The Licensing and Standards Committee again deferred consideration of this item until its meeting on March 10, 2010.

The purposes of this report are three-fold:  to consider a fairness protocol for the removal of street vendors when the City requires them to vacate their permitted vending location; to determine the feasibility of establishing a threshold system similar to the taxi industry; and in consultation with the City Solicitor, to review the process for the City rescinding and not renewing street vending permits on an annual basis.

Additionally, staff was asked to report back on modifications to the moratorium in Wards 20, 27, and 28 so as to allow for the receipt of applications for the re-issuance of vending permits that are returned or not renewed by existing vendors in the area bounded by the moratorium, to maintain the number of existing vending locations in those Wards.

The City Solicitor, Technical Services, the Toronto Transit Commission (TTC), Transportation Services – Street Events Unit, as well as the Street Food Vendors’ Association was consulted in the preparation of this report.

The Licensing and Standards Committee recommends that:

1.         City Council amend the City of Toronto Municipal Code, Chapter 545, Licensing, to remove the requirement for coffee truck drivers who drive City licensed mobile catering (coffee truck) vehicles to be licensed by the City.

2.         City Council amend the City of Toronto Municipal Code, Chapter 545, Licensing, to require that licensed coffee truck owners ensure that the drivers of Toronto licensed coffee trucks be trained and certified as food handlers in a manner satisfactory to Toronto Public Health.

3.         City Council authorize and direct all other appropriate City officials to take the necessary actions to give effect thereto.

To report on a review of the regulatory provisions found in the City of Toronto, Municipal Code, Chapter 545, Licensing, regarding the mobile catering industry, as they pertain to licensed coffee truck owners and drivers in the City of Toronto.

The Licensing and Standards Committee recommends that:

1.         City Council receive the report (December 14, 2009) from the Executive Director, Municipal Licensing and Standards for information only.

The purpose of this report is to examine the feasibility of providing child restraint seats in taxicabs to clients who request them; and to consider ways in which the City of Toronto could encourage taxicab brokerages and taxicab operators to make vehicles with child restraint seats available to the travelling public.

Child safety in cars is not new.  Child safety restraints include seat belts, booster seats and child seats, and are a highly effective way of reducing serious and fatal injuries to children.  However, despite the City’s desire for children to be safely restrained while travelling in taxicabs, several factors impede the overall goal of child safety in Toronto licensed taxicabs.

This report was prepared in consultation with the taxicab and limousine industries.

The Licensing and Standards Committee:

1.         Referred Recommendations 1-3 in the report (December 17, 2009) back to the Executive Director, Municipal Licensing and Standards for further consideration with a request to report back to the Committee at its meeting on April 29, 2010.

2.         In the interim, requested that a Working Group comprised of City staff from Municipal Licensing and Standards, Legal Services, Corporate Access and Privacy Office and representatives from the Toronto Police Service be established to review what further amendments to the City of Toronto Municipal Code Chapter 545, Licensing, concerning the collection of personal information are appropriate under the powers provided to the City of Toronto under the City of Toronto Act, 2006, and the IPC's Privacy Guidelines for Municipalities regulating Businesses Dealing in Second-Hand Goods; and

3.         Requested the Working Group to report back to the Licensing and Standards Committee, with draft amendments to City of Toronto Municipal Code, Chapter 545, Licensing.

This report addresses the issues raised by the Information and Privacy Commissioner of Ontario (IPC) regarding municipal by-laws which require the collection, recording and production of personal information from sellers of goods to Toronto licensed second-hand and salvage yard dealers.

This report recommends that the provisions in the City of Toronto Municipal Code, Chapter 545, Licensing, as they relate to second-hand dealers, salvage yard dealers and dealers in old gold and other precious metals and jewellery, be amended to bring the Code into compliance with the Order issued to the City of Ottawa by the IPC and the more recent complaint filed with the IPC regarding the City of Toronto.

The Licensing and Standards Committee recommends that:

1.         City Council amend the City of Toronto Municipal Code, Chapter 441, Fees to change the fee for inspection services to reflect a $94.00 one-hour minimum with additional hours charged at a rate of $55.00 per hour or part thereof, per Municipal Standards Officer, per inspection where by-law violations have not been remedied beyond the date of compliance set out in any Order or Notice of Violation issued by a Municipal Standards Officer; and

2.         City Council direct the City Solicitor to prepare the necessary bill to give effect to the recommendation in this report.

The purpose of this report is to amend Municipal Code, Chapter 441, Fees, to change the fees for property standards inspection services, where by-law violations have not been remedied beyond the date of compliance set out in any Order or Notice of Violation issued by a Municipal Standards Officer.

Currently, the fee is $60 per hour, with a one-hour minimum. Municipal Licensing and Standards (ML&S) has reviewed the current cost of providing these inspections, and a $94 one-hour minimum with additional hours charged at a rate of $55 per hour or part thereof, per Municipal Standards Officer, per inspection more accurately reflects a cost recovery model.

It is expected that the new fees will take effect February 1, 2010.

The Licensing and Standards Committee recommends to City Council:

1.         That the City of Toronto strongly support the Private Member's Bill 238 - An Act to Amend the Liquor Licence Act with Respect to Weapons on Licensed Premises tabled by MPP Mike Colle; and

2.         That the City Clerk relay this information to the Government of Ontario and the leaders of the Progressive Conservative Party of Ontario and the New Democratic Party of Ontario.

Requesting the Licensing and Standards Committee to support proposed amendments to Bill 238 - An Act to amend the Liquor Licence Act with respect to weapons on licensed premises.

The Licensing and Standards Committee referred this item to the Animal Services Reference Working Group with the request for a report to be submitted to the Licensing and Standards Committee at a future meeting.

Request to address the Licensing and Standards Committee on the matter of providing an exemption from having to pay pet licensing fees for persons receiving support from the Ontario Disability Support Program (ODSP) or on fixed income. 

The Licensing and Standards Committee referred this item to the Executive Director, Municipal Licensing and Standards for consideration with the request to submit a report together with the comprehensive report on this issue to the March 10, 2010 meeting of the Committee.

Referring communication from the Adult Entertainment Association of Canada, among other matters, requesting clarification on the definition of prohibited activity.

The Licensing and Standards Committee:

a.         referred the motion (December 8, 2009) from Councillor Giorgio Mammoliti to the Executive Director, Municipal Licensing and Standards for consideration with a request to submit a report to its March 10, 2010 meeting; and

b.         requested that staff attempt to review the licensed holistics discipline as a separate entity.

Requesting the Executive Director, Municipal Licensing and Standards to report on issues related to licensed and unlicensed holistic centres and body rub parlours.
