Final Report - 14 Strachan Avenue, 39-51 East Liberty Street and 19 Western Battery Road - Rezoning, Subdivision Applications

Recommendations

The City Planning Division recommends that:

 

1.         City Council amend Zoning By-law 566-2000 substantially in accordance with the draft Zoning By-law Amendment for 14 Strachan Avenue, 39-51 East Liberty Street and 19 Western Battery Road attached as Attachment No. 11 to the report from the Director, Community Planning, Toronto and East York District dated May 10, 2010.

 

2.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.

 

3.         City Council authorize the City Solicitor to amend the Phase II subdivision agreement for King-Liberty, registered as Instrument No. AT1373680 to:

 

i.          Release those lands at the easterly boundary of the Phase II Subdivision for inclusion in the new Phase 2A East Subdivision, with the exception of phasing provisions relating to the completion of the Pirandello Extension.

 

ii.         Provide for the Pirandello Extension connection between East Liberty Street and any future Local Road and to revise the interim design treatment of the Pirandello Extension.

 

4.         City Council authorize the City Solicitor to amend the Section 37 Agreement registered as Instrument No. CA681469 to exempt Block 1A, municipally known in 2010 as 39-51 East Liberty Street, 14 Strachan Avenue and 19 Western Battery Road, from the Public Art Program.

 

5.         Prior to the introduction of the necessary Bills at City Council, City Council require the owner to enter into a Subdivision Agreement satisfactory to the Chief Planner and Executive Director, City Planning Division, and the City Solicitor, for the lands known in 2010 as 14 Strachan Avenue and 39-51 East Liberty Street.  Such agreements shall be registered on title to the lands in a manner satisfactory to the City Solicitor, to secure the following:

 

i.          Conveyance and construction of a new local road, to the satisfaction of the Executive Director of Technical Services, generally as shown on Attachment 7 to the report from the Director, Community Planning, Toronto and East York District, dated May 10, 2010.

 

ii.         Construction and maintenance, in perpetuity, of a crash wall along the CN and GO Transit Lake Shore Rail Corridor generally as shown on Attachment 7 to the report from the Director, Community Planning, Toronto and East York District, dated May 10, 2010.

 

iii.        A contribution of not less than one percent of the estimated gross construction costs for the above grade development on the lands known in 2010 as 14 Strachan Avenue and 39-51 East Liberty Street, including any density transferred to the lands known in 2010 as 19 Western Battery Road, to be used for the City’s Percent for Public Art Program.

 

iv.        To improve the local road and laneway system in the neighbourhood and provide additional access to the Toronto Police Services Building at 9 Hanna Avenue, as shown on Attachment 8 to the report from the Director, Community Planning, Toronto and East York District, dated May 10, 2010, Toronto Hanna Properties Limited (“THPL”) agree to the following:

 

a.         Release of the existing easements in Instrument No. AT1331272 and restrictive covenants in Instrument No. AT1331291 over the City-owned lands designated as Parts 1 to 14, inclusive, on Plan 66R-22662 that benefit lands currently owned by THPL.

 

b.         Release of the existing easement in Instrument No. AT426406 over the City-owned lands designated as Parts 1 and 2 on Plan 66R-20451 that benefits lands currently owned by THPL.

 

c.         Execution by THPL, as tenant under the existing Sign Lease for the signs in front of the building at 9 Hanna Avenue, of an amending agreement to release the tenant's access easement over Parts 1 to 7, inclusive, on Plan 66R-22704.   

 

d.         THPL to provide its covenant, as tenant under the Sign Lease, that it shall not object to the City agreeing to a reconfiguration of its existing easement across 5 Hanna Avenue, provided that continuous vehicular and pedestrian access to 9 Hanna Avenue is maintained on the same terms and conditions as the City’s existing easement.

 

v.         As part of the Site Plan Approval process, the owner shall provide 1:50 scale drawings for the first, second, third and fourth storey portions of all building elevations with building materials labelled and the drawings having a sufficient level of detail to illustrate how the building will be perceived by pedestrians.  The owner shall incorporate, in the construction of the apartment building, said exterior materials to the satisfaction of the Chief Planner and Executive Director, City Planning Division.

 

vi.        The owner shall be encouraged to build in conformity with the Green Development Standard Checklist on file with the Chief Planner and Executive Director, City Planning Division, date-stamped as received April 8, 2009.

 

vii.       The owner shall provide and maintain an irrigation system, at the applicant's expense, for proposed trees within the public road allowances, including an automatic timer, designed to be water efficient by a Certified Landscape Irrigation Auditor (CLIA) and constructed with a back flow preventer to the satisfaction of the Executive Director, Technical Services Division, and requirements to maintain in good order and operation.

 

viii.      The owner shall provide a wind study and implement any mitigation measures required through the study satisfactory to the Chief Planner and Executive Director, City Planning Division.

Summary

This application was made on or after January 1, 2007, and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

This application proposes to incorporate reserved lands from the former Inglis Manufacturing Facilities Lands into King Liberty Village to extend the zoning permissions already granted to that neighbourhood.  The intent is to allow for the construction of three residential towers at 14 Strachan Avenue and 39 to 51 East Liberty Street.  Two of the towers, both being 25 storeys in height, would share a common 4-storey podium on the south side of East Liberty Street; the third tower, also having a height of 25 storeys, would have a separate 4-storey podium on the south west corner of Strachan Avenue and East Liberty Street.  As part of the application, a portion of the density will be transferred to the previously approved building at 19 Western Battery Road, increasing its height from 20 to 29 storeys.

 

This report reviews and recommends approval of the application to amend the Zoning By-law.

Final Report - 99 Blue Jays Way - Rezoning

Recommendations

The City Planning Division recommends that:

 

1.         City Council repeal site specific Zoning By-law 574-2007 for 99 Blue Jays Way.

 

2.         City Council amend Zoning By-law 438-86, for the lands at 99 Blue Jays Way substantially in accordance with the draft Zoning By-law Amendment to be available at the May 25, 2010, Toronto and East York Community Council meeting.

 

3.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.

 

4.         Before introducing the necessary Bills to City Council for enactment, City Council require the owner to enter into an Agreement pursuant to Section 37 of the Planning Act satisfactory to the Chief Planner and Executive Director, City Planning Division, and the City Solicitor, such agreement to be registered on title to the lands in a manner satisfactory to the City Solicitor, to secure the following facilities, services and matters:

           

a.         An indexed cash contribution of $1,200,000.00 payable to the City of Toronto prior to the issuance of the first above-grade building permit of which 10% will be allocated to affordable housing in Ward 20, and the remainder for the provision of one or more of the following:

 

-           streetscape improvements to John Street and Mercer Street;

 

-           park improvements to Clarence Square Park;

 

-           Heritage Conservation District Studies in the King Spadina East Precinct and/or design and development supporting the John Street streetscape project.

 

b.         A public art contribution in accordance with the Percent for Public Art Program for a value not less than one percent of the gross construction cost.        

 

The following matters are also recommended to be secured in the Section 37 Agreement as a legal convenience to support development:

 

c.         The owner shall provide a minimum of ten percent (10%) of the residential units in the building having at least three bedrooms, or be convertible to three or more bedrooms.

 

d.         Architectural plans, elevations and landscaping including 1:50 elevations will be secured to the satisfaction of the Chief Planner and Executive Director, City Planning Division, and the owner will be required to, in conjunction with the Site Plan Application, submit 1:50 scale drawings in conformity with this requirement for the podium.

 

e.         The owner shall incorporate in the construction of the building, and thereafter maintain, exterior building and landscape materials to the satisfaction of the Chief Planner and Executive Director, City Planning Division.

 

f.          The owner shall be encouraged to build in conformity with the Green Development Standard Checklist on file with the Chief Planner and Executive Director of City Planning Division, date-stamped May 27, 2009.

 

g.         The owner shall provide and maintain in good order and operation an irrigation system, at the applicant’s expense, for proposed trees within the public road allowances, including an automatic timer, designed to be water efficient by a Certified Landscape Irrigation Auditor (CLIA) and constructed with a back flow preventer to the satisfaction of the Executive Director, Technical Services.

 

h.         The owner shall submit a wind study completed by a qualified wind consultant in conjunction with the Site Plan Application and implement all wind mitigation measures recommended by the report. 

Summary

This application was made on or after January 1, 2007, and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

The applicant proposes a 40-storey mixed-use building on a 6 and 8-storey podium comprised of 309 residential units and commercial uses at grade located at 99 Blue Jays Way. The property is currently subject to site specific Zoning By-law 574-2007 which will be repealed and replaced by this Zoning By-law amendment. Community benefits that were secured under By-law 574-2007 will be included in the new by-law amendment.

 

The proposal is generally consistent with the King Spadina East Precinct Built Form Study in that it is located within an area that can accommodate tall buildings without destabilizing the warehouse character of the area. The proposal is consistent with the goals of the Tall Building Guidelines and the King Spadina Built Form Study with respect to tower floor plate size and adequate tower separation.

 

This report reviews and recommends approval of the application to amend the Zoning By-law.

The City Planning Division recommends that:

"4.i.      The owner shall pay for any required upgrades to the municipal infrastructure identified in the Municipal Servicing and Stormwater Management Report to support the development to the satisfaction of the Executive Director, Technical Services."

Summary

The April 30, 2010 report “99 Blue Jays Way – Rezoning – Final Report” recommends approval of a 40-storey mixed-use building at 99 Blue Jays Way. At the time of report preparation, Technical Services had not provided final comments on the rezoning application. The purpose of this report is to provide further information on parking, loading, and servicing requirements from Technical Services that was provided to Community Planning on May 12, 2010.

a.         the conditions as generally listed in Attachment 3 to the report dated April 29, 2010, from the Director, Community Planning, Toronto and East York District, which, unless otherwise noted, must be fulfilled prior to the release of the plan of condominium for registration; and

 

b.         any such revisions to the proposed condominium plan or any such additional or modified conditions as the Chief Planner may deem to be appropriate to address matters arising from the on-going technical review of this development.

The City Planning Division recommends that:

 

1.         City Council refuse application 10-103027 STE 18 OZ for 1100 Queen Street West because Entertainment Facilities are not permitted and are not appropriate in MCR districts that are directly adjacent to low-density residential neighbourhoods.

 

2.         City Council instruct the City Solicitor, together with other appropriate City staff, to attend any Ontario Municipal Board hearing in support of the positions recommended in this report.

Summary

This application was made on or after January 1, 2007, and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

This application proposes to permit an Entertainment Facility use at 1100 Queen Street West. The existing establishment at this location, known as “The Social” has been operating for approximately five years after having obtained building permits and a business licence for a Restaurant use. However, its current operation more closely reflects that of an Entertainment Facility, as defined by Zoning By-law 438-86. Therefore, the applicant proposes to rezone the site to allow an Entertainment Facility use in order to reflect its current operation.

16 York Street - Request for Direction Report

The City Planning Division recommends that:

 

1.         City Council authorize the appropriate City officials to amend the Section 16 Agreement for 16 York Street as follows:

 

a.         Deleting the requirement for a $500,000 payment to the City for Bremner Boulevard streetscaping, and replace with a requirement that the owner reconstruct Bremner Boulevard at no cost to the City, to the City's specifications, from York Street to Lake Shore Boulevard West.

 

b.         Requiring that the owner provide a letter of credit in a form satisfactory to the Executive Director of Technical Services as security to cover the cost of such reconstruction, upon execution of the agreement, with such letter of credit to be in an amount of $850,000.

 

c.         Providing for the refund of the $500,000 Section 16 funds previously paid by the owner for Bremner Boulevard streetscaping, upon execution of the amending agreement and provision to the City of the letter of credit.

 

d.         Reducing the amount of Section 16 funds required for Railway Lands Streetscaping from $500,000 to $150,000 and requiring the owner to incorporate streetscaping improvements in the reconstruction of Bremner Boulevard such that the total value of the reconstruction is approximately $850,000.

 

e.         Requiring the owner of 16 York Street to contribute any remaining amount to streetscape improvements in the Railway Lands including the Simcoe Street Pedestrian Promenade, if the Bremner Boulevard reconstruction work can be completed for less than $850,000.

 

2.         The owner enter into an appropriate agreement for the reconstruction of the road to the satisfaction of the Executive Director of Technical Services.

Summary

The purpose of this report is to seek Council authorization to amend the Section 16 Agreement for 16 York Street to delete the requirement for a $500,000 payment to the City for Bremner Boulevard reconstruction, and replace with a requirement that the owner reconstruct Bremner Boulevard between York Street and Lake Shore Boulevard West, and that $350,000 for Railway Lands streetscaping be reallocated to this project.

Summary

This report recommends that City Council state its intention to designate the property at 407 Huron Street (Thomas W. Wilson House) under Part IV, Section 29 of the Ontario Heritage Act.  In October 2009, the property owner applied for a residential demolition permit which has not been issued.

 

Following research and evaluation, staff have determined that the property merits inclusion on the City of Toronto Inventory of Heritage Properties for its cultural heritage value.  Because the site is the subject of a demolition application, staff recommend that Council state its intention to designate the property under Part IV, Section 29 of the Ontario Heritage Act to protect the site’s cultural heritage values and attributes.

Financial Impact

There are no financial implications resulting from the adoption of this report.  The public Notice of Intention to Designate will be advertised on the City’s web site in accordance with the City of Toronto Act provisions.

Recommendations

The Toronto Preservation Board recommended to the Toronto and East York Community Council that the recommendations in the report (March 2, 2010) from the Acting Director, Policy and Research, City Planning be amended by adding the following Recommendation 1 and renumbering the remainder of the recommendations so that they read as follows:

 

1.         City Council amend under the heading “Heritage Attributes” in Attachment No. 3 of the report (March 2, 2010) from the Acting Director, Policy and Research, City Planning by deleting:

1.         City Council approve the alterations to the property at 175 Jones Avenue, substantially in accordance with the plans and drawings prepared by Turner Fleischer Architects Inc. dated March 18, 2010, date stamped received by the City Planning Division on May 22, 2010 and including revised drawings A-7 and A-10 dated March 18, 2010, date stamped received by the City Planning Division March 26, 2010, and the Heritage Impact Assessment titled “St Clement's Anglican Church 169-175 Jones Avenue”, prepared by John Blumenson Preservation Consultant, revised April 6, 2010, dated stamped received by Heritage Preservation Services April 6, 2010, all on file with the Manager, Heritage Preservation Services subject to the owner:

Summary

This report recommends that City Council approve the proposed alterations to the heritage property at 175 Jones Avenue, the former St. Clement's Anglican Church.  This report further recommends the designation of this property under Part IV, Section 29 of the Ontario Heritage Act for its cultural heritage value.

 

This report addresses an application to adaptively reuse the church structure as a residential condominium and construct a 4-storey residential condominium building.  The proposed rehabilitation project retains the original structure of the church.  Also, the existing addition to the rear of the church is to be removed and replaced with a new 3-storey addition.  Two new floor levels will be added to the interior of the existing church.

 

The proposed alterations are necessary to accommodate the new use for the church. The front (west) bay of the building will be conserved and will remain essentially as it is now with some minor alterations. The side and rear elevations will retain their important characteristics while undergoing alteration to incorporate new windows and doors.

This report recommends that City Council include on the City of Toronto Inventory of Heritage Properties the properties on the south side of Hubbard Boulevard, between Wineva and Hammersmith Avenues, and the properties on the west side of Wineva Avenue, south of Hubbard Boulevard.  The 12 properties identified in the recommendations have cultural heritage value as an enclave of residential buildings from the 1920s that are among the last surviving dwellings with direct access to the waterfront in Toronto’s Beaches neighbourhood.  Their inclusion on the City’s heritage inventory would enable staff to monitor the sites and encourage the retention of their heritage attributes and values.

The applicant, being the property owner, is seeking an exemption to the provisions of the City of Toronto Municipal Code, Chapter 447 Fences, Section 447-2(B), to permit an existing wrought iron fence constructed on top of a brick wall fence located adjacent to the south property line and also a chain link fence constructed at the west and north side of the property, to exceed the maximum allowable height. The Fence By-law provides that a fence in the rear or side yard area can be constructed to a height of 2 metres.  (See Attachments 1 and 3).

 

A wrought iron fence measuring approximately 1.15 metres in height was constructed on top of an existing brick wall fence that was built sometime in the early 1900s, along the south property line.  The brick wall fence varies in height from approximately 2.25 metres at the east side to 2.71 metres at the west side, due to the slope of the grade.  The brick wall fence measures approximately 59.44 metres in length.  The combined height of the wrought iron and brick fence varies in height from 3.40 metres at the east side and 3.86 metres at the west side, due the slope of the grade.

 

A 3.05 metre high chain link fence was built at the north west corner as an extension to an existing chain link fence for a distance of 10.97 metres along the west property line and 22.25 metres along the north property line.

The City Planning Division recommends that:

 

1.         Staff be directed to schedule a community consultation meeting, together with the Ward Councillor, for the proposed site-specific Official Plan Amendment for the lands known as 150 Sudbury Street, attached as Attachment 1 to the report dated April 27, 2010, from the Director, Community Planning, Toronto and East York District.

 

2.         Notice for the community consultation meeting be given to landowners and residents within 120 metres of the site.

 

3.         Notice for the public meeting under the Planning Act be given according to the regulations under the Planning Act.

 

4.         Should City Council, at its meeting on May 11, 12, 2010, not adopt the recommendations of the Executive Committee (Item EX43.29) and Affordable Housing Committee (Item AH12.5) respecting "Request for Property Tax Waiver for Artscape's Affordable 20 Units of Rental Housing at 150 Sudbury Street", staff be authorized to discontinue the Official Plan Amendment process for 150 Sudbury Street.

Summary

This proposed Official Plan Amendment (OPA) was initiated by the City after January 1, 2007 and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.  The Executive Committee and Affordable Housing Committee both directed City Planning staff to immediately commence the Official Plan Amendment process.  Given the timelines and meeting schedules, at the time of drafting this report, Planning staff did not have City Council direction to commence.  Recommendations from the Executive and Affordable Housing Committees will be before City Council on May 11 and 12, 2010.

 

The  proposed OPA amends the definition of “rental housing” for  the lands known as 150 Sudbury Street in order for Toronto Artscape Inc., a non-profit housing provider, to benefit from municipal assistance through property tax waivers for the provision of affordable rental housing.  City Council adopted amendments to the Zoning By-law for 150 Sudbury Street, which secures 20 artist live/work units with affordable rents (0.8 times the average CMHC market rent for the City).  The Bills have not yet been placed before City Council for enactment.  These 20 units are proposed to be condominium registered units, which is explicitly prohibited by the definition of “rental housing” in the Official Plan.  In order to benefit from municipal assistance for affordable rental units, while at the same time being condominium registered units, a site specific OPA is required for the 20 live/work units.

 

This report provides the background and rationale for the proposed site-specific OPA and seeks Community Council's directions on further processing of the applications and on the community consultation process.  In consultation with the Ward Councillor, staff have scheduled a community consultation meeting for May 19, 2010.  Staff is targeting the statutory public meeting for the June 22, 2010 meeting of Toronto and East York Community Council.

1.         City Council authorize the introduction of an amendment to Municipal Code Chapter 743, “Streets and Sidewalks, Use of”, substantially in the form included as Appendix ‘A’ to the report dated April 19, 2010, from the Director, Transportation Services, Toronto and East York District, to prohibit street promotions (as defined in the proposed amendment) on the sidewalks adjacent to Yonge Dundas Square, to come into effect thirty days after adoption by City Council, subject to such stylistic or technical adjustments as may be required by the City Solicitor; and

 

2.         City Council authorize and direct all other appropriate City officials to take the necessary actions to give effect thereto, including the introduction of any necessary bills.

Summary

The Yonge-Dundas Square Board of Management (the Board) has expressed concern regarding sampling, marketing and illegal vending taking place on sidewalks adjacent to the Square.  The Board believes that such activities obstruct and encumber the sidewalks, particularly during crowded events, and that these also have a negative impact upon permitted vendors operating from licensed locations within the Square, thereby affecting the economic viability of the Square.

 

This report recommends the adoption of a by-law which prohibits sampling and marketing (referred to in the by-law as street promotions) on the public sidewalks adjacent to the Yonge-Dundas Square.  The by-law (Appendix ‘A’) would contain an exception for the distribution of information flyers provided that the by-law is otherwise complied with.

(the “Purchaser”) to purchase the portion of the Highway shown as Part 1 on Sketch No. PS-2008-108 in the amount of $115,000.00, plus applicable taxes, substantially on the terms and conditions outlined in Appendix “A” attached to the report dated May 3, 2010, from the General Manager, Transportation Services and the Chief Corporate Officer, and on such other terms as may be acceptable to the Chief Corporate Officer and in a form satisfactory to the City Solicitor.

 

5.         City Council authorize each of the Chief Corporate Officer and the Director of Real Estate Services severally to accept the Offer to Purchase on behalf of the City.

 

6.         City Council grant authority to direct a portion of the proceeds of closing to fund the outstanding expenses related to the Highway and the completion of the sale transaction.

 

7.         City Council authorize the City Solicitor to complete the transaction on behalf of the City, including paying any necessary expenses, amending the closing, due diligence and other dates, and amending and waiving terms and conditions, on such terms and as she considers reasonable.

Summary

In conjunction with the redevelopment of Don Mount Court by Toronto Community Housing Corporation, Transportation Services staff was requested to investigate the feasibility of closing the portion of Carroll Street extending between Thompson Street and Davies Avenue and a portion of Thompson Street, for incorporation into the abutting Joel Weeks Park.

 

As a new public highway system will be constructed as part of the redevelopment of Don Mount Court, the portion of Carroll Street and Thompson Street to be closed are not required for Transportation Services purposes and can be permanently closed.

Financial Impact

Parks, Forestry and Recreation has secured three Letters of Credit for a total amount of $571,882 from the Toronto Community Housing Corporation (TCHC) as Condition No. 34 of OMB Decision/Order No. 2673 for the development of Joel Weeks Park.

 

The project scope has not been yet determined as the park’s design is in its final stage, however Parks, Forestry and Recreation intends to work within the available resources.  Once the design stage is completed, the appropriate projects will be included into the 2011 Parks, Forestry and Recreation Capital Budget Submission for consideration.  Request for operating funding required for this park will be submitted for consideration with the Parks, Forestry and Recreation future year operating budget submissions.

Transportation Services recommends that:

 

1.         City Council direct that traffic calming not be installed on Wineva Avenue, between Queen Street East and Williamson Road.

Summary

Transportation Services staff have reviewed the need for a traffic calming island on Wineva Avenue, between Queen Street East and Williamson Road.  Our assessment indicates the criteria as set out in the traffic calming policy has not been satisfied; therefore, traffic calming should not be installed on Wineva Avenue at this time.  The impact of implementing street-based permit parking was also reviewed to address concerns with parking lost due to the island.  On this section of Wineva Avenue there are 40 parking spaces and 36 permits issued.

Financial Impact

The adoption of the above-noted recommendation will not result in any financial impact. If, however, Toronto and East York Community Council decides that traffic calming on Wineva Avenue, between Queen Street East and Williamson Road, would be beneficial, the following financial impact will result:

 

1.         The estimated cost for a traffic calming island would be $10,000.00.  The estimated cost to adjust the permit parking area signs would be negligible.  Funds in the amount of $418,000.00 have been allocated in the Transportation Services 2010 Capital Budget for traffic calming initiatives.  Traffic calming on Wineva Avenue would be subject to competing priorities and funding availability.

1.         Approve the installation of the decorative sidewalks with natural stone and decorative custom lighting within the public right of way on Montclair Avenue and Spadina Road, subject to the Forest Hill Village BIA entering into an encroachment agreement with the City of Toronto, agreeing but not limited to the following:

 

a.         maintain the decorative sidewalks with natural stone and decorative custom lighting at their own expense in good repair and a condition satisfactory to the General Manager of Transportation Services and will not make any additions or modifications to the encroachments beyond what is allowed under the terms of the Agreement;

 

b.         indemnify the City and utility/telecommunication companies of any damage sustained to the decorative sidewalks with natural stone in the event of a need to access the area;

 

c.         remove the decorative sidewalks with natural stone and decorative custom lighting, upon receiving 90 days' written notice to do so;

 

d.         obtain clearance and/or sign off from Toronto Parks, Forestry and Recreation, Urban Forestry group and the Electrical Safety Authority;

 

e.         pay for the costs of preparing the agreement; and

 

f.          accept such additional conditions as the City Solicitor or the General Manager of Transportation Services may deem necessary in the interest of the City;

 

2.         Request Legal Services to prepare and execute the Encroachment Agreement.

As the decorative sidewalks and decorative custom lighting will not negatively impact on the public right of way, Transportation Services recommends approval of these encroachments.

Transportation Services recommends that Toronto and East York Community Council:

 

1.         Approve the maintenance of a glycol heating system and light post that will encroach within the public right of way fronting 36 Astley Avenue, subject to the owners entering into an encroachment agreement with the City of Toronto, agreeing to but not limited to the following:

 

a.         indemnify the City from and against all actions, suits, claims or demands and from all loss, costs, damages, and expenses that may result from such permission granted;

 

b.         maintain the glycol heating system and light post at their own expense in good repair and a condition satisfactory to the General Manager of Transportation Services and will not make any additions or modifications to the encroachment beyond what is allowed under the terms of the Agreement;

 

c.         pay for the costs of preparing the Agreement and the registration of the Agreement on title;

 

d.         remove the glycol heating system and/or light post upon receiving 90 days' written notice to do so; and

2.         Direct Legal Services and/or the General Manager of Transportation Services to extend the Encroachment Agreement to the new owner, in the event of sale or transfer of the property abutting the encroachment, subject to the approval of the General Manager of Transportation Services.

Recommendations

Staff of Toronto Water, Transportation Services and the Toronto Parking Authority recommend that:

 

1.         In accordance with the requirements of Section 3.2.5.7 (2) of Ontario Regulation 350/06, the existing fire hydrants at Nos. 566, 596, 628, 722, and 838 St. Clair Avenue West not be relocated to create additional parking spaces.

Summary

The purpose of this Staff Report is to reply to the Toronto East York Community Council Decision Document No. TE32.124 dated March 9, 2010 and specifically to report on the feasibility of relocating the existing mid-block fire hydrants along St. Clair Avenue West between Bathurst Street and Winona Drive closer to the corners so as to increase available parking spaces.  

 

In the process of putting together this report, staff from Transportation Services, Technical Services, Toronto Water, and the Toronto Parking Authority all investigated the existing conditions along St. Clair Avenue West and provided comments on possible ways to increase available parking spaces.

 

The review conducted by Transportation Services concluded that the fire hydrants at Nos. 838, 722, 596, and 566 St. Clair Avenue West could potentially be relocated from their existing locations to adjacent “No Parking” zones.   

 

The Toronto Parking Authority indicated that the relocation of  the hydrants would increase the on-street inventory by one or two spaces per location. The relocation of the hydrants would not impact on the Authority’s cost or have any other operational impacts.

 

Field investigations conducted by Toronto Water staff revealed that this stretch of St. Clair Avenue West is serviced by eleven fire hydrants on the north side and two on the south side of the street, with horizontal spacing between hydrants presently ranging from 47.3 metres to 178.5 metres. Ontario Regulation 350/06 (Building Code Act, 1992) Section 3.2.5.7 (2) regulates the maximum spacing between fire hydrants to be 90 metres. The hydrants identified by Transportation Services for potential relocation at Nos. 566, 596, 628, 722, and 838 St. Clair Avenue West cannot be relocated to the side street intersections as the spacing would exceed the required minimum of Ontario Regulation 350/06.

 

Technical Services, reported that the issue of relocating the existing mid-block fire hydrants to the corners was addressed in 2009, and that all the hydrants that could be moved were already moved during the TTC track reconstruction.  There was one additional hydrant that was to have been installed at Arlington Avenue during the TTC track reconstruction. Due to unresolved issues at the time of construction however, the installation of the hydrant was delayed until the spring of 2010. Once this hydrant is installed, the existing 178.5 metre spacing reported by Toronto Water will be reduced.

I would like to recommend that, despite subsection 918-21B of Toronto Municipal Code Chapter 918, Parking on Residential Front Yards and Boulevards ("Chapter 918"), City Council grant authority to the General Manager of Transportation Services to accept an appeal from the applicant(s) for front yard parking for 336 Howland Avenue to Toronto and East York Community Council in accordance with the appeal process outlined in subsection 918-21A.

Summary

The new owners of this property discovered that their front yard parking space was illegal, even though it has existed for 30 years on a side of the street where each and every other property has a front yard parking space. The property owners have agreed to reconstruct the pad in an environmentally-friendly way and enhance the streetscape with more greening on the front yard.

 

The property in question is located within the area of the former City of Toronto in that portion of Ward 21 located south of St. Clair Avenue West. Given that this property falls within that portion of Ward 21 located south of St. Clair Avenue West, pursuant to subsection 918-5B of Chapter 918, the General Manager of Transportation Services shall not accept a front yard parking application for front yard parking for this residential address.

 

Further, given its location in Ward 21, according to subsection 918-21B, this property shall not be entitled to file an appeal pursuant to subsection 918-21 of Chapter 918 unless the property has no other alternative parking option and meets the physical requirements set out in Chapter 918.

 

In this instance, the property in question does have alternative parking as there is on-street permit parking in this area. Accordingly, pursuant to the provisions of Chapter 918, the property is ineligible to appeal.

The applicant is proposing to build an addition and construct a new driveway and parking area that would require the removal of two (2) privately-owned red oak trees. The construction will also impact the roots of two (2) additional red oak trees.

 

Urban Forestry is prepared to issue removal and injury permits for the four (4) oak trees conditional on the implementation of approved tree protection measures, tree replacement planting, and the applicant only proceeding with removal and injury once approval has been obtained from City Planning and Toronto Building.

Ontario Municipal Board Hearing - 2 St. James Court

Recommendations

That Council authorize the City Solicitor and any relevant Staff to attend at all proceedings before the Ontario Municipal Board pertaining to 2 St. James Court and to hire any consultants required to uphold the decision of the Committee of Adjustment.

Summary

The owner of 2 St. James Court has appealed a decision of the Toronto and East York Committee of Adjustment to refuse an application for variances to Zoning By-law 438-86.  A copy of the Committee's decision is attached.  The Ontario Municipal Board has not yet set a hearing date for the appeal.  This property was the subject of an Ontario Municipal Board hearing in 2008.  In that case, the City Solicitor attended in opposition and the Board did not allow the requested variances.  The current application is also not appropriate for the development of the property.

 

The applicant has brought a Motion before the Board seeking an Order for Disclosure and an Order that the Board rule separately on each of the requested variances.  The Board has set June 14, 2010 to hear the Motion.  A date will also likely be set in the near future for a hearing of the appeal of the Committee's decision.
