City Council on February 22 and 23, 2010, adopted the following:
1. City Council enact a part lot control exemption by-law with respect to the subject lands as generally illustrated on Attachment 1 of the report (January 21, 2010) from the Director, Community Planning, Scarborough District, to be prepared to the satisfaction of the City Solicitor.
2. City Council authorize the City Solicitor to introduce any necessary Bills in Council for a part lot control exemption by-law to expire (2) years from the date of enactment.
3. City Council require the owner to provide proof of payment of all current property taxes for the subject lands to the satisfaction of the City Solicitor, prior to the enactment of the part lot control exemption by-law.
4. 1. City Council, in accordance with the delegated approval under By-law 229-2000, be advised that the Chief Planner intends to approve the draft plan of common elements condominium, as generally illustrated on Attachment 1 of the report (December 30, 2009) from the Director, Community Planning, Scarborough District, subject to:
a. the conditions as generally listed in Attachment 2 of the report (December 30, 2009) from the Director, Community Planning, Scarborough District, which except as otherwise noted, must be fulfilled prior to the release of the plan of condominium for registration; and
b. any such revisions to the proposed condominium plan or any such additional or modified conditions as the Chief Planner may deem to be appropriate to address matters arising from the on-going technical review of this development.
2. City Council enact a part lot control exemption by-law with respect to the subject lands, to be prepared to the satisfaction of the City Solicitor, and that such by-law shall expire two years after it has been enacted.

Summary |
These applications were made after January 1, 2007 and are subject to the new provisions of the Planning Act and the City of Toronto Act, 2006. The new provisions for draft plan of common elements condominium require that a public meeting be held.
The application for a common elements condominium proposes a common driveway on lands known municipally as 742-744 Kennedy Road, located on the west side of Kennedy Road south of Eglinton Avenue and in close proximity to the Kennedy Subway Station. The common elements condominium is required to provide shared vehicular access and other amenities for two semi-detached and seven townhouse units recently constructed on this site, and to ensure shared ownership and maintenance of the common elements by the condominium corporation.
The requested exemption from the part lot control provisions of the Planning Act is required in order to permit the creation of conveyable lots for the nine units intended for freehold ownership.
This report reviews and recommends approval of the draft plan of common elements condominium and approval of the application for part lot control exemption. This report recommends that the owner of the lands be required to register a Section 118 restriction under the Land Titles Act agreeing not to convey or mortgage any part of the lands without prior consent of the Chief Planner or designate. In addition, this report recommends that a part lot control exemption by-law be enacted for a period of two years. |

Summary |
On January 27th, 2010, the Committee of Adjustment had before it an application for front yard parking. This is an industrial building in the Wexford Employment Area. This property has a narrow frontage of 15.24 metres but is a deep property. The building is narrow, with only 12 metre width across the front. The zoning bylaw allows front yard parking as long as it meets certain criteria. A building needs to have a minimum of 15 metres front wall to have 5 spaces in the front or flanking yards. This building only has a front wall of 12 metres and front yard parking is not permitted as of right in the bylaw. The applicant wanted 6 spaces in the front yard. The discussion of the committee members was that they didn't think there was room for 6 cars to park, and asked why he could not park in the rear yard, The applicant showed pictures of properties on the street that had front yard parking. The committee compromised and approved front yard parking but limited it to 3 spaces.
The purpose of the bylaw to limit front yard parking is to ensure the front yards of buildings do not become a parking lot, to provide space for landscaping and front yard amenity and to provide an attractive streetscape. I therefore ask that this matter be placed on the agenda as an urgent item. |
