Transportation Services Division, North York District recommends that City Council:

 

1.         Authorize the Transportation Services Division to conduct a 2 year Pilot Project commencing in 2011within Ward 15 to address the situation relating to illegal and unlicensed Front Yard Parking within the area bounded by Eglinton Avenue to the south, Dufferin Street to the west, Hopewell Avenue to the north and Marlee Avenue to the east and that the Transportation Services Division report to City Council the results of the Pilot Project in 2012.

 

2.         Authorize an exemption to Chapter 918-1 Definitions of the Toronto Municipal Code for the purpose of this Pilot Project where a parking pad in the area identified in Recommendation 1, has utilized a “Green Alternative” as outlined in Attachment 2, that the parking pad be considered as soft landscaping for the purpose of calculating the Landscape Open Space and Soft Landscaping requirements of the Code.

 

3.         Amend for the purpose of the Pilot Project, the requirement for polling for an application for front yard parking, as outlined in Chapter 918-14B, Polling of the Toronto Municipal Code, such that a petition and poll of the neighbourhood would not be required for the purpose of an application within the area identified in Recommendation 1.

Since this report recommends an exemption to an existing City By-law, approval resides with City Council.

 

To report on a request to authorize a Pilot Project and a Ward specific exemption to Chapter 918 of the Toronto Municipal Code to address the long standing illegal and unlicensed front yard parking situation existing in Ward 15.

Summary

The report requests that City Council deny the request to remove a privately-owned tree, located at the rear of 34 and 36 Sawley Drive. The owner of 36 Sawley would like to remove the tree to allow for construction of a fence between 34 and 36 Sawley Drive. The owner of 36 Sawley has also stated that the tree is too close to the house at 36 Sawley Drive.

 

The tree in question is a 48 cm diameter Silver maple in good condition. With proper care and maintenance, the tree should continue to provide benefits to the community for many years, and should be incorporated into any plans for the construction of a property line fence. Urban Forestry cannot support removal of this tree due to its viable condition.

3.         Approve the applications to demolish the subject buildings with the following conditions:

 

i.          that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official;

On May 6, 2010, Sayf Hassan of Symmetry Developments Inc, the owner of the properties at 2952, 2954, 2955 and 2958 Bayview Avenue, submitted applications for the demolition of four one storey dwellings located at the above addresses. The owner wishes to demolish the four vacant dwellings in advance of receiving building permits for replacement buildings.

Request for Inclusion on City of Toronto Inventory of Heritage Properties – 79 Dawlish Avenue

Recommendations

Councillor Jenkins recommends that:

 

1.         North York Community Council recommend to City Council, the inclusion of 79 Dawlish Avenue on the City of Toronto Inventory of Heritage Properties.

Summary

With its steeply-pitched roof and pointed dormers evoking French-Canadian architecture styles, 79 Dawlish has a distinctive and much-admired presence in Lawrence Park.

 

Built in 1928, it was designed and occupied by the notable architect Forsey Page who lived there until 1933. Page, with various partners, designed a number of houses in Lawrence Park, and the firm Page and Steele designed many landmark Toronto buildings including the Garden Court Apartments on Bayview, Benvenuto Place, and Commerce Court.  Page served as president of both the Ontario Association of Architects and the Royal Architectural Institute of Canada.

The property is included in the Toronto Public Library Board’s Historical Walking Tour of Lawrence Park, 2007.

 

This property has cultural heritage value and contributes significantly to the character of the Lawrence Park area.  Inclusion on the City of Toronto heritage inventory would enable staff to monitor the property and be advised of any request for a demolition permit.

 

The Toronto Preservation Board at its meeting on May 28:

 

·           Endorsed the nomination of several properties in Lawrence Park, including 79 Dawlish, as candidates for designation under the Ontario Heritage Act, and

·           Requested the Acting Manager, Heritage Preservation Services to prioritize the review of 79 Dawlish Avenue.

 

The North York Community Preservation Panel (NYCPP) passed a resolution requesting designation of 79 Dawlish Avenue under the Ontario Heritage Act at its May 17 meeting.

Additional documentation with respect to the architectural and historical value of the 79 Dawlish property is attached, inlcuding:

 

·           a recent photograph

·           several photographs from the January 1929 article in Canadian Homes and Gardens

·           photos of several architectural drawings from the North Toronto Historical Society Archives

Summary

The following report responds to a Notice of Motion introduced by Councillor Moscoe, and adopted by North York Community Council, at its meeting of March 9, 2010 as     Item NY32.54.   Item NY32.54 requests that the appropriate staff report on the potential authorization, including possible conditions to be imposed in connection with the authorization, of a Third Party Sign on the former beltline railway bridge, now a pedestrian bridge, which crosses Dufferin Street, south of Roselawn Avenue (the "Beltline Bridge") as shown on Appendix “A”.  Item NY32.54 also requests a report on the matter of an existing specific Third Party Sign within the immediate vicinity of the Beltline Bridge.

The application proposes to redesignate and rezone a number of properties owned by the Toronto Community Housing Corporation (TCHC) to permit the first phase of the redevelopment of the Lawrence Heights neighbourhood.  The application proposes the demolition and replacement of 233 existing affordable rental housing units, as well as the construction of an additional 1,046 market housing units on the subject lands. 

 

The residential units are proposed to be a mix of three-storey freehold townhouses and mid-rise apartment buildings of 6 to 12 storeys in height with townhouses at grade.  A limited number of non-residential uses are proposed at the intersection of Ranee Avenue and Allen Road in the base of the proposed mid-rise apartment buildings across from the Yorkdale Subway Station.  The application also proposes a reconfigured street network and a 1.1 hectare public park.

 

This report provides preliminary information on the above-noted application and seeks Community Council's directions on further processing of the application and on the community consultation process. 

 

It is intended that the community consultation process begin with a general community consultation meeting to be scheduled in consultation with the Ward Councillor, with subsequent consultation to occur via focused working groups.  Separate applications have been made under Section 51 of the Planning Act for Draft Plan of Subdivision approval and under Section 111 of the City of Toronto Act for permission to demolish rental housing.  These applications will be reviewed concurrently.  A Final Report and Public Meeting under the Planning Act and City of Toronto Act are required for all three applications. These applications will come forward for Council’s consideration once the financial strategy for the Lawrence-Allen Revitalization Plan has been approved by City Council.

Summary

This report reviews a Zoning By-law Amendment application to permit the temporary use of the subject lands for the parking of cars and trucks associated with the adjacent land owner (UPS Canada). The lands are designated Transit Transition by Official Plan Amendment No. 620 (Steeles Corridor – Jane to Keele) in the City of Vaughan’s Official Plan and are zoned C1 Restricted Commercial Zone and EM1 Prestige Employment Area Zone in Vaughan’s Zoning By-law.

 

A 1974 Agreement with York Region sets out a process for the City and York Region to mutually circulate Official Plan Amendment, Zoning By-law Amendment and subdivision approval applications on lands adjacent to Steeles Avenue for review and comment.

 

City Planning is currently developing an updated protocol with neighbouring municipalities with respect to the circulation and commentary of development applications that abut the City of Toronto. City Planning staff will report back on the protocol after further meetings have been held.

1.         Amend Recommendation 1 of the February 17, 2010 Final Report from the Director, Community Planning, North York District, so that it now reads as follows:

 

a.         Amend the Official Plan substantially in accordance with the proposed Official Plan Amendment attached as Attachment No. 2, with the following amendments:

a.         the conditions as generally listed in Attachment 2, which except as otherwise noted must be fulfilled prior to the release of the plan of condominium for registration; and

 

b.         any such revisions to the proposed condominium plan or any such additional or modified conditions as the Chief Planner may deem to be appropriate to address matters arising from the on-going technical review of this development.

 

2.         City Council enact a Part Lot Control Exemption By-law with respect to the subject lands, to be prepared to the satisfaction of the City Solicitor and to expire two years following enactment by City Council.

Summary

These applications were made on February 18, 2010 and are subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.  The provisions for Draft Plan of Common Elements Condominium require that a statutory public meeting be held.

 

The application for a common elements condominium proposes a common driveway on lands  municipally known as 4442 - 4450 Bathurst Street, located on the west side of Bathurst Street, north of Sheppard Avenue West.  The common elements condominium is required to provide legal vehicular access to eight, 3-storey residential townhouse units and to ensure shared ownership and maintenance of the driveway by the condominium corporation.

1.         City Council endorse in principle the Lawrence Allen Revitalization Plan (LARP) as attached to this report.

 

2.         The Deputy City Manager and Chief Financial Officer and Revitalization Secretariat develop a financial strategy for LARP in coordination with the General Manager of Transportation Services, General Manager of Toronto Water, General Manager of Parks, Forestry and  Recreation, General Manager Children’s Services, Chief Planner and Exective Director of City Planning, Executive Director of Technical Services, Executive Director of Social Development, Finance and Administration,  Director of Financial Planning, City Managers Office, the Affordable Housing Office and the Toronto Transit Commission and Toronto Public Library Board in coordination with Toronto Community Housing.

 

3.         The Deputy City Manager and Chief Financial Officer and Revitalization Secretariat report back on a LARP financial strategy to support the area’s revitalization at the same time as the Chief Planner and Executive Director of City Planning brings forward a new Secondary Plan for the Lawrence Allen area based on the Lawrence Allen Revitalization Plan (LARP).

 

4.         The General Manager of Transportation Services initiate the Allen Road Individual Environmental Assessment Study Terms of Reference before the end of 2010.

 

5.         This report be forwarded to the Toronto District School Board (TDSB) for its consideration and to request that the TDSB coordinate its land holdings and redevelopment initiatives to support the direction and phasing of the LARP.

 

6.         This report be forwarded to the Toronto Catholic District School Board (TCDSB) for its consideration and to request that the TCDSB coordinate its new school initiatives to support the direction and phasing of the LARP.

 

7.         The General Manager of Parks, Forestry and Recreation in coordination with City Planning and Transportation Services undertake a Parks and Public Realm Master Plan for the Lawrence-Allen area in 2011 and include the study in their 2011 Capital budget submission within their specified debt target. 

 

8.         The Director of Real Estate Services and the City Solicitor, in consultation with other appropriate City divisions, develop a real estate strategy to address the City’s interests and work with the Toronto District School Board, Toronto Community Housing and other landowners as appropriate, to support the implementation of the LARP.

 

9.         The TTC expedite the completion of the station studies for both the Yorkdale  and Lawrence West stations and develop a short and longer term transit strategy that addresses both surface and subway station improvements required to support the LARP and report back to City Council in the second quarter of 2011.

 

10.       The General Manager of Transportation Services include the short-term Lawrence-Allen capital improvements to the Lawrence-Allen intersection, pedestrian crossing at Yorkdale and the Allen Rd. and the underpass at Ranee Rd. in the Transportation Services 2011 Capital Budget and 2012 to 2020 Capital Plan submission, within the specified debt affordability targets, in an amount not to exceed $2.35 million.

Summary

The Lawrence Allen Revitalization Plan (LARP) is a 20-year plan for the evolution of the Lawrence-Allen area and the Lawrence Heights neighbourhood that is at its core.  It articulates a vision for the area, lays out a new physical plan and recommends short

term and long term directions for a Secondary Plan.  It suggests implementation tools to establish a comprehensive planning framework for the Lawrence-Allen Area.

 

This plan is the outcome of nearly two years of coordinated planning study by the City of Toronto, Toronto Community Housing Corporation, and Toronto District School Board.  It addresses a study area bounded by Lawrence Avenue West, Bathurst Street, Dufferin Street, and Highway 401 with particular focus on a 75 hectare area encompassing Toronto Community Housing’s Lawrence Heights neighbourhood and the lands which are interwoven with it.  The Lawrence-Allen Revitalization Plan is not attached to this report but can be accessed at www.toronto.ca/lawrenceallen.htm.

 

The plan describes a mixed-income, mixed-use neighbourhood which is park-centred, transit-supportive, and well integrated with the broader city.  Through public and private reinvestment, it provides for the replacement of all 1,208 existing social housing units along with 5,500 to 6,300 new market units.  Combined with this is a doubling of public parkland, new schools, community facilities and retail opportunities.

 

Over a multi-phase, twenty year implementation period, order of magnitude costs for the public infrastructure of the plan are estimated at about $240.605 million.

Financial Impact

The Lawrence Allen Revitalization Plan (LARP) will lay the foundation for a major building initiative in the City.  The anticipated scale of change in this area resulting from the LARP is significant.  The plan provides a vision for the area over the next twenty years and redevelopment will occur through a series of phases.  The LARP lays out a new physical plan including the full replacement of all 1,208 social housing units within TCHC's Lawrence Heights community and the integrated development of market housing within the study area.

 

In addition to the housing development, significant reinvestment in City infrastructure and community facilities will be required.  Preliminary order of magnitude costs for the infrastructure have been developed to inform a future financial strategy to implement the LARP as recommended in this report.  The estimated costs of City infrastructure such as roads, sewers, and community facilities such as parks, libraries and child care centres is approximately $240 million in constant 2010 dollars.

 

All preliminary servicing (roads and water) infrastructure order of magnitude costs are based on the following cost assumptions:

 

-           Based on 2010 dollars;

-           Include a 15% engineering fee;

-           Include a 30% contingency;

-           Include the removal of existing municipal infrastructure;

-           Exclude the removal, replacement, relocation and installation of utility infrastructure;

-           Exclude all applicable taxes.

 

It should be noted that the order of magnitude costs are preliminary and must be reviewed in conjunction with the City’s 2011 Capital Budget and 2012 to 2020 Capital Plan.  They do not include ongoing operating and maintenance costs once new infrastructure is completed and exclude other related projects in the area, such as major improvements to Allen Road and TTC transit station improvements. Furthermore, the cost of acquiring and remediating additional parkland where possible to improve parkland provision in the area is also not included in the order of magnitude estimate.

 

Included in this estimate are certain short term capital deficiencies in the order of $2.35 million that may be examined independent from the overall study. These include improvements to the Lawrence and Allen Road intersection, the Ranee Avenue Underpass and the Yorkdale and Allen Intersection.  Transportation Services will include funding for these improvements in their 2011 Capital Budget and 2012 to 2020 Capital Plan submission, in an amount not to exceed $2.35 million, within their debt affordability target.  As these improvement estimates are preliminary, should costs exceed $2.35 million, the General Manager of Transportation Services may request additional funding, as long as the funding can be accommodated within the Transportation 10-year debt affordability targets.  In addition, the General Manager of Parks, Forestry and Recreation will include the costs for the Public Realm Master Plan within the program 2011 Capital Budget submission, within specified debt target limits.

The financial strategy report will address the costs in greater detail and identify possible sources of funds between the City (including rate supported programs and Development Charges), TCHC, and other orders of government.
