Whereas, the applicant requested that the City grant variances from the Sign By-law in order to permit the display of a third party advertising sign on the property known municipally as 135 Fenelon Drive; and
Whereas, the applicant has agreed to allocate a portion of the revenue of the third party advertising sign to energy improvements and to community improvements;
Therefore, I move that the variance, as requested from the applicant, be granted subject to the following conditions:
1. That thirty percent (30%) of the ongoing gross revenue of the sign collected from the advertising company or the owner of the building, (whichever is greater) be applied to implement the energy improvement program set out in the “Energy Audit and Performance Modeling Report” prepared with respect to the property at 135 Fenelon Drive prepared by Halsall and Associates on December 8, 2009.
2. That upon the completion of the energy improvement program the thirty percent (30%) of the gross revenue of the sign that had been allocated to the energy improvement program be directed to community improvements in the ward of the local councillor, with the community improvement selection to be made in consultation with the Ward Councillor.
3. In the event that the property owner fails to comply with and/or to continue to comply with both conditions 1 and 2 above, at the sole discretion of the City, the variance and any sign permit issued in accordance with that variance shall expire.
4. That City officials shall provide periodic updates on the applications of these funds. |

North York Community Council recommends that:
1. City Council support the proposed modifications to the draft Official Plan Amendment that was previously presented to the Ontario Municipal Board, generally as shown in the draft Official Plan Amendment contained in Attachment No. 10 to the report (February 16, 2010) from the Director, Community Planning, North York District, and authorize the City Solicitor and necessary City staff and consultants to attend the Ontario Municipal Board in support of the modified Official Plan Amendment, as necessary.

a. the Ontario Municipal Board shall issue its final order to approve the Official Plan Amendment for the subject lands;
b. all requirements regarding the storm sewer and related easement, located at the north end of the site, in the vicinity of the proposed Yonge Street driveway, be addressed to the satisfaction of Toronto Water staff and the Executive Director, Technical Services;
c. the owner shall enter into an agreement with the City pursuant to Section 37 of the Planning Act, to the satisfaction of the City Solicitor, to secure and provide the facilities, services and/or matters as generally outlined below:
i. at-grade bicycle rooms containing racks or lockers, at a combined minimum rate of 0.1 per dwelling unit including live-work townhouses;
ii. a minimum of 1.5 m2 per apartment house dwelling unit of indoor recreational amenity space; and
iii. a minimum of 1,282 m2 of retail and service commercial space on the ground floor podium level, fronting onto and directly accessible from Yonge Street, Park Home Avenue or the Rose Garden Park shown on Schedule "RM6(___)" and located within 30 metres of the property line; and
iv. a continuous indoor and underground pedestrian connection to the North York Centre transit terminal;
d. all existing agreements that affect the subject lands be amended to the satisfaction of the City Solicitor, including but not limited to the agreements related to the following items:
i. the Rose Garden, Gibson Park and Leased Park;
ii. the publicly accessible driveway, which also provides access to the Sam-Sor property, Gibson House and Yonge Hearts Child Care Centre;
iii. Heritage and Construction Impact and parking arrangements within the proposed development for Gibson House, to the satisfaction of Cultural Services;
iv. pedestrian tunnel connections to the Sam-Sor property to the north, and to 5160 Yonge Street to the south; and
v. the existing storm sewer and related City easements, to the satisfaction of Toronto Water and the Executive Director of Technical Services; and
e. subject to taking the necessary procedural steps, City Council support in principle declaring as surplus PART 7 identified on the January 5, 2010 draft R-Plan by R. Avis Surveying Inc, having an area of 153.2 m2, in exchange for PARTS 2 and 4 identified on the January 5, 2010 draft R-Plan by Avis Surveying Inc, having and area on 179.6 m2;
f. subject to the necessary procedural steps declaring the lands surplus being completed, Director of Real Estate Services report to City Council on the terms & conditions of the land exchange;
g. the following site plan matters be addressed to the satisfaction of the Director, Community Planning, North York District:
i. fire access route requirements to the satisfaction of Fire Services and the Executive Director of Technical Services;
ii. solid waste requirements, including waste collection arrangement, to the satisfaction of the Executive Director of Technical Services; and
iii. a sanitary sewer analysis (drainage plans, flow sheets and hydraulic analysis as necessary) to identify required improvements to the existing sanitary sewer system, up to the Trunk connection point, to provide for peak sanitary flows generated by this development and any extraneous wet weather flow, and any other known developments which are to be served by the same sanitary sewer system;
h. the following matters regarding archaeological assessment be addressed to the satisfaction of the Manager, Heritage Preservation Services:
i. retain a consultant archaeologist, licensed by the Ministry of Culture under the provisions of the Ontario Heritage Act (R.S.O 1990 as amended) to carry out a Stage 3 Archaeological Assessment of the lands cited in the assessment report completed by Archaeological Assessments Inc., dated December 2008 and identified on figure 12;
ii. undertake archaeological assessment of those lands subject to a land exchange identified as Part 7 on draft R-Plan 66R- by R. Avis Surveying Inc, dated Jan. 5, 2010;
iii. follow through on recommendations to mitigate, through preservation or resource removal and documentation, adverse impacts to any significant archaeological resources found. The assessment is to be completed in accordance with the 2009 Final Draft – Standards and Guidelines for Consulting Archaeologists, Ministry of Culture. Should the archaeological assessment process continue beyond a Stage 3 assessment, any recommendations for Stage 4 mitigation strategies must be reviewed and approved by Heritage Preservation Services staff prior to commencement of the site mitigation;
iv. submit a copy of the relevant assessment report(s) to the Heritage Preservation Services Unit in both hard copy format and as an Acrobat PDF file on compact disk for review and comment;
v. incorporate significant archaeological resources and findings into the proposed development through either in situ preservation and interpretation where feasible, or commemorate and interpret the resources through exhibition development on site including, but not limited to, commemorative plaquing; and
vi. ensure no demolition, construction, grading or other soil disturbances shall take place on the subject property prior to the City’s Planning Division (Heritage Preservation Services Unit) and the Ministry of Culture (Heritage Operations Unit) confirming in writing that all archaeological licensing and technical review requirements have been satisfied; and
i. the owner shall satisfy the Director, Community Planning, North York District and Deputy Chief Building Official, North York District, that the plans and drawings conform to the proposed Zoning By-law and do not provide for or allow additional gross floor area or extra height beyond that permitted by the by-law.
5. City Council approve in principle the Site Plan drawings and draft Conditions of Site Plan Approval listed in Attachment 13 to the report (February 16, 2010) from the Director, Community Planning, North York District, subject to stylistic and technical changes, and subject to amending Pre Approval Condition 2. in Attachment 13, to read as follows:
“2. The owner shall submit revised Landscape Plans to the satisfaction of the Director, Community Planning, North York District, in consultation with Planning Design and Development Section of Parks, Forestry and Recreation, and Cultural Services and subject to the results of consultation with the ward Councillor and local community". |

Summary |
The Zoning By-law Amendment application was submitted on October 17, 2008 and the Site Plan Control Approval application was submitted on April 23, 2009. The applications are subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.
The applications propose a development of two 42-storey (125 metre) residential towers including a 5-storey base building with commercial uses at grade fronting Yonge Street and Park Home Avenue and live work units at the rear. Parks and Open Space areas are to be maintained at the corner of Yonge Street and Park Home Avenue and along the Park Home Avenue frontage, west of the development site towards Beecroft Road. 5. Before introducing the necessary Bills to City Council for enactment, City Council require the owner to agree to provide public access to the ‘grand plaza’ area, and to the construction sequencing of the development, as well as any other matters in the Council endorsed Settlement not otherwise addressed, to be secured through entering into a Section 37 Agreement with the City, to the satisfaction of the City Solicitor.
6. City Council approve in principle the Site Plan drawings and draft Conditions of Site Plan Approval listed in Attachment 10 to the report (February 16, 2010) from the Director, Community Planning, North York District, subject to stylistic and technical changes.
7. City Council direct that prior to the Director, Community Planning, North York District issuing the Notice of Site Plan Approval Conditions:
a. the Chief Corporate Officer will have declared surplus Parts 18, 21 & 23 identified on the November 12, 2008 draft R-Plan by RM Pastushak OLS, having an area of 222 m2 and an offer be invited from the owner, consistent with the offer to settle and in exchange for 284 Maplehurst Avenue, to acquire a strata fee interest in these lands, subject to any infrastructure requirements of the TTC;
b. the owner shall have completed a Toronto Transit Commission (“TTC”) Level 3 Technical Review of the proposed development as applicable to the particular demolition, excavation and shoring permits applied for and obtain the TTC’s written acknowledgement that the developer has satisfied all of the conditions arising out of the review;
c. the owner shall have entered into a TTC construction agreement(s);
d. the owner shall have filed with the City the monetary contribution towards the cost of acquiring lands for completion of planned service roads, in the form of a letter of credit, that may be offset by the costs of connecting the major office development to the subway stations in accordance with the Section 37 Agreement; and
e. the owner shall have conveyed to the City the lands at 2 and 10 Bonnington Place to the satisfaction of the Executive Director of Technical Services for the North York Centre Service Road.
8. City Council authorize the Chief Planner or his designate to give Site Plan approval once the final conditions to be satisfied prior to Site Plan Control Approval, including entering into a satisfactory Site Plan Agreement, have been fulfilled.
9. City Council direct that if the Owner agrees to take on the role of constructing the Longmore and Maplehurst Park using the Parks & Recreation component of the Development Charges generated through this development application, the Owner shall receive development charge credits for the Park Improvements. The development charges credit shall be the lesser of the Parks & Recreation component of the development charges payable in accordance with the City’s Development Charges By-law and the Owner’s actual cost for the Park Improvements as approved by the General Manager, Parks, Forestry and Recreation.

“That:
1. North York Community Council adopt the staff recommendations in the Recommendation Section of the report (February 17, 2010) from the Director, Community Planning, North York District, with the following amendments being made to the proposed Official Plan Amendment attached as Attachment 2 to the report:
a. Policy 2.2.1 (d) be amended by adding “Redevelopment of the lands will result in the removal of the concrete walls along Keele Street and the introduction of local street connections to Keele Street”;

b. Amending Policy 3.3.3 by replacing “is strongly encouraged to” with “shall” so it would now read: “Parc Downsview Park Inc. shall develop a District Public Art Plan for the National Urban Park to ensure public art is provided in a coordinated manner”.
c. Providing a definition of the term “significant scale” used in Policy 3.3.1.

1. allow this plan to be shown to the constituents of the three affected wards 8, 9 and 10, in the form of public consultations, in conjunction with the respective ward councillors;
2. allow the City Planning Division to:
a. include the impact of the proposed Humber River Regional Hospital Site Plan into the Parc Downsview Park Transportation Master Plan and the Infrastructure Master Plan;
b. investigate whether the proposed Downsview Secondary Plan is consistent with the Official Plan regarding the heights of buildings on Keele Street and its consistency with the existing built form;

3. allow the Toronto Transit Commission to:
a. report on the feasibility of designating Keele Street for Higher Order of Transit;
b. report on density levels beyond 500 m radii from Higher Order of Transit line;
4. allow Transportation Services staff to report on the impact of the new arterial road called for in the Downsview Secondary Plan, adjacent to the two area secondary schools;
5. allow Parc Downsview Park to incorporate sustainability principles into its request for proposals;
6. allow the Department of National Defence to provide a report outlining the need for on-site housing;
7. allow Toronto Water staff to report on sewer capacity to address area basement flooding;
8. allow the Toronto District School Board to report on potential closure of Downsview Secondary School;
9. allow the Toronto Catholic District School Board to report on potential closure of Madonna Catholic Secondary School.

3. City Planning staff being directed to include the Keele Street Avenue frontages (from Wilson Avenue to St. Regis Crescent) in the program to implement the City wide Avenue Studies.
4. City Finance staff being directed to report on the possible funding of the required transportation improvements shown on Maps 7-4, 7-5 and 7-6 through a special levy on development within the Downsview Secondary Plan area.
5. City Council advising Parc Downsview Park Inc. and Bombardier Aerospace that the City will not approve any implementing zoning on lands currently owned by the Federal Government or Bombardier until such time as the restrictive covenants are released from the Build Toronto lands at the southeast corner of the Allen Road and Sheppard Avenue West.
6. City Council at its meeting on September 24 and 25, 2008 authorized the City Solicitor to attend the Ontario Municipal Board to support Council’s position in relation to the appeal of a proposed Zoning By-law Amendment and Site Plan Approval to permit a 22-storey residential building and three blocks of townhouse units on the subject site.
The Ontario Municipal Board issued a Decision dated April 15, 2009 to approve the development proposal, but deferred issuing its Final Order pending the execution of a section 37 agreement relating to the Zoning By-law and a site plan agreement relating to the site plan approval.

The owner of 65 Thorncliffe Park Drive submitted an application to the Committee of Adjustment, North York Panel, for permission to allow a portion of the main floor within a rental high-rise apartment building to be used for meeting rooms, recreation space, and daily prayer activities (place of worship).
The renovations had already been undertaken without permits. Municipal Licensing and Standards staff issued a Notice of Violation to the owner of 65 Thorncliffe Park Drive. The Notice refers to use of the space as a “place of worship”, a use not permitted in the By-law unless within a dedicated building.
Variances were requested to permit approximately 576 square metres (6,200 square feet) within a residential high-rise building to be used for meeting rooms, recreation space, and daily prayer activities (place of worship).
In order to accommodate the place of worship, the applicant has converted an existing locker storage area. This conversion does not reflect the general purpose and intent of the Zoning By-law and is not minor as it proposes the addition of a use not contemplated in the manner proposed. The conversion has created issues regarding potential impacts such as noise and on-site parking requirements as well as the loss of locker storage space for residents.
The Committee of Adjustment for the City of Toronto (North District) refused the variances requested. The applicant has appealed the decision of the Committee of Adjustment to the Ontario Municipal Board. The Ontario Municipal Board has not set a hearing date for the application.
Community Council is requesting representation at the Ontario Municipal Board hearing.

The owners of 18 Glencairn Avenue have applied for Front Yard Parking to satisfy the condition of the variance approved by the Committee of Adjustment relating to the proposed renovations to their home. The variance applied for, through the Committee of Adjustment was approved, subject to the owners applying for and being approved for Front Yard Parking, pursuant to the requirements of Chapter 918 of the Toronto Municipal Code.
In accordance with the provisions of this code, given a valid poll for Front Yard Parking had not been approved in the past three years, a new poll was required.. A poll was conducted by the City Clerk on January 29, 2010. A total of 78 ballots were mailed out and 38 ballots were returned, where 39 were required. Chapter 918-21 of the Municipal Code requires that 50% plus one of the ballots mailed out must be returned or the poll is considered negative. Of the 38 ballots returned, 28 were in favour of the proposal while 10 were opposed. Given this overwhelming support for the proposal, even if the one missing required response were counted in the negative, the overall response is still strongly in support of the application.
Transportation Services has also advised that on-street parking is available on this section of Glencairn Avenue, where 18 of the 24 available permits for on-street permit parking or 75% have been issued, where the by-law requires that it be issued to 90% to qualify. |

In 1986, Loretto Abbey High School became a member of the Metropolitan Separate School Board (now Toronto Catholic District School Board) family of schools.”
