Inspection of the tree by staff revealed that the tree is in good condition and there are no visible signs of disease. With proper care and maintenance, the tree should continue to provide benefits to the community for many years. Urban Forestry cannot support removal of this tree due to its viable condition. |

Summary |

This report on Finch Avenue East details the changes to the distance of the east boundary of existing unsigned 60 Km/h speed limit and also a reduction of the speed limit to 50 Km/h, related to the recent railway grade separation and roadway widening/realignment. In addition, due to the new bicycle lanes, the existing on-street No Parking Anytime regulations will need to be rescinded and replaced with a No Stopping Anytime regulation.
Community Council’s approval of the No Stopping Anytime regulations and the 50 Km/h speed limit amendments will allow enforcement by the Toronto Police Service and may improve roadway operation and safety. |

Summary |
This staff report is about a matter for which the Scarborough Community Council does not have delegated authority from City Council to make a final decision due to the TTC bus route on the subject roadway.
This report responds to a concern, on behalf of a community association, regarding drivers parking their vehicles on Morningside Avenue between Kingston Road and Lawrence Avenue East to visit nearby coffee shops. To mitigate this on-street parking problem, a No Standing Anytime regulation is recommended along the subject portion of Morningside Avenue, as outlined in this report.
It is recommended that Transportation Services install No Standing Anytime regulations in the subject area. These regulations will help to encourage clear sight lines along this portion of roadway as well as continuing to provide some temporary pick-up and drop-off benefits. |

City Council Decision |
City Council on May 11 and 12, 2010, adopted the following:
1. City Council permanently close the public walkway located between 48 and 50 Broadbridge Drive, shown as Parts 1 and 2 on Sketch No. PS-2007-188 (the “Walkway”), subject to compliance with the requirements of the City of Toronto Municipal Code Chapter 162.
2. City Council direct Transportation Services staff to give notice to the public of a proposed by-law to close the Walkway in accordance with the requirements of City of Toronto Municipal Code, Chapter 162, with the Scarborough Community Council to hear any member of the public who wishes to speak to the matter during consideration of the proposed by-law.
3. City Council direct Transportation Services staff to advise the public of the proposed closure of the Walkway prior to implementation, in accordance with the requirements of the Municipal Class Environmental Assessment for Schedule “A+” activities, by posting notice of the proposed closure on the Notices page of the City of Toronto’s website for at least five working days prior to the Scarborough Community Council meeting at which the proposed by-law to close the Walkway will be considered.
4. City Council accept the Offer to Purchase from Alan John Schnurr and Renee Denise Schnurr at 48 Broadbridge Drive to purchase approximately 51.1 square metres of land shown as Part 2 on Sketch No. PS-2007-188 in the amount of $3,000.00 substantially on the terms and conditions outlined in Appendix “A” to the report (April 7, 2010) from the General Manager, Transportation Services and the Chief Corporate Officer.
5. City Council accept the Offer to Purchase from Benedict K. Y. Chan and Regina Man Yee Chan at 50 Broadbridge Drive to purchase approximately 51.1 square metres of land shown as Part 1 on Sketch No. PS-2007-188 in the amount of $3,000.00 substantially on the terms and conditions outlined in Appendix “B” to the report (April 7, 2010) from the General Manager, Transportation Services and the Chief Corporate Officer.
6. City Council authorize each of the Chief Corporate Officer and the Director of Real Estate Services severally to accept the Offer to Purchase on behalf of the City.
7. City Council grant authority to direct a portion of the proceeds of closing to fund the outstanding expenses related to the completion of the sale transaction.
8. City Council authorize the City Solicitor to complete the transaction on behalf of the City, including paying any necessary expenses, amending the closing, due diligence and other dates, and amending and waiving terms and conditions, on such terms as she considers reasonable. |

Committee Recommendations |
Scarborough Community Council recommends that:
1. City Council permanently close the public walkway located between 48 and 50 Broadbridge Drive, shown as Parts 1 and 2 on Sketch No. PS-2007-188 (the “Walkway”), subject to compliance with the requirements of the City of Toronto Municipal Code Chapter 162.
2. City Council direct Transportation Services staff to give notice to the public of a proposed by-law to close the Walkway in accordance with the requirements of City of Toronto Municipal Code, Chapter 162, with the Scarborough Community Council to hear any member of the public who wishes to speak to the matter during consideration of the proposed by-law.
3. City Council direct Transportation Services staff to advise the public of the proposed closure of the Walkway prior to implementation, in accordance with the requirements of the Municipal Class Environmental Assessment for Schedule “A+” activities, by posting notice of the proposed closure on the Notices page of the City of Toronto’s website for at least five working days prior to the Scarborough Community Council meeting at which the proposed by-law to close the Walkway will be considered.
4. City Council accept the Offer to Purchase from Alan John Schnurr and Renee Denise Schnurr at 48 Broadbridge Drive to purchase approximately 51.1 square metres of land shown as Part 2 on Sketch No. PS-2007-188 in the amount of $3,000.00 substantially on the terms and conditions outlined in Appendix “A” to the report (April 7, 2010) from the General Manager, Transportation Services and the Chief Corporate Officer.
5. City Council accept the Offer to Purchase from Benedict K. Y. Chan and Regina Man Yee Chan at 50 Broadbridge Drive to purchase approximately 51.1 square metres of land shown as Part 1 on Sketch No. PS-2007-188 in the amount of $3,000.00 substantially on the terms and conditions outlined in Appendix “B” to the report (April 7, 2010) from the General Manager, Transportation Services and the Chief Corporate Officer.
6. City Council authorize each of the Chief Corporate Officer and the Director of Real Estate Services severally to accept the Offer to Purchase on behalf of the City.
7. City Council grant authority to direct a portion of the proceeds of closing to fund the outstanding expenses related to the completion of the sale transaction.
8. City Council authorize the City Solicitor to complete the transaction on behalf of the City, including paying any necessary expenses, amending the closing, due diligence and other dates, and amending and waiving terms and conditions, on such terms as she considers reasonable. |

a. the conditions as generally listed in Attachment 3 to the report (April 6, 2010) from the Director, Community Planning, Scarborough District, which, unless as otherwise noted, must be fulfilled prior to the release of the plan of condominium for registration; and
b. any such revisions to the proposed condominium plan or any such additional or modified conditions as the Chief Planner may deem to be appropriate to address matters arising from the on-going technical review of this development.
2. City Council enact a part lot control exemption by-law with respect to Blocks 13 to 15 of Plan M-2469, to be prepared to the satisfaction of the City Solicitor and to expire two years following enactment by City Council.
3. City Council require the owner to provide proof of payment of all current property taxes for the subject lands to the satisfaction of the City Solicitor, prior to the enactment of the part lot control exemption by-law.
4. Summary |
On April 14, 2010 the Committee of Adjustment had before it an application “to permit the existing holistic centre (Orient Spa) to remain in the commercial plaza”. The Committee of Adjustment approved the variance.
I sent a letter to the Committee of Adjustment requesting that the above item be deferred to provide an opportunity for me to meet with the applicant/owner to discuss what services she is planning to provide. My staff had left a number of phone messages at the number provided to us for the agent who was dealing with the file and no response was received. On the day of the hearing, the owner of the “holistic centre” called wanting to meet immediately before the meeting started. My staff advised the owner that there was no way that we could meet immediately because of previously scheduled meetings and that she should agree to deferring the matter until the next meeting to provide an opportunity for us to meet. The owner made the decision to move forward with the matter at the April 14th meeting.
The reason for my request that the City of Toronto appeal the Committee of Adjustment decision is that there is another “holistic centre” in this strip mall just above the proposed use on the second floor. My ward has a proliferation of “holistic centres” in strip malls along the arterial roads which abut residential neighbourhoods. A large number of the “holistic centres” are not what they claim to be, by providing services which are illegal. Locating the proposed “holistic centre” in this strip mall is not in the best interest of the community and the retail neighbours of the proposed use. |
