District Map 17, comprising the lands known as 725, 729 Jane Street and 120 Corbett Avenue, from an R2
District to an LCR District.
2. THAT Section 16 of the City of York By-law 1-83, as amended, be further amended by adding the following as a new
subsection (376):
"(376) LANDS - 725-729 Jane Street and 120 Corbett Avenue
Notwithstanding any other provision of this By-law, the property known municipally as 725-729 Jane Street and 120
Corbett Avenue, and zoned LCR, shall not be used for a restaurant, licensed restaurant or public garage.
3. SUBJECT to the provisions of Section 34 of the Planning Act, R.S.O. 1990 c.P.13, this By-law shall come into force on
the date of its passing.
ENACTED and PASSED this day of A.D. 1998.

(City Council on March 4, 5 and 6, 1998, had before it, during consideration of the foregoing Clause, the following report
(February 25, 1998) from the Commissioner of Development Services, York Civic Service Centre:
Purpose:
This information report advises that a development agreement has been executed by the Owner of the lands and a financial
security to guarantee landscape works as required by the agreement has been deposited with the City. The executed
agreement fulfils the condition imposed by the Community Council at its meeting on February 18, 1998 and permits City
Council to pass the recommended zoning by-law amendment.
Funding Sources, Financial Implications and Impact Statement:
Not applicable.
Recommendation:
It is recommended that this report be received for information.
Comment:
Council today will consider Clause No. 5 of Report No. 2 of The City of Toronto York Community Council, recommending
that:
(1) the report of the Commissioner of Development Services (York Civic Centre) be adopted; and further that the draft
by-law attached to such report respecting Application No. OZ97-004 submitted by Balian Holdings regarding a zoning
by-law amendment, be approved, subject to the owner executing a Development Agreement with the City prior to
enactment of the draft by-law; and
(2) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.
The Owner has executed the required development agreement with the City and has provided the necessary financial
security to guarantee landscape works as required by the agreement. The Bill to amend the zoning by-law is before
Council for enactment this day. It is recommended that this report be received for information.

Acquisition of CN Belt Line Lands (York)
(City Council on March 4, 5 and 6, 1998, adopted this Clause, without amendment.)
The York Community Council recommends the adoption of the confidential report dated February 18, 1998 from
the Solicitor (York Civic Centre), respecting the acquisition of CN Belt Line Lands, which was forwarded to
Members of City Council under confidential cover.
The York Community Council reports, for the information of City Council, having directed that this matter be forwarded to
City Council for its meeting scheduled to be held on March 4, 1998.

Recommendation:
That the Chief Administrative Officer be authorized, on behalf of the City, to enter into an agreement to extend the
requisition, conditional and closing dates set up in the Agreement of Purchase and Sale, dated December 31, 1997, between
the City of York and Canadian National Railway Company, to dates that City staff will negotiate with the Vendor, such
amending agreement to be in a form satisfactory to the City Solicitor; such authority is also to extend to any further
extensions as may be necessary.

Other Items Considered by the Community Council
(City Council on March 4, 5 and 6, 1998, received this Clause, for information.)
(a) Request for Stop Sign at Haverson Boulevard
and Donald Avenue.
The York Community Council reports having concurred with the recommendation embodied in the following
report:
(December 11, 1997) from the Commissioner of Operations Services (York Civic Centre), advising that based on the
results of a traffic study an all-way stop control is not warranted at the aforementioned intersection, and is therefore not
recommended for installation.
(b) Request for Alternate Side Parking on
Silverthorn Avenue or a Portion thereof.
The York Community Council reports having concurred with the recommendation embodied in the following
report:
(December 16, 1997) from the Commissioner of Operations Services (York Civic Centre) advising that reversing the
parking regulation from the west to the east side on Silverthorn Avenue between Harlton Crescent and Donald Avenue
would result in a loss of three (3) on-street curb side parking spaces; and recommending that the Uniform Traffic By-law
not be amended to reverse the current on-street parking regulation.
(c) Parking Problems on Vaughan Road,
West of Northcliffe Boulevard; and
Proposed Policy for Area-Wide Parking Permits.
The York Community Council reports having referred the following communication to the Commissioner of
Planning and Urban Development Services, with a request that staff (York Civic Centre) report on the parking
problems on Vaughan Road, west of Northcliffe Boulevard; and having also requested the Commissioner to report
on a policy with respect to the issuance of area-wide parking permits:
(February 4, 1998) from Councillor R. Davis, advising that a number of residents on Vaughan Road have complained that
they are receiving parking tickets through aggressive enforcement; the lack of available parking on the street; and that a
copy of this memorandum had been sent to Mr. Stephen Brown, Traffic Branch (York Civic Centre) with a request to
report to the Community Council on the feasibility of implementing parking on the south side of Vaughan Road.
(d) Traffic on Arlington Avenue,
South of Vaughan Road.
The York Community Council reports having referred the following communication to the Commissioner of
Planning and Urban Development Services, with a request that:
(1) staff (York Civic Centre) undertake a traffic count on Arlington Avenue, south of Vaughan Road for one week,
and that this information be used as the basis for consideration of the removal of the 4:00 to 6:00 p.m. southbound
turn restriction on Vaughan Road at Arlington Avenue; and
(2) staff (York Civic Centre) report on a 4:00 to 6:00 p.m. No Entry prohibition for southbound vehicles on
Arlington Avenue at Earlsdale Avenue:
(January 14, 1998) from Councillor J. Mihevc, advising that a business establishment in the Vaughan Road/Arlington
Avenue area had requested that the southbound 4-6 p.m. "No Right Turn" restriction on the sign at Vaughan Road at
Arlington Avenue be removed; that since the sign was installed at this location, a number of stop signs were placed on
Arlington Avenue southbound, thereby reducing the volume of traffic on Arlington Avenue; and requesting that a traffic
count be undertaken on Arlington Avenue, south of Vaughan Road, for a one-week period.
(e) Removal of New Stop Sign on
Ava Road at Hill Place.
The York Community Council reports having deferred consideration of the following communication; and having
regard to the Cedarvale Traffic Plan, requested the Commissioner of Planning and Urban Development Services, to
direct staff (York Civic Centre) to submit a status report to its April 1, 1998 meeting, including traffic control
measures which have been implemented, measures proposed, and the cost of the contract:
(January 27, 1998) from Councillor J. Mihevc, advising that area residents had requested the removal of the stop sign, as
there does not appear to be a problem with traffic, volume and speed of vehicles; that the new stop sign increases noise and
air pollution and is peripheral to the overall Cedarvale traffic plan; and requesting that staff undertake a poll of the residents
in the immediate regarding the removal of the stop sign and to report back to the Community Council.
(f) Installation of Bench at the Top of the Hill
on Ennerdale Road; and Grass Maintenance.
The York Community Council reports having referred the following communication to the Commissioner of
Community and Neighbourhood Services, with a request that staff (York Civic Centre):
(1) report on the feasibility of maintaining the grassy areas of public land along the Ennerdale Road flankage at
2 Branstone Avenue; and
(2) on placing the grassy areas of public land at 2 Branstone Avenue on a regular maintenance schedule;
(3) identify and report on the feasibility of installing benches on plots of public land in York, such as the hills in the
areas of Ennerdale Road, Nairn and Harvie Avenues, and Dufferin Street;
(4) consult with the Fairbank Seniors to identify need and location for benches; and
(5) report in two months on criteria for development of a City-wide policy for installation of benches on public land:
(February 4, 1998) from Councillor J. Mihevc, advising that the City-owned property at 2 Ennerdale Road is on a very
steep hill, and that area residents are experiencing difficulty walking up this incline, and requesting that a bench be installed
at the top of the hill to allow area residents to rest; that if the City is unable to cut the grass at this location, that the City
consider paying an area resident to maintain the upkeep of this property; and requesting that staff investigate and report
back on the above two issues.
(g) Permit Parking on Alameda Avenue between
Eglinton Avenue West and Belvidere Avenue.
The York Community Council reports having concurred with the recommendation embodied in the following
report, and having referred this matter to the Commissioner of Planning and Urban Development Services, with a
request that staff (York Civic Centre) undertake the poll for permit parking on Alameda Avenue between Eglinton
Avenue West and Lanark Avenue:
(January 23, 1998) from the Commissioner of Operations Services (York Civic Centre) advising that a survey revealed a
total complement of thirty-two (32) curbside parking spaces available on the east side of Alameda Avenue between
Eglinton Avenue West and Lanark Avenue, and on Alameda Avenue between Gloucester Grove and Belvidere Avenue;
and recommending that the York Community Council approve the implementation of on-street permit parking at the

(u) Proposed Uniform Permit Parking Policy.
The York Community Council reports having recommended to the Urban Environment and Development
Committee that:
(1) the Interim Functional Lead for Transportation be requested to submit to the Committee:
(a) a draft uniform permit parking by-law; and
(b) at the earliest opportunity, an outline of a policy for the introduction of area-wide permit parking, to be
considered in a City-wide context, including a graduated fee structure for single addresses requiring multiple
vehicle permits; and
(2) the aforementioned draft uniform permit parking by-law and policy be referred to the Community Councils for
consideration and public consultation, and subsequent comment thereon back to the Urban Environment and
Development Committee.
(v) Proposed 1998 Capital and Operating Budgets.
The York Community Council reports having deferred discussion regarding the proposed 1998 Capital and
Operating Budgets to its next meeting scheduled to be held on April 1, 1998.
(w) Sidewalk Repairs in the Vaughan Road and
Arlington Avenue Area.
The York Community Council reports having referred the following communication to the Commissioner of
Planning and Urban and Development Services, with a request that staff (York Civic Centre) proceed to take
appropriate action:
(January 14, 1998) from Councillor Joe Mihevc, advising that complaints had been received from the shopkeepers between
389-397 Vaughan Road, and 306-400 Vaughan Road, regarding the condition of the sidewalks; and requesting that the
Community Council support the repair of these sidewalks going forward to the Works Department for inclusion in the
Capital Works Program for 1998.
(x) Request for Two-Way Traffic on Holland Park Avenue
between Oakwood Avenue and a point 52 Metres East of
Oakwood Avenue to be Reverted to One-Way Traffic.
The York Community Council reports having referred the following communication to the Commissioner of
Planning and Urban and Development Services, with a request that staff (York Civic Centre) undertake a poll of
the residents on Holland Park Avenue between Oakwood Avenue and the easterly point, to determine majority
interest in retaining the status quo of two-way traffic, or reverting to the original one-way traffic flow:
(i) (October 20, 1997) from Councillor Joe Mihevc, advising that area residents were not consulted with the change of
traffic flow to two-way on Holland Park; and requesting that the two-way traffic from Oakwood Avenue to the library
entrance/exit be removed, and returned to the original one-way flow.
(ii) (August 26, 1997) report from the Commissioner of Operations Services (York Civic Centre) embodied in Clause
No. 109, in Report No. 14 of the York Works and Parks Committee, adopted by the Council of the City of York on
September 17 , 1997.
(y) Request for Earlsdale Avenue from Oakwood Avenue
to the Laneway to be Changed to Two-Way.
The York Community Council reports having referred the following communication to the Commissioner of
Planning and Urban Development Services, with a request that staff (York Civic Centre) undertake a poll of the
residents on Earlsdale Avenue between Oakwood Avenue and Glenholme Avenue, to determine majority interest in
changing the direction of traffic from one-way to a two-way flow.
(January 14, 1998) from Councillor Mihevc advising of the subject request from a resident to allow improved access to the
laneway, and requesting that appropriate staff undertake a poll of the residents on Earlsdale Avenue, to determine majority
interest in this proposal.
(z) Bell Canada Telephone Booth Advertising.
The York Community Council reports having received the following communication, and having directed the
Commissioner of Development Services (York Civic Centre) to submit to the April 1, 1998 Community Council
meeting, the report on this matter requested at its meeting held on January 21, 1998.
(February 13, 1998) from the City Clerk advising that the Urban Environment and Development on February 9, 1998,
concurred with the recommendation embodied in a report (January 21, 1998) from Councillor Joe Pantalone, Chair, Urban
Environment and Development Committee, viz:
"It is recommended that the Bell Canada telephone booth advertising proposal be deferred until the end of 1998 to provide
the opportunity to assess the reaction to the installations in Etobicoke and East York in the context of a general assessment
of advertising possibilities on the public road allowances."
(aa) Condolences regarding Mark Adler.
The York Community Council reports having received the following motion by Councillor Nunziata, and having
requested the Chair forward an appropriate letter to the family of Mark Adler, on behalf of the Community
Council.
WHEREAS the York Community has been saddened by the recent passing of Mark Adler, the former Executive Director of
the St. Clair West Services for Seniors; and
WHEREAS Mark Adler was an outstanding citizen of the community who gave countless hours of his time to volunteer
efforts in a number of areas such as the York Bingo Association and Jewish youth initiatives; and
WHEREAS his contributions to the well-being of the community at large will be remembered long after his passing;
THEREFORE BE IT RESOLVED that the York Community Council convey its deepest sympathy to Mark's wife, Terry
Azar, and his parents Louis and Hilda Adler.
(bb) Proposed Sign at Eglinton Avenue West
and Guestville Avenue.

The York Community Council reports having received the following communication, and having directed that
ratepayer groups be invited to attend the public meeting on April 1, 1998, to make deputations after the other items

(February 4, 1998) from Councillor F. Nunziata, forwarding a letter from the Chief General Manager (January 30, 1998)
requesting proposals for improvements in transit service for evaluation in the TTC's 1999 Service Plan, be submitted by

(ff) Recommendation 21 in the Final Report of the
Toronto Transition Team pertaining to One
Councillor Per Ward Representation.
The York Community Council reports having deferred consideration of the issue with respect to reducing the
number of councillors from 56 to 28 to later this year, to allow the new Council to gain experience, to provide
appropriate staff with sufficient time to prepare reports, and to permit community consultation on this proposal.
The Community Council reports having given consideration to the following communications:
(January 15, 1998) from the City Clerk advising that:
(i) City Council on January 2, 6, 8 and 9, 1998, considered a motion and several communications with respect to the final
report of the Transition Team, entitled "New City, New Opportunities", and the draft Procedural By-law; and,
(ii) Council, in adopting as amended, the recommendations of the final report of the Toronto Transition Team directed, in
part, that Recommendation 21 of the final report pertaining to one Councillor per ward representation be referred to the
Urban Environment and Development Committee, and circulated to the Community Councils for consideration and report
thereon to Council.
(February 13, 1998) Motion from Councillor Nunziata:
WHEREAS the Toronto Transition Team recommended that there be only one Councillor per Ward representation; and
WHEREAS one Councillor per ward can effectively represent each constituency, similar to an MP or MPP; and
WHEREAS the reduction of the size of Council by fifty (50) percent would provide significant cost savings to the
taxpayers;
THEREFORE BE IT RESOLVED that the York Community Council endorse the recommendation of the Toronto
Transition Team with respect to one Councillor per Ward representation; and
BE IT FURTHER RESOLVED that the City Council approve the implementation of this recommendation in time for the
next municipal election.
(gg) Procedural By-law and Possible Amendments
regarding Road Alterations, and Regulation of Signs.
The York Community Council reports having endorsed the following motions by Councillor Davis, and having
concurred with the recommendations embodied in the following report; referred these matters to the Special
Committee chaired by Councillor Miller for consideration:
Whereas Section 300 of The Municipal Act, R.S.O. 1990, c.M.45, requires that before passing a by-law for stopping
up, altering, widening, diverting, selling or leasing a highway, or for establishing or laying out a highway, Council
must hear any person who claims that the person's land will be prejudicially affected by the by-law and who applies
to be heard; and
Whereas Section 105 of The Municipal Act provides that where the Council of a municipality is required by law to
hear interested parties or to afford them an opportunity to be heard before doing any act, passing a by-law or
making a decision, the Council may provide for a committee of Council to hear such parties, or afford them an
opportunity to be heard in the place of the Council;
Now Therefore Be It Resolved that the hearing, as required by Section 300 of The Municipal Act, of persons who
claim that their land will be prejudicially affected by a proposed by-law for stopping up, altering, widening,
diverting, selling or leasing a highway, or for establishing or laying out a highway is delegated:
(1) in the case of any highway designated as arterial, minor arterial or collector by any official plan in effect, to the
Urban Environment and Development Committee; and
(2) in every other case, to the Community Council which represents the geographic area in which the affected
highway is located; and
Be It Further Resolved that this delegation is an interim measure, to be reconsidered once the Special Committee
chaired by Councillor Miller has reported to Council regarding Community Councils and Council's Procedural
By-law.
And further,
Whereas paragraph 146, of Section 210, of The Municipal Act, R.S.O. 1990, c.M.45, requires that Council hear any
person who applies to be heard before Council passes a by-law for prohibiting or regulating signs and other
advertising devices or any class or classes thereof, and the posting of notices on buildings or vacant lots within any
defined area or areas, or on land abutting on any defined highway or part of a highway; and
Whereas Section 105 of The Municipal Act provides that where the Council of a municipality is required by law to
hear interested parties or to afford them an opportunity to be heard before doing any act, passing any by-law or
making a decision, the Council may provide for a committee of the Council to hear such parties or afford them an
opportunity to be heard in the place of the Council;
Now Therefore Be It Resolved that the hearing, as required by paragraph 146 of Section 210 of The Municipal Act,

(February 5, 1998) from the Solicitor (York Community Council) providing advice on the provisions of the Procedural
By-law and suggested amendments, as requested by the Community Council on January 21, 1998; and recommending that:
1. Council delegate the following hearing functions to the Community Councils:
(a) the hearing required by section 300 of the Municipal Act of persons who claim that their land will be prejudicially
affected by a proposed by-law to stop up, alter, widen, divert, sell or lease a highway or establish or lay out a highway,
except any such proposed by-law in relation to roads designated as arterial, minor arterial and collector roads by an
applicable official plan; and
(b) the hearing required by paragraph 146 of section 210 of the Municipal Act of persons who apply to be heard in relation
to a proposed sign by-law or amendment which would apply solely to lands totally within the urban area represented by the
Community Council; and
2. Notices of Motion be prepared and presented to City Council to effect the delegation of these hearing functions.
(hh) Deputations.
The York Community Council reports having decided on the following procedure with respect to deputations, for a
trial period of six months:
(1) at the beginning of the meeting, the Chair will ask members of the public to identify the items on which they
wish to speak;
(2) if the item is listed on the regular or supplementary agenda, the Community Council will dispense with the
required written notice of intent to speak;
(3) the Community Council will then, as the first order of business, set aside time to hear these deputations
consecutively, allowing for submissions of approximately 3 to 5 minutes, and will render its decisions as soon as
possible thereafter; and
(4) if a member of the public wishes to speak on an item which is not listed on the agenda, the Community Council
will decide by majority vote whether or not to hear the deputant.
