1. Approved the application for an encroachment agreement for 236 Hillhurst Boulevard, subject to the following conditions:
a. that the owner have a locate done for the Bell Canada line in the area and hand dig within 1 metre of any Bell plant;
b. that the owner enter into an Encroachment Agreement with the City, to the satisfaction of the City Solicitor and the Executive Director of Municipal Licensing and Standards;
c. that the appropriate City Officials be authorized to take the necessary action to give effect thereto;
d. that no claims will be made against the City by the owner for damages occurring to the area of the encroachment or its elements during snow removal;
e. the indemnification to the City by the owner of the encroachment for all liability relating in any way to the encroachment and providing of an insurance policy for such liability for the lifetime of the Agreement in a form as approved by the City Solicitor, in an amount no less than $2,000,000.00 or such greater amount as the City Solicitor may require;
f. that the life of the Agreement be limited to 10 years from the date of registration on title or to the date of removal of the encroachment at which time, the City may consider the Agreement for further extension, if requested by the applicant;
g. in the event of sale or transfer of the property abutting the encroachment, Legal Services be authorized to extend the Encroachment Agreement to the new owner, subject to the approval of the Executive Director of Municipal Licensing and Standards; and
h. the owner pay all applicable fees. |

Specifically, adjacent to the TTC parking lot from Allen Road to Wilson Heights Boulevard on the north side of Wilson Avenue, on the west side of Wilson Heights Boulevard on the north side of Wilson Avenue to a point in alignment with the centreline of Ansford Avenue, and across the frontage of the TTC parking lot from the Allen Expressway to the northwest corner of the applicants property on the south side of Wilson Avenue; and
ii. replacement of asphalt with decorative concrete or unit pavers in the boulevard along Wilson Avenue beyond the subject property where opportunities exist in the locations identified in i. above;
b. a cash contribution of $150,000 or 0.5%, whichever is greater, for an on-site public art installation under the Percent for Public Art Program; and
c. a cash contribution of $400,000 for recreational capital facilities in Ward 10, the specific expenditure of these funds is to be determined through discussions between the Ward Councillor, Parks, Forestry and Recreation staff, City Planning staff and other City Divisions as required.
4. City Council require that direct pedestrian access be provided from the property to the adjacent commuter parking lot, subject to the location being determined by staff in consultation with the local Councillor, and that the condominium corporation maintain the portion of the direct access on their lands and the City maintain the portion of the direct access on City land.
5. City Council require that the building be subject to the TTC Transit Pass Policy.

The area residents on the north side of Coldstream Avenue from Bathurst Street to Glenmount Avenue, have expressed concern that vehicles parked on north side of the roadway between 519 and 527 Glenmount Avenue restricts two way traffic flow and access to the residential driveways.
Currently parking on Coldstream Avenue between Bathurst Street and Glenmount Avenue is permitted for maximum periods of three hours on the south side of and parking is prohibited at anytime on the north side. It should be noted that angle parking is provided on the south side the roadway from Bathurst Street to 519 Glenmount Avenue for the area residents. A municipal sidewalk is located on the south side of the roadway.
Transportation Services Division staff have confirmed that when vehicles are parked on the north side of the road two-way traffic is restricted, particularly for large vehicles including emergency services and other service vehicles. In addition, the pavement width of the roadway between 519 and 527 Coldstream Avenue is narrower then the pavement width adjacent to the angle parking, thus creating a bottleneck in the roadway. In this regard Staff has indicated their support to install No Parking Anytime prohibitions on the south side of Coldstream Avenue, from Glemount Avenue to a point 80 metres east thereof.
The installation of parking restrictions on the north side of Coldstream Avenue will improve both the flow of two-way traffic and the pedestrian environment.
It should be noted that all costs associated with the amendments of parking regulations will be included within the Transportation Services Division’s 2010 Operating Budget estimates. |

Summary |
City Council at its meeting of July 16, 17, 18 and 19, 2007 authorized the Chief Planner to begin the development of a Vision and Planning Framework for the Lawrence Heights community. In response, the City Planning Division commenced the Lawrence-Allen Revitalization Study in 2008 to determine a comprehensive planning framework for the Lawrence-Allen area, including Lawrence Heights, and has scheduled a community open house on February 25, 2010 to present an emerging preferred plan to the public.
Toronto Community Housing Corporation (TCHC) is preparing applications to amend the Official Plan and the Zoning By-law for the first phase of redevelopment of Lawrence Heights with a mix of uses and a mix of non-profit housing. While the redevelopment will be exempt from planning application fees associated with non-profit housing, the fees will apply to the portion of the redevelopment that comprises market housing.
At this time, the gross floor area in the redevelopment to be dedicated to non-profit housing versus market housing is not known. As a result, the planning application fees to be charged cannot be accurately quantified. |

On October 29, 2009, the Committee of Adjustment (COA) – North Panel – issued a decision approving these minor variances for a new two-storey dwelling at 246 Holmes Avenue.
The Committee approved three minor variances, one with respect to a building length of 17.07m, and two variances for reductions in the east and west side yard setbacks to 1.0m. On November 17, 2009, the ward councillor appealed the decision to grant variances for the two side yards to the Ontario Municipal Board, on the ground that the proposed side yards are contrary to the intent of the zoning by-law and out of keeping with the character of the neighbourhood.
Based on discussions with the applicant, the applicant has advised that it is prepared to withdraw its request for minor variances to the east and west side yards.

On October 1st, 2009, the Toronto City Council voted against the application by Cadillac Fairview for Phase II of the Don Mills Centre Redevelopment. One of the main issues Councillors had with the development was the proposed densities on the properties which were in the range of 4.2 times coverage and 4.6 times coverage. The proposed densities and heights were similar to those approved along the subway line around Sheppard Ave. Cadillac Fairview appealed to the Ontario Municipal Board (“OMB”), and a seven-week hearing is scheduled for April 2010.
Recently, I was informed that an agreement was reached with the Provincial Facilitator between the City, Cadillac Fairview, Friends of Don Mills and DMRI.
This matter may be the subject matter of a report to be presented at the next meeting of City Council. This report may be presented as an “in camera” matter.
Given the importance this development will have on the Don Mills Community, the terms of any proposed Settlement must be made public.
