Etobicoke York Community Council recommends that:

1.            City Council amend Zoning By-law 1088-2002 substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 7.

2.            City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.

Etobicoke York Community Council:

1.         Directed the Chief Corporate Officer to report no later than the end of the first quarter of 2010 on the status of negotiations with the YMCA for the purchase of a portion of the Westwood property to permit the construction of a YMCA facility.

2.         Directed the Director, Transportation Services, Etobicoke York District, and the Director, Community Planning, Etobicoke York District, to report no later than the end of the first quarter of 2010 on a Streetscape Plan for the Etobicoke City Centre District, to include selection of common street lamps and other elements to be installed throughout the District as construction activity proceeds.

3.         Held a statutory public meeting on October 13, 2009 and notice was given in accordance with the Planning Act.

This application proposes to amend the Etobicoke Centre Zoning By-law (1088-2002) to permit a Provincial Courthouse and ancillary uses at 3699 and 3741-3751 Bloor Street West and 925 Kipling Avenue (the Westwood Theatre Lands).  The application also proposes to provide relief from some development standards in the By-law to accommodate building massing, siting and parking requirements resulting from the security and operational needs of a Provincial Courthouse.

Etobicoke York Community Council recommends that:

1.            City Council amend the Official Plan substantially in accordance with the draft Official Plan Amendment attached as Attachment 6.

2.            City Council amend Zoning By-law 1994-197 substantially in accordance with the draft Zoning By-law Amendment as described in this report.

3.            City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendment and draft Zoning By-law Amendment as may be required.

4.            Before introducing the necessary Bills for enactment, City Council require the owner to enter into a Section 37 Agreement to secure community benefits as outlined in this report.

5.            The Land Owners Precinct Plan be finalized to the satisfaction of the City Solicitor and City Planning, in consultation with Technical and Transportation Services, prior to the lifting of the Holding Symbol.

The Etobicoke York Community Council held a statutory public meeting on October 13, 2009 and notice was given in accordance with the Planning Act.

This application requests an Official Plan and Zoning Amendment, in order to permit a 5-storey office/commercial building fronting on Lake Shore Boulevard West, an 88-unit, 8-storey residential building in the centre block of the property and a 408-unit, 36-storey residential tower with ground floor retail. A 4-level underground garage will be shared by all three buildings to be accessed from the north side of Street “C”.

Etobicoke York Community Council:

1.         Deferred consideration of the Information Report (May 11, 2009) from the District Manager, Licensing and Standards, to its November 10, 2009 meeting.

2.         Directed the District Manager, Municipal Licensing and Standards, to submit a further report, including:

a.         statistics on a ward-by-ward basis;

b.         statistics from the Emery Village BIA;

c.         a strategy to be implemented to re-align enforcement efforts in order to meet current priorities.

d.         how the current court case on the legalization of prostitution may affect the grandfathering of existing establishments in the Etobicoke York District, that may presently be involved in prostitution activities.

3.         Referred the following motion to the Licensing and Standards Committee:

The Licensing and Standards Committee recommends that:

1.         City Council request the Province of Ontario to direct the Alcohol and Gaming Commission of Ontario (AGCO) to make it mandatory that a liquor licence hearing be held for any liquor licence violation.

2.         City Council request the AGCO, effective immediately, to notify the City of Toronto of any liquor licence hearing pertaining to any establishments located within the City of Toronto.

3.         City Council lobby the Province of Ontario to issue liquor licences to the business owner and the owner of the property, as opposed to the current practice of issuing licences to the business owner alone.

The Etobicoke York Community Council at its meeting held March 26, 2009 requested the Director, Municipal Licensing and standards and Toronto Police Service, to report to its meeting on April 21, 2009, on the number of illicit activities that have been reported within the last two (2) years.

Etobicoke York Community Council:

1.         Approved the request for variance from the Toronto Municipal Code, Chapter 447, Fences to maintain an existing board on board wood fences with lattice on top and also the newly constructed portion, at the present heights, at 15 Jeff Drive.

This report is in response to an application by the owner of the property to maintain the existing board on board wood fence with lattice on top and also the newly constructed portion, at the present heights.  The fence is located in the rear yard and exceeds the 2 metre height permitted,  Toronto Municipal Code, Chapter 447, Fences by 0.34 metres.

Etobicoke York Community Council:

1.         Approved the request for a fence exemption at 197 Edenbridge Drive, subject to the following conditions:

a.         The tempered glass fence, guards and gates shall be installed in accordance with the Manufacturer’s and Engineer’s specification.

b.         The glass gates shall be self-closing and self-latching, and provided with a latching device installed on the pool side at a position that measured a total distance of 1.5 metres from the inside of the deck, over the top of the gate, to the latch on the pool side.

c.         The horizontal wood slat gate and fencing shall be constructed in the manner that they are not climbable.

d.         Should the neighbour’s 1.8 metres high metal fence behind the section of 50 millimetres mesh size chain link fence on the east side be removed, this nonconforming 17.8 metres long section shall be replaced immediately by a fence in compliance with Toronto Municipal Code, Chapter 447, Fences.

e.         The gate on the south side shall be provided with a self-closing and self-latching device and permanently locked;

f.          The rest of the pool enclosure as well as the landscaped garden shall be constructed in accordance with the Toronto Municipal Code, Chapter 447, Fences, and the Ontario Building Code.

g.         The existing temporary fence shall remain in place when the pool and ponds are filled with water, until the Fence Exemption is approved and the fence enclosure completed and inspected in accordance with Toronto Municipal Code, Chapter 447, Fences.

h.         Amended drawings shall be submitted and Fence Enclosure Permit to be obtained from Toronto Building Division.

This report is in response to an application made by the owner of the property for a fence exemption to install a 1.2 metres high tempered glass fence enclosure including fence, guardrails and gates of similar construction and a 1.8 metres high fence made up of horizontal wood slats above the deck, that separates the house from the swimming pool and fish ponds at the rear yard, and, maintain a 17.8 metres long section of 1.2 metres high chain link fence of 50 mm mesh size, together with a 1.5 metres high gated entrance made up of horizontal wood slats, on the east side of the property.

1.         Approved the request for a variance from Chapter 215, Signs, of the former City of Etobicoke Municipal Code, at 451 Attwell Drive, subject to:

a.         any annual licensing fees as required, including those fees as may be required under the new City-wide harmonized Sign By-law.

Toronto Building received a request from Rick Taddeo of Supersign Sigma Inc., on behalf of 1531206 Ontario Inc.  for approval of variances from Chapter 215, Signs, of the former City of Etobicoke Municipal Code to permit an installation of a double face illuminated third-party ground sign at 451 Attwell Drive.

Etobicoke York Community Council:

1.         Approved the request for a variance from Chapter 215, Signs, of the former City of Etobicoke Municipal Code, at 2 Paxman Road, subject to:

a.         any annual licensing fees as required, including those fees as may be required under the new City-wide harmonized Sign By-law.

Toronto Building received a request from Rick Taddeo of Supersign Vergo Inc., on behalf of Kroupa Holdings Ltd.  for an approval of variances from Chapter 215, Signs, of the former City of Etobicoke Municipal Code to permit an installation of a double face illuminated third-party ground sign at 2 Paxman Road.

Etobicoke York Community Council:

1.         Approved the request for a variance from the former City of North York Sign By-law 30788, as amended, at 1542 Jane Street, subject to:

a.         licensing fees as required, including those fees as may be required under the new City-wide harmonized Sign By-law.

2.         Directed the District Manager, Municipal Licensing and Standards, Etobicoke York District to investigate the illegal sign at 1546 Jane Street.

Toronto Building received a request from Elio Monaco of Monaco E.S.T. Holdings Ltd. owner of the building, for an approval of a variance from the former City of North York Sign By-law  30788, as amended, to permit the erection of one single face third party non- illuminated trivision roof sign, at 1542 Jane Street.

Etobicoke York Community Council:

1.            Refused the application to demolish the one-storey single family dwelling at 25 The Wishbone as there is no permit application to replace the buildings on the site.

On June 2, 2009, Toronto Building received a demolition permit application to demolish a one storey single family dwelling at 25 The Wishbone Toronto Building has not received a building permit application to replace the building to be demolished as of this date.

Etobicoke York Community Council:

1.         Approved the request for sign variance at 10 Meteor Drive, subject to the following:

a.         That the applicant be advised, upon approval of variances, of the requirement to obtain the necessary sign permit.

b.         That the owners remove the existing ground sign prior to the issuance of the permit for the roof sign.

c.         That MTO (Ministry of Transportation) approval will be required.

d.         That Greater Toronto Airport Authority (GTAA) approval will be required.

Toronto Building received a request from Lou Scheurmann, CEO of Doby Enterprises Inc. owner of the building, for approval of variance from Chapter 215, Signs, of the former City of Etobicoke Municipal Code to erect an Illuminated 10' x 20' Third Party Trivision Roof Sign mounted on an existing single storey industrial building and remove the existing ground sign on the front yard at 10 Meteor Drive.

Etobicoke York Community Council:

1.            Approved enacting a “No Parking Anytime” prohibition on the south side of Meteor Drive between a point 122 metres east of Carlingview Drive and a point 24 metres further east.

2.            Approved enacting a “No Parking Anytime” prohibition on the south side of Meteor Drive between a point 158 metres east of Carlingview Drive and a point 24 metres further east.

The purpose of this report is to propose the introduction of “No Parking Anytime” prohibitions on the south side of Meteor Drive near the two driveways that service No. 19 Meteor Drive.  These parking regulations are being recommended to facilitate access by trucks to No. 19 Meteor Drive and improve visibility for motorists exiting the subject driveways.  These parking regulations will maintain parking for 2 to 3 vehicles directly in front of No. 19 Meteor Drive.

Etobicoke York Community Council recommends that:

1.            City Council approve the installation of Pay and Display Machines on the south side of Dundas Street West between a point 30 metres west of Michael Power Place and Summerland Terrace (private road), to operate from 9:00 a.m. to 4:00 p.m., Monday to Friday, and from 9:00 a.m. to 6:00 p.m., Saturday, for a maximum period of 3 hours, at a rate of $1.00 per hour.

2.            City Council approve the installation of Pay and Display Machines on the south side of Dundas Street West between a point 45 metres west of Mabelle Avenue and a point 54 metres further west, to operate from 9:00 a.m. to 4:00 p.m., Monday to Friday, and from 9:00 a.m. to 6:00 p.m., Saturday, for a maximum period of 3 hours, at a rate of $1.00 per hour.

The purpose of this report is to obtain approval for the installation of  Pay and Display Machines on the south side of Dundas Street West on the sections between a point 30 metres west of Michael Power Place and Summerland Terrace (private road); and, between a point 45 metres west of Mabelle Avenue and a point 54 metres further west.  These machines will operate from 9:00 a.m. to 4:00 p.m., Monday to Friday, and from 9:00 a.m. to 6:00 p.m., Saturday, for a maximum period of 3 hours, at a rate of $1.00 per hour.

Etobicoke York Community Council recommends that:

1.            City Council approve the installation of a northbound left turn prohibition that applies between 7:00 a.m. and 9:00 a.m. and between 4:00 p.m. and 6:00 p.m., Monday to Friday, from Runnymede Road to Liverpool Street.

The purpose of this report is to respond to a request from residents of Liverpool Street to prohibit northbound left turns from Runnymede Road to Liverpool Street during the morning and afternoon peak periods.

Etobicoke York Community Council:

1.            Approved enacting a 40 km/h speed limit on Liverpool Street between Castleton Avenue and Runnymede Road.

The purpose of this report is to respond to a request from residents of Liverpool Street to address concerns about speeding on Liverpool Street.  Also requested was an all-way stop at the intersection of Castleton Avenue at Liverpool Street.

Etobicoke York Community Council:

1.            Approved the installation of Two additional speed humps be installed on Earlscourt Avenue between Ascot Avenue and St. Clair Avenue West; and

2.            Approved amending By-law # 602-89 and Drawing “No.421F-5079, July 1997” to include the installation of two additional speed humps as shown in drawing “No. EY09-125, September 2009.”

The purpose of this report is to amend the existing by-law authorizing the installation of speed humps on Earlscourt Avenue to accommodate two additional speed humps.

Etobicoke York Community Council:

1.         Approved the application to maintain the encroachments within the road allowances, subject to the following conditions:

a.         The City Solicitor be authorized to prepare an Encroachment Agreement for the proposed encroachments.

b.         The owner enters into an Encroachment Agreement with the City of Toronto and pays all fees associated with the preparation of the Agreement. Should an annual fee(s) be charged in the future, the owner shall be responsible for payment of the fees.

c.         The signed Agreement to be returned to the City with the required Certificate of Insurance, evidencing a third party bodily injury and property damage insurance in the amount of $2,000,000.00 or such other coverage and greater amount as the City may require, and naming the City of Toronto as an additional insured party under the policy. The Certificate of Insurance shall be renewed on an annual basis for the life of the encroachments.

d.         The maximum height of the gate shall be 1.83 metres (6 feet), with the maximum height of the close board wood fence being 1.27 metres (4 feet, 2 inches). Posts exceeding the 1.27 metres shall be cut to the approved height by October 31, 2009.

This report is in regard to an application submitted by the owner of the property for an Encroachment Agreement at 72 Goodwood Avenue, for permission to maintain an existing close board wood fence measuring 66.44 square metres and retaining wall within the Boon Avenue west flankage and existing front steps measuring 6.0 square metres, two columns and retaining wall within the Goodwood Avenue front yard road allowance.

Etobicoke York Community Council:

1.         Approved the application for an Outdoor Patio License Agreement, subject to the following conditions:

a.         The City Solicitor to be authorized to prepare an Outdoor Patio License Agreement for the proposed encroachment.

b.         The applicant to pay all fees associated with the preparation of this agreement, and an annual fee to be paid to the City of Toronto for the use of the road allowance in the amount of $11.00 per square metres, plus GST. All fees are subject to change.

c.         Comply at all times with regulations set out in the former Metropolitan Toronto By-law 41093, as amended.

d.         The signed agreement to be returned to the City along with the required  Certificate of Insurance, evidencing a third party bodily injury and property damage insurance in the amount of Two Million Dollars ($2,000,000.00) or such other and greater amount as the City may require, and naming the City of Toronto as an additional insured party under the policy.

e.         The said Certificate of Insurance to be renewed and a copy thereof submitted to Municipal Licensing and Standards on an annual basis for the life of the encroachment.

f.          The applicant to operate the boulevard café in compliance with the requirements of Municipal Code, Chapter 591, Noise.

g.         The outdoor boulevard café only to be licensed for seasonal use, between the period of May 1st to October 31st and the patio furniture and fence to be removed from the municipal boulevard at the end of the season.

To report on an application submitted by the new business owner to maintain/transfer an existing Outdoor Patio License Agreement to lease 9.85 square metres of the municipal boulevard for the purposes of an outdoor café at 4906 Dundas Street West, operating under the name “Ristorante Da Noi”.

Etobicoke York Community Council directed that:

1.            City Planning staff schedule a community consultation meeting together with the Ward Councillor regarding the Mimico 20/20: Revitalization Action Plan Proceedings Report and recommendations contained in the Mimico-By-The-Lake Implementation Action Memo prepared by Urban Strategies Inc.

2.            City Planning staff in consultation with the local councillor, issue the appropriate notices for the community consultation meeting.

3.            Notice for the public meeting under the Planning Act regarding a Final Report on this matter be given according to the regulations under the Planning Act.

On September 13, 2006, Etobicoke York Community Council requested the Director, Community Planning, Etobicoke York District to report on the next steps involved in implementing “Mimico by the Lake Project 20/20: A Perfect Vision for our Community”. Since then, Planning staff has convened three major public consultation exercises, including a 4-day Charette in April 2009, led by consultants Urban Strategies Inc.  The project is now prepared to proceed to the final implementation phase. 

Etobicoke York Community Council:

1.            Approved the installation of four speed humps on The Kingsway; two south of Government Road, and two north of Bloor Street West.

2.            Approved the reconfiguration of the intersections of Usher Avenue, Kingsgrove Boulevard and Kingsway Crescent, as shown on drawing No. Y09566, Y09564 and Y09563.

3.            Approved the reduction of the speed limit on The Kingsway between Government Road and Usher Avenue and between Bloor Street West and King Georges Road from 40 km/h to 30 km/h.

4.            Directed that the City Solicitor prepare the necessary by-laws to alter sections of the roadway on The Kingsway between Government Road and Bloor Street West , for traffic calming purposes, generally as shown on the attached print drawing No. EY08-178, dated June 2008 (Map 2).

Councillor Hall requested that the recommendations be voted on separately.

This staff report is about a matter for which Community Council has delegated authority from City Council to make a final decision.

The purpose of this report is to present the recommendations arising from ongoing discussions with the residents of The Kingsway Neighbourhood which mitigate concerns raised by residents of the neighbourhood as whole, with respect to the installation of twelve (12) speed humps on The Kingsway between Bloor Street West and Government Road.

The recommendations were reached through an extensive public consultation process which included the creation of a Residents Working Group and involves the installation of four (4) speed humps and the modification and improvement of three intersections on The Kingsway, including Usher Avenue, Kingsgrove Boulevard and Kingsway Crescent.  In conjunction with the speed hump installation, the speed limit on the sections of roads affected will be reduced from 40 km/h to 30 km/h.

Etobicoke York Community Council :

1.            Approved the request for variance from Chapter 215, Signs of the former City of Etobicoke Municipal Code, at 5515 Eglinton Avenue West.

2.            Advised the applicant, upon approval of variances, of the requirement to obtain the necessary sign permit.

Toronto Building received a request from Domenic Rotundo for Teksign Inc., for the owners Bayview Heritage Group (BHG), to the attention of Debbie Scriver for approval of variance from Chapter 215, Signs, of the former City of Etobicoke Municipal Code to erect Four (4) Illuminated First Party Fascia Signs for "Homewood Suites" and "Hampton Inn", that will be located on the east and west elevations of the hotel at 5515 Eglinton Avenue West.

Etobicoke York Community Council recommends that:

1.            City Council approve the widening of Caledonia Road, from a width of approximately 8.7 metres to a width of about 11.7 metres by the construction of a lay-by on the west side of Caledonia Road, from a point 6.8 metres south of Lambert Avenue to a point 13.9 metres further south, generally as shown on the attached drawings.

2.            City Council approve rescinding the “No Stopping, 7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m., except Saturday, Sunday and Public Holidays” regulation on both sides of Caledonia Road from St. Clair Avenue to the north City limits.

3.            City Council approve enacting a “No Stopping, 7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m., except Saturday, Sunday and Public Holidays” regulation on the east side of Caledonia Road from St. Clair Avenue to the former City of Toronto north City limits.

4.            City Council approve enacting a “No Stopping, 7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m., except Saturday, Sunday and Public Holidays” regulation on the west side of Caledonia Road from St. Clair Avenue to 20.7 metres south of Lambert Avenue.

5.            City Council approve enacting a “No Standing, 7:00 a.m. to 12:00 midnight” regulation on the west side of Caledonia Road from 6.8 metres south of Lambert Avenue to 13.9 metres south thereof.

6.            City Council approve enacting a “No Stopping, 7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m., except Saturday, Sunday and Public Holidays” regulation on the west side of Caledonia Road from Lambert Avenue to the former City of Toronto north City limits.

The purpose of this report is to recommend the enactment of a highway alteration by‑law and a corresponding designated loading zone for the installation of a lay-by facility on the west side of Caledonia Road south of Lambert Avenue to provide an area adjacent to the traveled portion of the road for vehicles, especially Wheel-Trans vehicles, picking up/dropping off visitors to the First Portuguese Canadian Cultural Club located at 60 Caledonia Road.

Etobicoke York Community Council:

1.         Withdrew the motion at the request of Councillor Cesar Palacio.

The owner of 192 Glenholme Avenue is requesting front yard parking.

1.         Directed the General Manager of Parks, Forestry & Recreation, to report to its November 10, 2009 meeting with a recommendation on renaming the park in Ward 12, Green Hills Park.

During a meeting of the Green Hills Residents Association a request was made to name the small park at Paulson Road and King Georges Drive, Green Hills Park.

1.         Directed the Director, Community Planning, Etobicoke York District to review the issue of widened driveways within the above-noted subdivision to determine the extent of non-compliance with zoning regulations, and report on the non-compliance issue within the subject subdivision and on appropriate or additional measures in the subdivision approval process and assumption process that would prevent similar outcomes from recurring, in consultation with appropriate staff including Municipal Licensing and Standards and Transportation Services staff.

1.         City Council authorize the City Solicitor to retain outside planning consultations and to attend the Ontario Municipal Board hearing against the decision of the Committee of Adjustment (A11/09EYK) for 435 Westmoreland Avenue.

The purpose of this report is to review and make recommendations on a request by      Dominic Rotundo, of Pattison Sign Group, on behalf of Lou Vavacoutson, president of Ontario 1654316 LTD., for an approval of variances from sign By-law 3369-79, of the former City of York, to permit installation of the building at 2595 St. Clair Avenue West.

 Etobicoke York Community Council:

1.         Directed the Director, Community Planning, Etobicoke York District, and the Director of Transportation Services, Etobicoke York District, to report to its November 10, 2009 meeting on the driveway widths for townhouse units with double garages, and on street parking issues on Mendota Road, Gala Lane, and Dalesford Road, abutting the Berkely Developments townhouse site.

A report by City staff addressing driveway widths leading to double car garages and on street parking provisions on the abutting public streets should be prepared for Etobicoke York Community Council consideration at the November 10, 2009 meeting.
